Discipline of Strikers Sample Clauses

Discipline of Strikers. Any bargaining unit member who violates the provisions of Section 1 of this Article shall be subject to immediate discipline, which may include discharge. Any action taken by the Employer against any bargaining unit member who participates in action prohibited by Section 1 above shall not be considered as a violation of this Agreement and shall not be subject to the provision of the grievance procedure, except that the issue of whether a bargaining unit member in fact participated in a prohibited action shall be subject to the grievance and arbitration procedure.
Discipline of Strikers. Any officer who violates the provisions of Section 5.1 of this Article shall be subject to immediate discharge. Any action taken by the Employer against any officer who participates in action prohibited by Section 5.1 above shall not be considered as a violation of this Agreement and shall not be subject to the provisions of the grievance procedure except that the issue of whether an officer in fact participated in a prohibited action shall be subject to the grievance procedure. The failure to confer a penalty in any instance is not a waiver of such right in any other instance nor is it a precedent.

Any action taken by the Village against any employee who participates in any action prohibited by Section 20.1 above shall not be considered as a violation of this Agreement and any grievance filed under this Article is limited to the issue of whether the employee violated this Article. Any or all employees who violate any of the provisions of this Article may be subject to discipline, up to and including discharge. In such event, the only issue that may be submitted to the arbitrator is whether an employee in fact participated in the prohibited action.

Any action taken by the Employer against any Lieutenant who participates in an action prohibited by Section 5.1 shall not be considered a violation of this Agreement and shall not be subject to the provisions of the grievance procedure, except that the issue of whether a Lieutenant in fact participated in a prohibited action shall be subject to the grievance and arbitration procedure.
