Contents of Requests. (1) In all cases requests for assistance shall indicate:
(a) the competent authority conducting the investigation or proceedings to which the request relates;
(b) the nature of the investigation or proceedings, and include a summary of the facts and a copy of the applicable laws;
(c) the purpose of the request and the nature of the assistance sought;
(d) the degree of confidentiality required and the reasons therefor; and
(e) any time limit within which the request should be executed.
(2) In the following cases requests for assistance shall include:
(a) in the case of requests for the taking of evidence, search and seizure, or the location, restraint or forfeiture of proceeds of crime, a statement indicating the basis for belief that evidence or proceeds may be found in the Requested State;
(b) in the case of requests to take evidence from a person, an indication as to whether sworn or affirmed statements are required and a description of the subject matter of the evidence or statement sought;
(c) in the case of lending of exhibits, the current location of the exhibits in the Requested State and an indication of the person or class of persons who will have custody of the exhibits in the Requesting State, the place to which the exhibit is to be removed, any tests to be conducted and the date by which the exhibit will be returned;
(d) in the case of making detained persons available, an indication of the person or class of persons who will have custody during the transfer, the place to which the detained person is to be transferred and the date of that person=s return;
(3) If necessary and where possible requests for assistance shall include:
(a) the identity, nationality and location of the person or persons who are the subject of the investigation or proceedings;
(b) details of any particular procedure or requirement that the Requesting State wishes to be followed and the reasons therefor
(4) If the Requested State considers that the information is not sufficient two enable the request to be executed, it may request additional information.
(5) Requests shall be made in writing. In urgent circumstances, a request may be made orally but shall be confirmed in writing promptly thereafter.
Contents of Requests. Each request for a reclassification shall contain eight (8) copies [four (4) to the District and four (4) to CSEA] of the following:
1. A cover letter stating an overview of the request.
2. A letter from the employee’s supervisor is strongly recommended but not required stating that he/she has reviewed all documentation in support of the employee’s request for reclassification and also stating his/her recommendation and reasons for such recommendation regarding the request. Upon receipt of the documentation, the supervisor shall not alter the employee’s assignment pending the outcome of the reclassification negotiation.
3. The current job description.
4. A proposed job description.
5. A letter outlining the additional duties acquired over a period of time that differs from the current job description and justifying the request.
6. Current and proposed salary ranges.
7. Any other relevant information including data supporting the request.
Contents of Requests. 1. Requests for assistance shall:
(a) indicate the name of the competent authority conducting the investigation, prosecution or other proceedings to which the request relates;
(b) specify the purpose of the request and the nature of the assistance sought;
(c) identify the person, agency or authority that initiated the request;
(d) include a description of the nature of the criminal matter, including a summary of the relevant facts and laws and applicable penalties;
(e) include a Statement indicating the current status of the investigation or proceeding;
(f) include a Statement specifying any time frame within which compliance with the request is desired.
2. Requests for assistance, where relevant and so far as possible, shall also include:
(a) the identity, nationality and location of the person or persons who are the subject of, or who may have information relevant to, the criminal matter;
(b) where the request is for assistance under Article 11:-
(i) in the case of requests to take evidence from a person, an indication as to whether sworn or affirmed Statements are required and a description of the matter about which persons are to be examined including, where appropriate, any questions that the Requesting Party wishes to put to those persons;
(ii) a description of any documents, records or articles of evidence to be produced and, where relevant, a description of the appropriate person to be asked to produce them;
(c) in the case of lending of exhibits, the current location of the exhibits in the Requested Party and an indication of the person or class of persons who will have custody of the exhibits in the Requesting Party, the place to which the exhibit is to be taken, any tests to be conducted and the date by which the exhibit will be returned;
(d) in the case of making persons in custody available, an indication of the person or class of persons who will have custody during the transfer, the place to which the person in custody is to be transferred and the probable date of that person’s return;
(e) where the request is for assistance under Article 13 or 14, information about the allowances and expenses to which a person traveling to the Requesting Party would be entitled;
(f) where the request is for assistance under Article 10 or Article 16 or Article 17 a description of the material sought and, where relevant, its likely location;
(g) where the request is for assistance under Article 16 or Article 17:-
(i) a Statement outlining the basis of Request...
