Construction Labour Relations - An Alberta. Association Dues and Initiatives Fees (a) in satisfaction of the Employers' obligations to the Association under section of the Alberta Labour Relations Code and in satisfaction of the Employers' obligations under this Collective Agreement, the Employer shall pay to Construction Labour Relations An Alberta Association (the the contribution rates for sponsored initiatives, and the hourly dues levied by the pursuant to section of the Code and pursuant to this Collective Agreement. The amounts of the contribution rates and dues shall be established by the and any or all of them may be changed by the Board of Directors of Construction Labour Relations An Alberta Association, and notice to an Employer and the Union from the Association respecting such amendment shall be sufficient. the event of a failure on the part of any Employer to contribute to the Association the contribution rates and dues required to be contributed pursuant to section of the Labour Relations Code and pursuant to this Letter of Understanding, the Association may, at the sole choice and prerogative of the Association, the dues as a debt payable by application to the Labour Relations Board by other civil action, or may collect the dues by way of a grievance filed, notwithstanding any other provision of this Collective Agreement, by the Association in its own name against the subject Employer. Such a grievance may be referred by the Association to arbitration without being processed through any intervening steps other than written notice of the grievance and the reference of the grievance to arbitration. The Parties to the grievance for the purposes of appointment of the Arbitration tribunal shall be the Association and the subject Employer. The Association may not, however, simultaneously pursue a violation of this Article through application to the Labour Relations Board civil action and through the grievance procedure.
