DEMEANOR AND CONDUCT. While involved in City-initiated tow operations or related business, the tow company owner and/or employees shall refrain from any acts of misconduct including, but not limited to, any of the following: rude or discourteous behavior; lack of service, selective service, or refusal to provide service which the company is capable of performing; any act of sexual harassment or sexual impropriety; unsafe driving practices; or exhibiting any objective symptoms of alcohol or drug use.

DEMEANOR AND CONDUCT. ‌ A. While involved in RCPD rotation tow operations or related business, the tow Operator and/or Employee(s) shall refrain from any act(s) of misconduct, to include, but not be limited to, any of the following: 1) Rude or discourteous behavior. 2) Lack of service, selective service, or refusal to provide service, which the Operator is/should, be capable of performing, including failure to clean the traffic collision scene or tow scene properly. 3) Any act of sexual harassment or sexual impropriety. 4) Unsafe driving practices. 5) Exhibiting any objective symptoms of alcohol and/or drug use. 6) Appearing at the scene of a RCPD rotation tow call with the odor of an alcoholic beverage emitting from his/her breath. If that occurs, the Operator/tow truck driver shall submit to a preliminary alcohol screening test upon demand of the RCPD. 7) Showing up to a scene without proper equipment such as brooms, absorbent and other equipment required by this TSA. 8) Appearing at a scene with improper or offensive clothing. 9) Any violation of the required equipment or safety practice required by the vehicle code. 10) Failure to show up at a scene within the allotted time. 11) All RCPD related tow service complaints received by the RCPD against the Operator or his/her Employee(s) will be accepted and investigated in a fair and impartial manner. As a result of the investigation, the RCPD may initiate disciplinary action as deemed appropriate. In any event, the Operator will be notified of the results of any investigation. 12) Should the filing of criminal charges be a possibility as a result of tow service conduct, the RCPD will conduct the investigation to its conclusion or assist the lead investigating agency and, if warranted, request prosecution. 13) Any violation of this Element shall be cause for suspension, if deemed appropriate by the Chief of Police.‌

Rude or discourteous behavior. 2. Lack of service, selective service or refusal to provide service which the operator is/should be capable of performing. 3. Any act of sexual harassment or sexual impropriety. 4. Unsafe driving practices. 5. Exhibiting any objective symptoms of alcohol and/or drug use. 6. Appearing at the scene of a RPD rotation tow call with the odor of an alcoholic beverage emitting from his/her breath. a. The operator/tow truck driver shall submit to a preliminary alcohol screening test upon demand of the RPD. B. All RPD related tow service complaints received by the RPD against the operator or his/her employee(s) will be accepted and investigated in a fair and impartial manner. When providing the services required under this AGREEMENT, OPERATOR and its employee(s) shall refrain from any act(s) of misconduct, including, but not limited to, any of the following: (1) Rude or discourteous behavior; (2) Lack of service, selective service, or refusal to provide service that OPERATOR or its employees are/should be capable of performing; (3) Any act of sexual harassment or sexual impropriety; (4) Unsafe driving practices; (5) Exhibiting any objective symptoms of alcohol or drug use; (6) Appearing at the scene of a CITY rotation tow call with the odor of alcohol emitting from his/her breath; and (7) Accepting or offering any gratuity pursuant to California Vehicle Code Section 12110. b. All CITY-related tow service complaints received by CITY concerning OPERATOR or its employee(s) will be investigated by CITY in a fair and impartial manner. OPERATOR will be notified of the results of any investigation. Following the investigation, CITY may initiate any action deemed appropriate by CITY in its sole discretion. c. Should criminal charges be filed against OPERATOR, CITY may conduct its own investigation of such charges or assist the lead investigating agency in such investigation and, if deemed warranted by CITY, request prosecution of such charges. d. OPERATOR’s failure to comply with these requirements shall be a material breach of this AGREEMENT and grounds for immediate termination of this AGREEMENT by CITY. e. Records of any breach of this AGREEMENT shall be retained by LPD for not less than thirty-six (36) months from the date of the incident giving rise to the breach.

Use of radios or other music equipment or telephone ringers at levels that are excessively loud or cause disturbance to neighbors, as determined in IPD’s sole and absolute discretion. 8. Animals on premises, except watchdogs. However, watchdogs shall be maintained within the Operator’s premises by a fence that is adequate to contain the dog within the premises. IPD may require Operator to remove the dog from the premises if, in IPD’s sole and absolute discretion, the dog barks excessively. B. All IPD-related tow service complaints received by the IPD against Operator, its employees, or agents will be accepted and investigated in a fair and impartial manner. As a result of the investigation, the IPD may suspend Operator from its participation on the Rotation List. In any event, Operator will be notified of the results of any investigation. 1. Operator shall agree to each of Operator’s employees review and execute the disclosure and acknowledgment attached hereto at Exhibit “D”. Operator shall retain all employee-executed copies of Exhibit “D” and provide the same to the City upon request. C. Operator shall post a notice in a conspicuous place at Operator’s place of business of a size which is at least 8 1/2” x 11” informing the public of the right to make complaints regarding service provided by Operator within the City, and shall include the name and location where complaints can be made to City. Operator shall notify the IPD, in writing, within seventy-two (72) hours of any complaints made to Operator regarding the performance of service in connection with towing or storage, or concerning rates, charges of fees, or any claims, or any legal actions filed, delivered or served upon or instituted against Operator or any of its agents, officers or employees.

While participating on the VPD rotation, tow operations or related business, the operator and or his or her employee(s) shall refrain from any act(s) of misconduct, to include, but not be limited to, any of the following. 1) Rude, discourteous or threatening behavior toward the public or VPD personnel. The operator/tow truck driver shall give a business card containing his name upon request of any customer or VPD personnel. 2) Lack of service, selective service, or refusal to provide service which the operator is or should be capable of performing. 3) Any act of sexual harassment or sexual impropriety. 4) Any unsafe driving practices. 5) Exhibiting any objective symptoms of alcohol and/or drug use. 6) Appearing at the scene of a VPD rotation tow call with the odor of an alcoholic beverage emitting from his or her breath. When probable cause exists, the operator/tow truck driver shall submit to a preliminary alcohol screening' test upon demand of the VPD. 7) Any criminal activity or any other action(s) that may reflect negatively on the VPD through association due to this agreement. B. All VPD related tow service complaints received by the VPD against the operator or his or her employee(s) will be accepted and investigated in a fair and impartial manner. As a result of the investigation, the VPD may initiate disciplinary action as deemed appropriate. In any event, the operator will be notified of the results of any investigation. C. Should the filing of criminal charges be a possibility, the VPD will conduct the investigation to conclusion or assist the lead investigating agency and, if warranted, request prosecution.

While involved in Beaumont Police Department rotation tow operations or related business, the tow operator and/or employees shall refrain from any acts of misconduct including, but not limited to, any of the following: 1. Rude or discourteous behavior toward members of the public, or Police Department staff. 2. Failure to comply with instructions provided by Police Department staff. 3. Lack of service, selective service, or refusal to provide service in which the operator should be capable of performing. 4. Any act of sexual harassment or sexual impropriety. 5. Unsafe driving practices. 6. Exhibiting any objective symptoms of alcohol and/or drug use. 7. Appearing at the scene of a Police Department rotation tow call with the discernible odor of an alcoholic beverage emitting from the driver’s or employee’s breath. The operator/tow truck driver shall submit to a preliminary alcohol screening test upon demand of the Beaumont Police Department. B. Any violation of this section is cause for suspension or termination from the rotation tow program, as deemed appropriate by the Beaumont Police Department Command staff.