Contents of Requests. 1. Requests for assistance shall be in writing and include:
(a) the name of the authority on behalf of which the request is made;
(b) a description of the purpose of the request and the nature of the assistance requested;
(c) a description of the nature of the investigation, prosecution, offence or criminal matter;
(d) a summary of the relevant facts (date, place and circumstances in which the offence was committed) giving rise to the investigation or proceedings in the Requesting Party, unless the request is one for service within the meaning of Article 17;
(e) the text of the statutory provisions or where this is not possible a statement of the relevant law applicable;
(f) where possible, the complete name, place and date of birth, nationality and address of the person who is the subject of the investigation or proceedings as of the date the request is made;
(g) any requirements for confidentiality;
(h) details of any particular procedure the Requesting Party wishes to be followed;
(i) details of the period within which the request should be complied with.
Contents of Requests. 1. In all cases requests for assistance shall include:
a) the name of the competent authority conducting the investigation or proceedings to which the request relates,
b) a description of the nature of the investigation or proceedings, including a summary of the relevant facts and laws,
c) the purpose for which the request is made and the nature of the assistance sought;
d) where possible, the identity, nationality and location of the person or persons who are the subject of the investigation or proceedings;
e) a statement as to whether assistance should be provided by a court or some other authority,
f) the need, if any, for confidentiality and the reasons therefor; and
g) any time limit within which compliance with the request is desired.
Contents of Requests. (1) Requests shall be made in writing. In urgent circumstances, or where otherwise permitted by the Requested Party, requests may be made by facsimile transmission or other electronic method, provided that a duly signed request is subsequently forwarded without delay.
(2) Requests for assistance shall include a statement of:
a) the name of the competent authority conducting the investigation or proceedings to which the request relates:
b) the matters, including the relevant facts and laws, to which the investigation or proceedings relates;
c) the purpose for which the request is made and the nature of the assistance sought;
d) details of any particular procedure or requirement that the Requesting Party wishes to be followed;
e) any time limit within which compliance with the request is desired;
f) where relevant, the identity, nationality and location of the person or persons who are the subject of the investigation proceedings;
g) in the case of a request for the search for or seizure of material, the offence which there are reasonable rounds for believing has been committed in the jurisdiction of the Requesting Party and a description of the conduct constituting that offence.
(3) If the Requested Party considers that the information contained in the request is not sufficient to enable the request to be dealt with, that Party may request that additional information be furnished.
Contents of Requests. Paragraph (1) corresponds to Article 5(2) of the model agreement. Paragraph (2) follows the formulation in Article 4(4) of the HK/US MLA Agreement.
Contents of Requests. Each request shall contain the basis for the suspicion, the geographic position of the vessel, and, if available, the name of the suspect vessel, the registration number, the IMO number, home port, the port of origin and destination, and any other identifying information. If a request is conveyed orally, the requesting Party shall confirm the request in writing by facsimile or e-mail as soon as possible.
Contents of Requests. Each request should be in writing and contain sufficiently reliable information forming the basis for the suspicion, the geographic position of the vessel, the name and physical description of the suspect vessel, and, if available, the registration number/call sign, the IMO number, home port, the port of origin and destination, and any other identifying information. Nevertheless, in urgent circumstances, a request may be made orally, but shall be confirmed in writing forthwith. The time limits established in paragraph 4 of this Article shall commence on receipt of a written request by the Competent Authority of the requested Party. The requested Party shall immediately acknowledge in writing to the Competent Authority of the requesting Party its receipt of all written requests.
