Court Subpoena Absence. 1. An employee covered by this agreement other than a litigant in the case, who is necessarily absent because of his/her appearance in response to a subpoena shall have no deductions made from his/her salary on account of such absence. Witness fees shall be collected by the employee and remitted to the District.

Court Subpoena Absence. 1. If a regular employee, other than a litigant in the case, is necessarily absent because of his/her appearance before a grand jury; or, in a criminal case, before a court within the State; or, in a civil case, before a court within the county in which the employee resides, or outside such county if within one hundred fifty (150) miles of his/her place of residence, in response to a subpoena fully served, no deduction will be made from the employee’s salary on account of such absence; provided, that each date of necessary attendance in court or before a grand jury, other than the date specified in the subpoena, shall be certified by the clerk or other authorized officer of such court or grand jury; and provided, further, that in any case in which a witness fee is payable, such fee shall be collected by the employee and remitted to the Business Services Division.

  • Subpoena Leave Each Faculty Member shall be granted leave at full pay when subpoenaed as a witness, other than as a defendant or plaintiff, in a criminal or civil trial which has resulted directly from an incident which took place during any District sponsored activity including all class and laboratory sessions, Associated Student Body sponsored events, Athletic contests or required meetings held either on or off the college's campuses.
