Effective Date: Duration of Agreement. This Agreement shall become effective upon the execution and delivery of the Lease Agreement by the Obligor and the Agency and this Agreement by the Obligor and the Agency and the execution and delivery of the Company Lease from the Obligor to the Agency and shall continue in effect until the earlier of (i) the termination of this Agreement pursuant to the terms of the Lease Agreement or of this Agreement, or (ii) the date on which the Company Lease and the Lease Agreement are terminated pursuant to the Lease Agreement or this Agreement and the Project Facility has been placed back on the tax rolls as taxable property.

This Joint Trade Agreement shall become effective June 2, 2014 and shall be rigidly observed until its expiration May 31, 2017, during which time neither party to it shall continue in force or create any rule or By-Law conflicting with its provisions, provided, however, that this Agreement may be amended from time to time by the parties hereto.

In the event of a bona fide sale, transfer or assignment, by whatever means or methods, of the Employer’s Head Start operations, or any part thereof, covered by this Agreement during the term hereof, the Employer shall give advance notice to the new owner, transferee or assignee of the obligations of this Agreement, and shall, as a condition of such sale, transfer, or assignment, require the new owner, transferee or assignee to hire the Employer’s employees, and to become a Party hereto. It is understood that the Parties hereto shall not use any leasing device to a third party to evade this contract. The Employer shall be responsible for any and all monetary benefits that employees have accumulated under this Agreement to the date of sale, transfer or assignment. Seniority of employees shall not be broken by such sale, transfer or assignment. The Employer agrees to give the Union no less than thirty (30) days written notice in the event that it intends to sell, transfer, or assign the operations, or part thereof, covered by the Agreement, and agrees to provide the Union with written documentation establishing the Employer’s compliance with this Article no less than ten
Effective Date: Duration of Agreement. This Agreement shall become effective upon the delivery of the Lease and shall continue in effect until the earlier of (i) June 30, 2001 or (ii) the date in which title to the Facility is conveyed to the Company pursuant to the Lease.
