Content Use Limitations. Your use of the Services and its Content, whether supplied by us, any other User, or any other third party may only be used for the lawful and intended purposes expressly authorized by us. Any misuse or unauthorized use of the Services, the Content, or other violations of the TOS, may violate applicable law, including, but not limited to, copyright laws (including the Digital Millennium Copyright Act), trademark laws, laws of privacy, laws of publicity, identity theft, and communications statutes and regulations. You agree and authorize Go Beyond to terminate your account and access to the Services at any time with or without notice and report you to the appropriate authorities and/or other interested parties, such as a claimed intellectual property owner if we become aware of any such misuse or unauthorized use.

Content Use Limitations. You may use the Portal and its videos, webinars, images, infographics, alerts, text, articles, assessments, checklists, forms, ratings, design, data, source code, analytics, photos, software, trademarks, copyrights, and other information ("Content") only for the lawful and intended purposes expressly authorized by DirectCF. You may not modify, reproduce, transmit, distribute, display publicly, perform, or create derivative works from that Content. Any misuse or unauthorized use of the Portal and its Content, or other violations of the Terms may violate Applicable Law (see below), including without limitation SEC regulations and applicable state securities laws, copyright laws (including the Digital Millennium Copyright Act), trademark laws, patent laws, the laws of privacy, laws of publicity, laws governing identity theft, and communications statutes and regulations, in which case DirectCF may terminate your Account and access to the Portal at any time and without notice and report you to the appropriate authorities and other interested parties, such as someone claiming an intellectual-property interest. Even if such Content or activity does not violate Applicable Law, you are prohibited from posting or transmitting any material on or through the Portal that, in DirectCF’s sole opinion, is or could be offensive, fraudulent, unlawful, threatening, disingenuous, libelous, defamatory, obscene, scandalous, inflammatory, pornographic or profane, or that constitutes anti- competitive collaboration or antitrust violations, or any material that could constitute or encourage conduct that might be a criminal offense, give rise to civil liability, or otherwise violate any Applicable Law. DirectCF will cooperate with any law enforcement authorities or court order requesting or directing DirectCF to disclose the identity of anyone posting any such information or materials on the Portal. By posting Content on the Portal, you represent and warrant that you have all necessary rights or permissions to make the Content available on the Portal and acknowledge that no postings on the Portal are confidential and that all postings are available for public viewing.   • Use Limitations Your license is solely for the purposes of creating, presenting, hosting, analyzing, viewing and delivering Events (as defined below) to Authorized Users, subject to any limitation of Seats (as defined below) specified in the Order Form. “Event” means a single live broadcast event transmitted over the SaaS Service created and/or sponsored in whole or substantial part by Customer or Customer’s employees that is branded under Customer’s name. The term “Events” shall include both live and archived Events. “Seat” means each Authorized User served by a stream of digitally encoded data that delivers an Event to such Authorized User in the SaaS Service and shall include an Authorized User’s access to live Events and archived Events but does not include an access to a downloaded archived Event. A limitation on a number of Seats limits the number of unique Authorized Users of the Service.

  • License Limitations You may not distribute, redistribute, sell, resell, transfer, rent, lease, or sublicense the Progress Telerik JustMock Product Package or any portions thereof.

  • Xxxxx of License; Limitations The Engineer is granted a limited revocable non-exclusive license to use the registered TxDOT trademark logo (TxDOT Flying “T”) on any deliverables prepared under this contract that are the property of the State.   • Service Use Restrictions In connection with your use of the Services, you sha l not in any way transmit, publish, post, upload, disseminate, or distribute any (i) corrupted files, viruses, trojan horses, worms, spyware, time bombs, cancelbots, or any other similar software or programs; and/or ( i) defamatory, infringing, vulgar, sexua ly explicit, obscene, indecent, o fensive, inappropriate, profane, or unlawful content or any hate speech (i.e., racist/discriminatory speech). You sha l also not (i) impair anyone else from using the Services or interfere with the proper functioning of the Services; ( i) access the Services (including by use of robots, scripts, spiders or other automated means) other than via the means provided by us; ( i) misrepresent your identity in any way; (iv) overburden the Services in any way; and/or (v) violate any law, rule or regulation in connection with your use of or access to the Services.

  • General Use Restrictions Licensee shall not use, copy, merge, or transfer copies of the SOFTWARE or the Documentation except as may be expressly and specifically authorized in this Agreement. Licensee shall not knowingly take any action that would cause the SOFTWARE to be placed in the public domain.
