Construction Progress Report. On or before the tenth (10th) day following the end of a calendar quarter during the Term, Seller shall provide to Buyer a report stating (i) the expected online date of any Generating Unit under construction, (ii) the estimated percent completion of such Generating Unit, (iii) an update on the status of any permits or licenses required for operation of the Generating Unit, and (iv) any issues that may cause a change in the expected online date. The first Construction Progress Report shall be provided by Seller within ten (10) Business Days following the Effective Date. Each Construction Progress Report shall be signed by an officer of Seller verifying that the Construction Progress Report is true and accurate.

Construction Progress Report. The Loan Servicer shall have received, in form and substance satisfactory to each Relevant Credit Party in consultation with the Lenders’ Engineer: (a) the most recent Construction Progress Report, certified by the Borrower as being accurate and complete in all material respects based upon the Borrower’s good faith reasonable estimates of the information contained therein with respect to the following: (i) Construction of the Project is proceeding in accordance with the Project Milestone Schedule and the Construction Budget, or if construction is not proceeding in accordance with the Project Milestone Schedule and the Construction Budget, then the Construction Progress Report shall describe any variances and state that the variances could not reasonably be expected to have a Material Adverse Effect; (ii) Total Funding Available is sufficient to pay all remaining Total Project Costs (including Interest During Construction, DOE Credit Facility Fees, Periodic Expenses, and identified Cost Overruns); and (iii) evidence that as of the date of such Construction Progress Report (A) each Construction Contractor, any sub-contractor, and the Operator shall have irrevocably waived and released all Liens, statutory or otherwise, that any of them may have or acquire on the Collateral Security with respect to work completed prior to the last submission for payment, except for Liens in favor of any Person in an aggregate amount for such Person not greater than $50,000; and (B) all unpaid balances that are due or unsettled claims with any Construction Contractor or any sub-contractor, if any, have been adequately paid and that those being contested or negotiated in good faith are provisioned to the reasonable satisfaction of each Relevant Credit Party; and (b) certification from the Borrower and the Lenders’ Engineer that as of the Periodic Approval Date: (i) there is no reason to believe that anything is incorrect or misleading in any material respect in the most recent Construction Progress Report; and (ii) nothing has occurred since the date of the most recent Construction Progress Report or the date of the Lender’s Engineer’s most recent site visit, whichever is later, that could reasonably be expected to prevent construction of the Project in accordance with the Project Milestone Schedule and the Construction Budget.
Construction Progress Report. The Financing Parties shall have received from the Borrower the most recent Construction Progress Report substantially in the form of Exhibit E and required to be delivered pursuant to Section 10.01(r). If any Construction Progress Report shall have indicated the absence of Material Compliance with the original Ramp and Capital Costs Budget delivered pursuant to Section 6.01(g) or the Ramp Schedule, Ex-Im Bank shall be satisfied in its reasonable discretion that Total Funding Available is adequate for the Borrower to achieve Phase I Completion by the Date Certain.

  • Progress Report By March 1 of each year, ***** will submit a written annual report to Stanford covering the preceding calendar year. The report will include information sufficient to enable Stanford to satisfy reporting requirements of the U.S. Government and for Stanford to ascertain progress by ***** toward meeting this Agreement’s diligence requirements. Each report will describe, where relevant: *****’s progress toward commercialization of Licensed Product, including work completed, key scientific discoveries, summary of work-in-progress, current schedule of anticipated events or milestones, market plans for introduction of Licensed Product, and significant corporate transactions involving Licensed Product. ***** will specifically describe how each Licensed Product is related to each Licensed Patent.

  • Progress Reports The Recipient shall submit to the OPWC, at the OPWC's request, summary reports detailing the progress of the Project pursuant to this Agreement and any additional reports containing such information as the OPWC may reasonably require.

  • Construction Progress Schedule A schedule indicating proposed activity sequences and durations, milestone dates for receipt and approval of pertinent information, preparation, submittal, and processing of Shop Drawings and Samples, delivery of materials or equipment requiring long-lead time procurement, and proposed date(s) of Material Completion and Occupancy and Final Completion. The schedule will be developed to represent the sixteen or seventeen CSI Specification Divisions. It shall have a minimum number of activities as required to adequately represent to Owner the complete scope of work and define the Project’s critical path and associated activities. If the Project is to be phased, then each individual Phase should be identified from start through completion of the overall Project and should be individually scheduled and described, including any Owner’s occupancy requirements and showing portions of the Project having occupancy priority. The format of the schedule will have dependencies indicated on a monthly grid identifying milestone dates such as construction start, phase construction, structural top out, dry-in, rough-in completion, metal stud and drywall completion, equipment installation, systems operational, Material Completion and Occupancy Date, final inspection dates, Punchlist, and Final Completion date.
