DRYDOCKING. NO DRYDOCKING CLAUSE TO APPLY AND CLAUSE 6 OF SALESFORM 1993 IS DELETED. HOWEVER, PROMPTLY BEFORE OR AFTER THE VESSEL'S ARRIVAL AT THE DELIVERY PORT AND PRIOR TO THE VESSEL'S DELIVERY THE BUYERS HAVE THE RIGHT TO CARRY OUT AN INSPECTION OF THE VESSEL'S UNDERWATER (BELOW SUMMER LOADLINE) PARTS BY CLASS APPROVED DIVERS WITH VIDEO LINK TO THE ATTENDING CLASS SURVEYOR, SUCH DIVERS INSPECTION TO BE AT BUYERS' RISK AND EXPENSE. BUYERS TO ADVISE SELLERS FIVE (5) DAYS PRIOR TO DELIVERY IF THEY INTEND TO CARRY OUT UNDERWATER INSPECTION. IF THE DECLARED BY SELLERS DELIVERY PORT IS NOT FEASIBLE FOR AN UNDERWATER INSPECTION, BUYERS SHALL PROMPTLY ADVISE SELLERS OF AN ALTERNATIVE PLACE NEAR TO THE DELIVERY PORT, TO BE MUTUALLY AGREED, WHERE SELLERS ARE TO MAKE THE VESSEL AVAILABLE, AT SELLERS' COST (EXCEPT FOR THE BUNKERS' COST WHICH SHALL BE BORNE EQUALLY BETWEEN THE SELLERS AND THE BUYERS), FOR SUCH AN INSPECTION. THE EXTENT OF THE INSPECTION AND CONDITIONS UNDER WHICH IT IS PERFORMED SHALL BE TO THE SATISFACTION OF THE CLASSIFICATION SOCIETY. THE DIVERS INSPECTION TO BE CARRIED OUT IN A MANNER AND UNDER CONDITIONS CONSIDERED SUITABLE BY THE ATTENDING CLASS SURVEYOR FOR SUCH UNDERWATER INSPECTION. ATTENDANCE ARRANGEMENTS AND FEES FOR THE ATTENDING CLASS SURVEYOR SHALL BE FOR THE BUYERS' ACCOUNT AND THE COST OF THE DIVERS FOR THE BUYERS' ACCOUNT.
A) IF ANY DAMAGE IS FOUND TO THE VESSELS UNDERWATER PARTS WHICH LEADS TO IMPOSING RECOMMENDATION(S) AGAINST THE VESSEL, AND REQUIRES SAME TO BE REPAIRED PRIOR TO THE VESSEL'S NEXT DUE DRYDOCKING DATE, THEN THE SELLERS SHALL REPAIR SUCH DAMAGE TO THE SATISFACTION OF CLASSIFICATION SOCIETY AT THE SELLERS' TIME AND EXPENSE, PRIOR TO THE VESSEL'S DELIVERY TO THE BUYERS. SHOULD THE VESSEL BE REQUIRED TO DRYDOCK TO EFFECT SUCH REPAIRS TO CLASS SATISFACTION, THEN THE BUYERS SHALL HAVE THE RIGHT TO SCRAPE/PAINT THE VESSEL'S UNDERWATER PARTS AT THE BUYERS' RISK & EXPENSE WHILST THE VESSELS IS IN DRYDOCK. ALL COSTS AND MATERIALS ASSOCIATED WITH THE BUYERS' WORKS AND ANY EXTRA DRYDOCKING TIME REQUIRED FOR THE BUYERS TO CARRY OUT/COMPLETE THEIR WORKS SHALL BE FOR THE BUYERS' ACCOUNT. SUCH BUYERS' WORKS SHALL NOT INTERFERE WITH THE SELLERS' WORKS AND NOT TO DELAY THE DELIVERY OF THE VESSEL. IN THE EVENT THAT THE SELLERS HAVE COMPLETED THEIR WORKS IN THE DRYDOCK TO THE SATISFACTION OF CLASS AND THE BUYERS WORKS ARE NOT YET COMPLETED, THEN THE SELLERS HAVE THE RIGHT TO TENDER NOR FOR DELIVERY TO THE BUYERS WHILST THE VESSEL IS IN DRYDOCK. DRYDOCKING. No predelivery drydocking as per NSF 1987.
DRYDOCKING drydock the Ship and clean and paint her underwater parts in accordance with good commercial practice for vessels of the type and age of the Ship and, in any event, in accordance with the requirements from time to time of the Classification Society;
DRYDOCKING. A. See clause 22 of the Shelltime 4 form.
B. Emergency Drydocking Should emergency drydocking be required, Charterer shall allow the Vessels to proceed to an appropriate port. Owner shall be solely responsible for gas freeing the Vessels upon such occasion, and all towing, pilotage, fuel and other expense incurred while proceeding to and from and while in drydock shall be for Owner’s account. Fuel used during such drydocking or repair as provided in this clause or in proceeding to or from the port of drydocking or repair, will be charged to Owner by Charterer at the price charged to Charterer by its bunker supplier at the last supply port. In case of emergency drydock pursuant to this clause at a port where the Vessels are to load, discharge or bunker under Charterer’s orders, hire shall be suspended from the time the Vessels received free pratique on arrival, if in ballast, or upon completion of discharge of cargo, if loaded, until the Vessels are again ready for service. In case of drydocking at a port other than where the Vessels load, discharge, or bunker under Charterer’s orders, the following time and bunkers shall be deducted from hire: total time and bunkers including repair port call from the actual voyage from last port of call under Charterer’s order to next port of call under Charterer’s orders, less theoretical voyage time and bunkers for the direct voyage from said last port of call to said next port of call. The period during which hire is suspended including drydocking and repairs until the Vessels again come on hire under the terms hereof shall count as off-hire under the terms of this Charter.
