Cost of Equipment. Each Party shall, at its own expense, obtain and maintain its own System and shall update its System as recommended by the manufacturer/owner/licensor of said System. Furthermore, each Party shall pay its own costs for any and all charges related to Data Transmission under this TPE and specifically including, without limitation, charges for System equipment, software and services, charges for maintaining an electronic mailbox, connect time, terminals, connections, telephones, modems, and any applicable minimum use charges. Each Party shall also be responsible for any and all expenses it incurs for translating, formatting, or sending and receiving communications over the electronic network to the electronic mailbox, if any, of the other Party.
Cost of Equipment. 3.3.1 Allowable costs for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by the XXXX, or a subcontractor at any tier performing cost plus fee work, shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which CPRA can determine both ownership and operating costs from the contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor's accounting records, costs for that equipment shall be based upon the applicable provisions of USACE Engineer Pamphlet (EP) 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region III. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by CPRA. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.
3.3.2 Rates for equipment rented from an organization under common control, lease-purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.
3.3.3 When actual equipment costs are proposed and the total amount of the pricing action exceeds the simplified acquisition threshold (SAT), CPRA shall request the XXXX Contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data shall be submitted using the USACE Standard Form 1411, Contract Pricing Proposal Cover Sheet.
Cost of Equipment. VENDOR is responsible for acquiring and paying for all telecommunications services, software and equipment necessary to enable VENDOR to receive and distribute the ASX Benchmark Data or Agency Information (as the case may be) under this Agreement.
Cost of Equipment. CLEARINGHOUSE is responsible for acquiring and paying for all telecommunications services, software and equipment necessary to enable CLEARINGHOUSE to receive and distribute the ASX Benchmark Data or Agency Information (as the case may be) under this Agreement.
Cost of Equipment. Credit/financing conditions of the equipment supplier. - The condition of maintaining and the capability of supplementing and upgrading the network system. - New and advanced equipment, field proven, with the latest production time.
Cost of Equipment. During the first year of this Agreement, the per unit cost of all Modified Pro Gym Equipment to be charged to Distributor will be an amount not to exceed the per unit prices set forth on Exhibit B. On or prior to the forty-fifth (45th) day prior to each anniversary of this Agreement, Seller will submit to Distributor a written statement outlining the manufacturing cost increases or decreases, if any, in producing Pro Gym Equipment and Modified Pro Gym Equipment and the corresponding per unit sales price increase or decrease, if any, for each piece of Pro Gym Equipment and Modified Pro Gym Equipment, respectively, which price will govern this Agreement for the ensuing twelve (12) month period. Notwithstanding anything in the foregoing to the contrary, each party agrees to use good faith efforts to resolve any disputes regarding any price increases or decreases in existing products or in the establishment of prices for New Pro Gym Equipment and Modified Pro Gym Equipment developed and manufactured by Seller. After the per unit price of New Pro Gym Equipment is established by Seller and Distributor, the price of such New Pro Gym Equipment shall remain the same until modified in accordance with this Section 4.2.
Cost of Equipment. Each party shall provide and be responsible for its own costs for the data processing equipment it uses to send and receive electronic communications.
Cost of Equipment. If equipment required for the provision of services to the Hotel is installed and maintained at the Hotel in connection with the provision of the Global Reservations System or any Centralized Services, all costs thereof shall be identified in the Annual Budget and shall be the responsibility of the Owner and charged as Operating Expenses to the Operation of the Hotel either as (a) a current expense in the Fiscal Year, or (b) a capital expenditure financed by the Owner and charged over a period of years in accordance with the Operator’s Accounting Policies.
Cost of Equipment. Parlier shall bear any and all costs associated with any specifically required upgrades to equipment, including but not limited to licensing, training, computer hardware, computer software and radio equipment necessary for Coalinga to provide Services.
