Consent to Collection and Use of Data. You acknowledge and agree that Apple and its affiliates and agents may collect, maintain, process and use diagnostic, technical, usage and related information, including but not limited to unique system or hardware identifiers, cookies or IP addresses, information about Your use of the Service, Your MDM Server, Device Enrollment Settings, computers, devices, system and application software, and other software and peripherals, that is gathered periodically to facilitate the provision of services to You related to the Service, to provide, test and improve Apple’s devices and services, for internal purposes such as auditing, data analysis, and research to improve Apple’s devices, services, and customer communications, to facilitate the provision of software or software updates, device support and other services to You (if any) related to the Service or any such software, for security and account management purposes, and to verify compliance with the terms of this Agreement. Data collected pursuant to this Section will be treated in accordance with Apple’s Privacy Policy, which can be viewed at: xxxx://xxx.xxxxx.xxx/legal/privacy.
Consent to Collection and Use of Data. You agree that Roku may gather data on the usage of Your Channel Application and share with third parties such usage data aggregated with data regarding other Channel Applications, provided that Roku agrees to maintain the specific data regarding Your Channel Application confidential.

Apple may use this information, as long as it is in a form that does not personally identify You for the purposes described above. To enable Apple’s partners and third party developers to improve their software, hardware and services designed for use with the Program and/or with Apple products or services, Apple may also provide any such partner or third party developer with a subset of diagnostic information that is relevant to that partner’s or developer’s software, hardware and/or services, as long as the diagnostic information is in a form that does not personally identify You. Data collected pursuant to this Section will be treated in accordance with Apple’s Privacy Policy, which is incorporated by reference into this Agreement and which can be viewed at: xxxx://xxx.xxxxx.xxx/legal/privacy.
Consent to Collection and Use of Data. In order to test, provide and improve Apple’s products and services, and only if you choose to install or use Pre-Release Materials provided as part of the developer seeding process, you acknowledge that Apple and its subsidiaries and agents may be collecting diagnostic, technical, usage and related information from Pre-Release Materials. Apple will notify you about the collection of such information on the Apple Developer portal, and you should carefully review the release notes and other information disclosed by Apple in such location prior to choosing whether or not to install or use any such Pre-Release Materials. By installing or using such Pre-Release Materials, You acknowledge and agree that Apple and its subsidiaries and agents have your permission to collect any and all such information and use it as set forth above.

In order to test and improve Apple’s products and services, and unless You or Your Authorized Developers opt out as set forth below, You acknowledge that Apple and its subsidiaries and agents will be collecting, using, storing, processing and analyzing (collectively, “Collecting”) diagnostic, technical, and usage logs from Your Authorized Test Devices (that are running such pre-release versions of iOS) as part of the developer seeding process. This information will be Collected in a form that does not personally identify You or Your Authorized Developers and may be Collected from Your Authorized Test Devices at any time, including when You or Your Authorized Developers sync to iTunes or automatically over a secure over-the-air connection. The information that would be Collected includes, but is not limited to, general diagnostic and usage data, various unique device identifiers, details about hardware and operating system specifications, performance statistics, and data about how You use Your Device and applications, and, if Location Services is enabled for Diagnostics, the location of the Device at least once per day, the location where a call ends, and the wireless/cellular network coverage and current radio conditions at a particular location. By installing or using pre-release versions of iOS on Your Authorized Test Devices, You acknowledge and agree that Apple and its subsidiaries and agents have Your permission to Collect all such information and use it as set forth above. If You do not agree to the foregoing, You may choose to turn off Diagnostics by going to Settings > General > About > Diagnostics & Usage on the Device. You can also choose to turn off Location Services for Diagnostics at any time. To do so, open Settings, tap Location Services, tap System Services and turn off the Diagnostics switch on the Device.

Consent to Collection and Use of Data. You hereby grant to Guardrail a non-exclusive, royalty-free, transferable, perpetual, irrevocable, worldwide, fully paid-up license (with rights to sublicense, including, without limitation, through multiple tiers of sublicensees) to use, reproduce, prepare derivative works, distribute, perform, display, and otherwise exploit the Your usage data in connection with Guardrail™s (and its successors™ and affiliates™) business and for the purpose of providing and improving the Service. Guardrail may process aggregated and anonymous usage data and extracts of Your usage data on an anonymized basis for Guardrail™s legitimate business purposes. Nothing in this Section 9.2 gives Guardrail the right to publicly identify You or any individual user as the source of such aggregated and anonymized data. For the avoidance of doubt, this license survives any termination or expiration of this Agreement.

In order to provide, test and help Apple, its partners, and third party developers improve their products and services, and unless you opt out in the pre-release versions of Apple's operating system, as applicable, you acknowledge that Apple and its subsidiaries and agents will be collecting, using, storing, transmitting, processing and analyzing (collectively, “Collecting”) diagnostic, technical, and usage logs and information from your devices or computers that are running such pre- release versions of Apple’s operating system software as part of this Beta Program. This information will be Collected in a form that does not personally identify you and may be Collected from your devices or computer at any time. The information that would be Collected includes, but is not limited to, general diagnostic and usage data, various unique device identifiers, various unique system or hardware identifiers, details about hardware and operating system specifications, performance statistics, and data about how you use your devices, computer, system and application software, and peripherals, and, if Location Services is enabled, certain location information. You agree that Apple may share such diagnostic, technical, and usage logs and information with partners and third party developers for purposes of allowing them to improve their products and services that operate on or in connection with Apple-branded products. By installing or using pre-release versions of Apple’s operating system software on your devices or computers, you acknowledge and agree that Apple and its subsidiaries and agents have your permission to Collect all such information and use it as set forth above.

The information that would be Collected includes, but is not limited to, general diagnostic and usage data, various unique system or hardware identifiers, information about your computer, system and application software, and peripherals, and, if Location Services is enabled, the real-time geographic location of your computer and location search queries. By installing or using pre-release versions of OS X on your computer, you acknowledge and agree that Apple and its subsidiaries and agents have your permission to Collect all such information and use it as set forth above. If You do not agree to the foregoing, you may opt out by changing Your Diagnostics & Usage and/or Location Services settings in System Preferences on your computer.
