Costs of Employment Related Legal Proceedings. 17.1 If an Employee is required to attend or participate in a proceeding, hearing, examination, inquiry or investigative process on matters which arise from the performance of the Employee’s duties, the Employer must meet the Employee’s reasonable legal costs relating to the Employee’s appearance and legal representation in the matter. This includes, but is not limited to, a matter before a Royal Commission, Independent Broad-based Anti-Corruption Commission, Ombudsman’s or a Coroner’s inquest. 17.2 Where legal proceedings are initiated against an Employee as a direct consequence of the Employee legitimately and properly performing his or her duties, the Employer will not unreasonably withhold agreement to meet the Employee’s reasonable legal costs relating to the defence of such proceedings. 17.3 Where, as a direct consequence of the Employee legitimately and properly performing his or her duties, it is necessary to obtain an intervention order or similar remedy against a person, the Employer will not unreasonably withhold agreement to meet the Employee’s reasonable legal costs in obtaining the order or other remedy. 17.4 An Employee’s immediate supervisor must ensure that an application to meet reasonable legal costs will be referred to the appropriate person or body to enable the application to be decided expeditiously.

Redeployment Principles are set out in Schedule A. support Employees with unsatisfactory work performance to improve their performance to the required standard; ensure that unsatisfactory work performance is addressed expeditiously; reflect the public sector values of integrity, impartiality, accountability and respect with the aim of ensuring that Employees are treated fairly and reasonably; and provide a fair and transparent framework for action to be taken where an Employee continues to perform below the Employer’s expected standard.

Costs of Employment Related Legal Proceedings. 48.1 If an Employee is required to attend court proceedings on matters that directly arise from the Employee legitimately and properly performing his or her duties, QVM shall meet the Employee's reasonable legal costs relating to appearance at or representation before the court. 48.2 Where legal proceedings are initiated against an Employee as a direct consequence of the Employee legitimately and properly performing his or her duties, QVM will not unreasonably withhold agreement to meet the Employee's reasonable legal costs relating to the defence of such proceedings. 48.3 Without affecting the generality of clauses 48.1 and 48.2 above, an Employee's independent legal costs are deemed to be reasonable if: a) The Employee has acted in good faith in performing his or her duties; and b) QVM and the Employee agree that there is a real risk that the Employee may be exposed to civil or criminal liability in the circumstances of the case; and c) for that reason QVM legal advisors have a conflict of interest in representing both QVM and the Employee; and d) the costs of the independent legal representation are within the agreed limits.
