Early Completion Incentive. If CONSTRUCTION MANAGER AT RISK achieves Substantial Completion of the Project prior to ____________[ INSERT A SPECIFIC DATE, UNLESS IT IS AGREED THAT THE BONUS WILL RUN FROM THE REQUIRED SUBSTANTIAL COMPLETION DATE, AS IT MAY LATER BE EXTENDED], CONSTRUCTION MANAGER AT RISK shall be entitled to an early completion incentive bonus of $_______ per full day between _________ and such date of Substantial Completion, up to a maximum bonus of $_____________, but subject to any deductions as otherwise provided in the Contract.]
Early Completion Incentive. Conversely, if the Contractor achieves Substantial Completion of the Casino or the Hotel, as the case may be, prior to their respective Substantial Completion Dates, the Owner shall pay the Contractor an incentive fee as follows:
(i) For each day Substantial Completion of the Casino precedes the Casino Substantial Completion Date, the sum of: . $0.00 per day for the first seven (7) days which precede the Casino Substantial Completion Date; and . $10,000 per day for each day which precedes the seventh (7th) day before the Casino Substantial Completion Date.
(ii) For each day Substantial Completion of the Hotel precedes the Hotel Substantial Completion Date, the sum of $1,000 per day. The preceding incentive fees, if any, shall be paid with the final payment to the Contractor.
Early Completion Incentive. For each day early that Developer achieves Substantial 15 Completion, measured by the number of days prior to the Substantial Completion 16 Deadline that ADOT issues the Certificate of Substantial Completion (inclusive of the date 17 of issuance but not of the Substantial Completion Deadline), Developer shall be entitled 18 to an additional payment of $50,000 per day, up to a total of 60 days. Developer shall 19 receive such payment, if any, as a lump sum in the progress payment subsequent to the 20 month in which ADOT issues the Certificate of Substantial Completion.
Early Completion Incentive. (d-1) Total CLIN 1 Price is $50,211,322.26 for the period of performance January 1, 2012 through August 31, 2014 to be paid monthly as described in Clause B.2.1(b) unless subject to Clause B.2.1(e)

Early Completion Incentive. In the event that the Contractor concludes Option 2 ahead of October 31, 2014, XXX agrees to pay the Contractor $707,700 per month of schedule acceleration in lieu of the CLIN 1 monthly payment identified in B.2.1 (b), provided the total sum of this incentive does not exceed $5M. Any early incentive payment will not be pro-rated. For example: With the negotiated duration of Option 2 being 32 months and the Early Completion Incentive being $707,700, the following scenarios are possible associated with CLIN 2 milestone #363:
1. Accelerated: Contractor is able to make the final shipment of CEUSP material (i.e., achieve CLIN 2 milestone #363) during the 30th month (June 2014), Contractor would be paid: 30 months of the CLIN 1 monthly rates in B.2.1 (b); all CLIN 2 payment milestones in B.2.1 (c), and $707,700/month for 4 months (a total of lump sum payment of $2,830,800).
2. On Schedule: Contractor makes the final shipment of CEUSP material (CLIN 2 milestone #363) during the 32nd month (August 2014), Contractor would be paid: 32 months of the CLIN 1 monthly rates in B.2.1 (b), all CLIN 2 payment milestones in B.2.1 (c), and $707,700/month for 2 months (a total lump sum payment of $1,415,400).
3. Delayed: Contractor is able to make the final shipment of CEUSP material (CLIN 2 milestone #363) during the 34th month (October 2014), Contractor would be paid: 32 months of the CLIN 1 monthly rates in B.2.1 (b), all CLIN 2 payment milestones in B.2.1 (c), $0 for the early completion incentive and Contractor would be responsible for 2 months of CLIN 1 costs ($2,830,796.04).

Early Completion Incentive. Because time is of the essence in completing the contract work, a monetary incentive is offered for early completion of the work. For each day prior to the contract completion date that contract work is substantially complete, payment to the Contractor will be increased by an incentive amount of $1,100 per day up to a maximum of $33,000.
