Delivery and Term. On or prior to the Service Commencement Date, Exodus shall deliver to Customer, at the designated Customer Area, the Exodus Supplied Equipment. Customer shall have the right to use the Exodus Supplied Equipment for the Initial Term set forth in the Order Form and any additional period agreed to in writing by Exodus. Customer shall not remove any Exodus Supplied Equipment from the Customer Area(s) without the prior written consent of Exodus.

Delivery and Term. 2.01 Sublandlord shall vacate the Sublet Premises no later than September 30, 2007, free and clear of any and all encumbrances, liens, security interests, claims and charges of any kind and deliver the Sublet Premises to Subtenant no later than October 7, 2007 in “AS IS”, “broom clean” condition with all of Sublandlord’s personal property removed therefrom, provided that Sublandlord may leave intact all alterations and improvements existing in the Sublet Premises. 2.02 The term of this Sublease Agreement (the “Term”) shall commence on October 1, 2007 (the “Commencement Date”) and shall expire on September 30, 2012 (the “Termination Date”), unless sooner terminated due to the provisions hereof. Notwithstanding anything to the contrary herein, in no event shall the Term of the Sublease Agreement extend beyond the expiration or earlier termination of the Master Lease, and Subtenant acknowledges that the expiration or any earlier termination of the Master Lease as to the Sublet Premises shall automatically extinguish and terminate this Sublease Agreement, except as may be otherwise expressly permitted by Master Landlord. Sublandlord agrees that it will not enter into an agreement with Master Landlord to terminate the Master Lease prior to the Termination Date of this Sublease Agreement, except in the event of a fire or other casualty or condemnation as provided in the Master Lease.
Delivery and Term. EDS will deliver to Licensee the Licensed Programs and the Documentation at the Designated Location on or before June 1, 1999 or such other date agreed to by the parties in writing. The term of this License will begin on the earlier of (a) the date EDS completes installation of the Licensed Programs and furnishes Licensee written notification of such completion, or (b) the date the Licensed Programs first processes Licensee's Billable Messages to Licensee's reasonable satisfaction (the "Installation Date"), and will continue for sixty (60) months (the "License Term") unless earlier terminated pursuant to Article VII. For purposes of this Agreement, a "Billable Message" means records of those mutually agreed upon and legally permitted (i) telephone calls originated by end-users through Licensee, or (ii) other services provided by Licensee to Licensee's end-users. The original License Term will automatically extend for successive one-year periods thereafter unless either party notifies the other at least ninety days prior to the end of the original License Term or prior to the end of any such one-year extension period, as the case may be, that this Agreement will not be so extended.
Delivery and Term. On or prior to the Service Activation Date, if required, Company shall deliver to Customer, at the designated Customer Location, any contractually obligated Company Supplied Equipment. Customer shall have the right to use the Company Supplied Equipment for the Initial Term set forth in the SOW and any additional period agreed to by Company as defined in this MSA. Customer shall not remove or alter in any manner any Company Supplied Equipment without the prior written consent of Company. Customer will not remove, alter or destroy any labels on the Company Supplied Equipment stating that it is the property of Company and shall allow reasonable access to Company Supplied Equipment for Company employees and/or designated authorized agents. The Customer must provide prior written notice and the written approval from Company before moving any Company Supplied Equipment from the address listed on the applicable SOW and Hand Receipt that accompanies the Company Supplied Equipment.

Customer shall have the right to use the Rental Equipment for the Initial Service Term set forth in the Order Form and any additional period agreed to in writing by C&W. Customer shall not remove any Rental Equipment from the Customer Area(s) without the prior written consent of C&W.
