Cooperation by Contractor. The Contractor shall at all times have on the work, as his agent, a competent superintendent or xxxxxxx thoroughly experienced in the type of work being performed, who shall receive instructions from the Inspector. The superintendent shall have full authority to execute the orders or directions of the Inspector, without delay, and to supply promptly such materials, equipment, tools, labor and incidentals as may be required.
Cooperation by Contractor. Upon request, furnish the Engineer with every reasonable facility for ascertaining whether the work performed and materials used are in accordance with the requirements and intent of the Contract Documents. If the Engineer so requests at any time, remove or uncover portions of finished work as directed. After examination, restore the uncovered portions of the work to the standard required by the Contract Documents. If the Engineer determines that the work so exposed or examined is unacceptable, perform the uncovering or removal, and the replacing of the covering or making good of the parts removed, at no expense to the Department. However, if the Engineer determines that the work thus exposed or examined is acceptable, the Department will pay for the actual costs incurred by uncovering or removing, and the replacing of the covering or making good of the parts removed.
Cooperation by Contractor. No work shall be done nor materials used, without suitable supervision or inspection by the Engineer or his representative, and Contractor shall furnish the Engineer with every reasonable facility for ascertaining whether the work performed and materials used are in accordance with the requirements and intent of the plans and specifications. If the Engineer so requests, Contractor shall, at any time before final acceptance of the work, remove or uncover such portions of the finished work as may be directed. After examination, Contractor shall restore the uncovered portions of the work to the standard required by the specifications. Should the work so exposed or examined prove unacceptable, the uncover or removal, and the replacing of the covering or making good of the parts removed, shall be at Contractor’s expense. However, should the work thus exposed or examined prove acceptable, the uncovering or removing, and the replacing of the covering or making good of the parts removed, shall be paid for as Unforeseeable Work.
Cooperation by Contractor. D-BE shall not perform work or furnish materials without obtaining inspection by the OWNER. D-BE shall provide the OWNER with safe means of access to the work, so the OWNER can determine whether the work performed, and materials used are in accordance with the requirements and intent of the Contract Documents. If the OWNER so requests at any time before final acceptance of the work, the D-BE shall remove or uncover such portions of the finished work as directed. After examination, restore the uncovered portions of the work to the standard required by the Contract Documents. If the OWNER determines that the work so exposed or examined is unacceptable, D-BE shall perform the uncovering or removal, and the replacing of the covering or making good of the parts removed, at no expense to the OWNER. However, if the OWNER determines that the work thus exposed or examined is acceptable, the OWNER will pay for the uncovering or removing, and the replacing of the covering or making good of the parts removed in accordance with 14.2.
Cooperation by Contractor. Whenever requested by Company, CONTRACTOR agrees to assist and cooperate with Company, at Company’s expense, in:
(a) the obtaining, maintaining and enforcing of United States and foreign patents for any Invention. This assistance and cooperation shall include, but is not limited to:
(i) making application for United States and foreign patents on any Invention if so requested by Company;
(ii) assigning all of CONTRACTOR’s right, title and interest in and to such Invention and any patent, applications thereon to Company or its designee;
(iii) executing all documents and rendering all assistance as may be reasonably necessary to protect the rights of Company or its designee and to vest in Company or its designee all rights to any such Invention, patent application, or patent;
(b) the registering, maintaining and enforcing of any United States or foreign copyright, mask work or trademark in any Proprietary Information; and
(c) otherwise seeking, maintaining and enforcing any legal rights to any Proprietary Information, including trade secrets, of Company.
Cooperation by Contractor. The City shall supply Contractor with five copies of the Plans and Specifications. Contractor shall have said Plans and Specifications available at the Project at all times during the prosecution of the Work. Contractor shall give the Work its constant attention to facilitate progress and shall cooperate with the Engineer in setting and preserving stakes, benchmarks, etc., and in all other things that are necessary for satisfactory completion of the Work. Contractor shall have a competent and reliable superintendent acting as Contractor’s representative on the job at all times. This representative shall supervise all of Contractor’s workforce, including its subcontractors, during all phases and in all aspects of the Work. All orders from the Engineer shall be directed through the superintendent. Contractor shall provide a list, as deemed necessary by the Engineer, of emergency contacts, including names and 24-hour telephone numbers, to the City.

For bridge projects with construction operations accessible only by watercraft, provide safe passage and transport to facilitate the Engineer’s inspection of the Work. However, if the Engineer determines that the work thus exposed or examined is acceptable, the Department will pay for the actual costs incurred by uncovering or removing, and the replacing of the covering or making good of the parts removed.
Cooperation by Contractor. The Contractor shall supervise and direct the work, using its best skills and attention. The Contractor is responsible for all maintenance means, methods, techniques, and procedures, for coordinating all portions of the work, and for cooperating with Department personnel and with other contractors in every way possible. The Contractor shall have on the work site at all times, as an agent, a competent superintendent capable of reading and thoroughly understanding the work directive and specifications and thoroughly experienced in the type of work being performed, who shall receive instructions from the Engineer, Contract Administrator, Inspector or other authorized representative of the Department. The superintendent shall have full authority to execute orders or directions of the Engineer, Contract Administrator or Inspector without delay and to promptly supply such materials, equipment, tools, labor, and incidentals as may be required. The Contractor shall furnish a superintendent irrespective of the amount of work subcontracted. The Contractor shall furnish to the Engineer, or Contract Administrator and Inspector a list of addresses and telephone numbers of its personnel who may be reached in case of emergency during hours when no work is being performed. On weekends and holidays and during suspensions of work and storms, the Contractor shall alert certain of its personnel to stand by and shall inform the Engineer or Contractor Administrator and Inspector of arrangements so made. The Contractor is responsible to the Department for the acts and omissions of its employees and its subcontractors and their employees or agents and all other persons performing any of the work with the Contractor under the contract.
Cooperation by Contractor. Revise subparagraph a. Causes for Removal as follows: The Engineer may remove the Superintendent or any other key Contractor staff positions included in the Proposal Qualifications Questionnaire at any time if the performance is unsatisfactory or the staff member is uncooperative in their relationship with the Engineer. Add the following to this subsection: The Contractor shall provide the staff indicated in the Proposal Qualification Questionnaires. If staff identified in the Proposal is no longer in the employ of the Contractor during the performance of work under this Contract, then the Contractor shall submit for approval by the Engineer the qualifications of a replacement.
Cooperation by Contractor. The Contractor will be supplied by the Department with copies of the plans, and the Contractor shall have available on the Project site at all times during the prosecution of the Project, a copy of the Contract plans and specifications. The Contractor shall give the Project constant attention to facilitate the progress thereof, shall cooperate with the Department, and shall promptly comply with all orders and directions of the Engineer.