DRYDOCKING. The Lessee shall procure that the Ship is drydocked as often as may be required to ensure that the Ship maintains its classification with its Classification Society and otherwise in accordance with good commercial practice. If the Lessee fails to comply with the requirements of the relevant Classification Society, the Lessor shall have the right to inspect the Ship in accordance with clause 10.14. If so requested by the Lessor, the Lessee shall give the Lessor reasonable prior written notice of any intended drydocking of the Ship.
DRYDOCKING. The Borrower shall procure that the Vessel is drydocked as often as may be required to ensure that the Vessel maintains its Classification with its relevant Classification Society and otherwise in accordance with good commercial practice. If the Borrower fails to comply with the requirements of the relevant Classification Society, the Agent may inspect the Vessel in accordance with clause 9.
DRYDOCKING. No pre-delivery drydocking clause to apply. However the Buyers have the right to inspect the Vessel's underwater parts by a diver approved by Class, which shall be arranged by Buyers at Buyers expense prior delivery. If the conditions at the place of underwater survey are unsuitable for such inspection due to tides/weather/underwater visibility/not clear-sufficient waters due to water depth, then the Sellers shall immediately make the Vessel available at a suitable alternative place near to the delivery port without any extra cost from the Buyers. The Sellers to have the option for divers inspection to take place, at a place with clear water visibility before the last discharging port, provided ample notice is given to Buyers for preperation. In the event the Buyers choose such diver's inspection, same shall be carried out in the presence of the Vessel's Class surveyor (whom to be for Sellers expense) and in the presence of the Sellers/Buyers representatives without interferring with the Vessel's operation. Should any damage be found during such inspection that will impose a recommendation and/or condition of Class, then:
a) In case the Class imposes a recommendation and/or condition of Class but the Vessel is not required to be drydocked before her next scheduled drydock, then the Sellers shall pay the Buyers the direct cost only (excluding drydocking costs) to repair such damage in a way which is acceptable by the Class and which to be based on the average of two (2) quotations given by two reputable independent repair yards at port of delivery or nearby, one at Sellers choice and one at Buyers choice. The above amount agreed shall be deducted from the balance of the purchase money at the time of delivery.
DRYDOCKING. Schedule 6.14 lists the scheduled drydocking activities to be undertaken by Company or the appropriate Consolidated Subsidiary, along with the budgeted costs associated with such activities. Prior to the Closing, Seller shall, or shall cause the Company or the appropriate Consolidated Subsidiary to make commercially reasonable efforts to arrange, complete and fully pay for the drydocking activities detailed in Schedule 6.14, to the extent such activities in such schedule are planned prior to Closing. Seller shall provide Buyer and its representatives reasonable access to the vessels during drydocking to inspect the vessels and the work required by this Section 6.14.
DRYDOCKING. In connection with the delivery the Sellers shall place the vessel in drydock at the port of delivery 44 for inspection by the Classification Society of the bottom and other underwater parts below the Sum- 45 mer Load Line. If the rudder, propeller, bottom or other underwater parts below the Summer Load 46 Line be found broken, damaged or defective, so as to affect the vessel's clean certificate of class, such 47 defects shall be made good at the Sellers' expense to 1) ______ 48 satisfaction without qualification on such underwater parts.2) ______ 49 Whilst the vessel is in drydock, and if required by the Buyers or the representative of the Classifi- 50 cation Society, the Sellers shall arrange to have the tail-end shaft drawn. Should same be condemned 51 or found defective so as to affect the vessel's clean certificate of class, it shall be renewed or made 52 good at the Sellers' expense to the Classification Society's satisfaction without qualification. 53 The expenses of drawing and replacing the tail-end shaft shall be borne by the Buyers unless the 54 Classification Society requires the tail-end shaft to be drawn (whether damaged or not), renewed or 55 made good in which event the Sellers shall pay these expenses. 56 The expenses in connection with putting the vessel in and taking her out of drydock, including dry - 57 dock dues and the Classification Surveyor's fees shall be paid by the Sellers if the rudder, propeller, 58 bottom, other underwater parts below the Summer Load Line or the tail-end shaft be found broken, 59 damaged or defective as aforesaid or if the Classification Society requires the tail-end shaft to be 60 drawn (whether damaged or not). In all other cases the Buyers shall pay the aforesaid expenses, dues 61 and fees. 62 During the above mentioned inspections by the Classification Society the Buyers' representative 63 shall have the right to be present in the drydock but without interfering with the Classification Xxxxx- 64 yor's decisions. 65 The Sellers shall bring the vessel to the drydock and from the drydock to the place of delivery at 66 their own expense. 67
DRYDOCKING. If the VESSEL stays in fresh water after launching until delivery to the BUYER for a period of not more than 180 days, it shall be exempted from drydocking, provided however that the final antifouling paint has been applied by the SELLER in strict accordance with the paint suppliers’ recommendations (such recommendations to be submitted to the BUYER for information) before the launching of the VESSEL. In the event that the VESSEL stays in fresh water for a period of more than 180 days, the SELLER shall carry out at SELLER’s a drydocking of the VESSEL.
