HOLIDAYS AND VACATIONS If work is performed on Buyer's premises, Buyer shall not be obligated to make any payments to Seller for days designated by Buyer as holidays or shutdown periods, except for work specifically authorized in writing by Xxxxx's Authorized Procurement Representative and performed by Seller on such days.
Holidays and Vacation A) Employee shall be paid for the following seven (7) holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and the day after Thanksgiving, and Christmas Day and all other holidays for Employees of the Company as approved by the Chief Executive Officer or Board of Directors.
Vacation, Holidays and Sick Leave During the Term, the Executive shall be entitled to paid vacation, paid holidays and sick leave in accordance with the Company's standard policies for its senior executive officers.
ANNUAL VACATIONS 15.01 Employees shall be entitled to an annual vacation after one (1) year of employment with pay, calculated as follows: (a) 3/52nds of the earnings of that year of service after one (1) year and each subsequent year thereafter, up to and including five (5) completed years of service; (b) 4/52nds of the earnings for the year commencing after five (5) completed years of service and each subsequent year thereafter, up to ten (10) completed years of service; (c) 5/52nds of the earnings after ten (10) completed years of service and each subsequent year thereafter. 15.02 For other than full-time employees, all vacation pay will be paid to employees on December 15th in each year unless the employee requests vacation pay when a holiday is taken. In such circumstances, the employee will receive vacation pay requested at that time or a portion of the payment at that time and the balance on December 15th. Part-time employees will be allowed to make two (2) such requests per year based on earnings to June 30th. Full-time employees will receive vacation pay when they take their vacation. 15.03 Employees who are hospitalized or make use of compassionate leave during their vacation period shall be credited with extra vacation time equivalent to the time used. 15.04 Vacations cannot be accumulated from one year to another. 15.05 When a statutory holiday occurs during an employee’s vacation, an extra day’s vacation shall be granted if the holiday is one for which the employee would have received pay if he/she had been working. 15.06 If the employment of an employee is terminated, the Employer shall pay him/her for any vacation time he/she has earned. 15.07 A vacation list shall be submitted to the employees requesting them to indicate their preference as to vacation dates. Both parties agree, however, that the vacation schedule must be practical insofar as the operation of the business is concerned and therefore the Employer is able to make a final decision as to how many and which employees would be able to take vacation at any particular time. Seniority shall prevail in the event of a conflict of vacation requests between employees.
Vacation; Holidays The Executive shall be entitled to all public holidays observed by the Company and vacation days in accordance with the applicable vacation policies for senior executives of the Company, which shall be taken at a reasonable time or times.
PAID VACATIONS 41.1 The Board shall grant paid vacation periods to each Member in accordance with the terms and conditions outlined in this Article. (a) The Board shall maintain a record of paid vacation entitlement for each Member based on the years, and parts thereof, of service from the most recent date of hire with the Board completed by August 31st prior to the vacation period to be taken. (b) For the purpose of this Article, the most recent date of hire shall be the date of last hire where there has been no termination of employment since that date. (c) A Member who was given credit for split service prior to the signing of this Agreement shall continue to retain such service for vacation entitlement. (a) Every Member shall be granted by the Board an annual paid vacation according to the following schedule: Years of Service Prior Entitlement to September 1st less than 1 year 3 weeks pro rated to time worked 1 year 3 weeks 8 years 4 weeks 17 years 5 weeks 24 years 6 weeks (b) The pay for any vacation period shall be calculated on the Member's annual salary as provided in Schedule A. (a) Vacations will normally be taken during the months of July and August but alternate scheduling may be permitted with the approval of the Member’s immediate Supervisor. Such requests for alternate scheduling shall not unreasonably be withheld. (b) The Member shall inform the Board about the Member’s request for paid vacation by completing the vacation schedule form provided by the Board. (c) If more than one (1) Member in a work location or department requests the same vacation time off, then, the most senior Member shall be granted the first choice the initial year after ratification of this Agreement. Thereafter, vacation time shall be on a rotation basis beginning with the next most senior Member having first choice. (d) The choice of vacation time by seniority referred to in clause 41.4 (b) is to be implemented only when a problem may occur in a department whereby two or more Members have chosen the same vacation period and it is necessary that one of those Members must be available to maintain the efficient operation of the department. (e) There will be a minimum of two (2) Members in a Composite Secondary School Office at all times. 41.5 (a) A ten (10) or twelve (12) month Member working in elementary schools shall take their vacation during regular scheduled breaks. This provision will also apply to ten (10) month Members working in Instructional Services and Media Services.
Holidays A. The following shall be observed as paid holidays: New Year's Day, January 1 Labor Day Xxxxxx Xxxxxx Xxxx'x Birthday Columbus Day* President’s Day Veterans' Day * Good Friday* Thanksgiving Day Memorial Day Day after Thanksgiving July 4th Christmas Day, December 25 * These days are not paid holidays and are considered regular workdays for employees assigned to Xxxxxxxxx Xxxxxxxxx. B. When a holiday falls on a regular day off, for employees scheduled to work a five (5) day operation, the holiday shall be celebrated on a regular workday to be scheduled by the Town. For employees scheduled to work a seven (7) day operation, the holiday shall be celebrated on a regular workday to be selected by the employee, with the approval of the department head; the workday selected need not be uniform. C. If an employee shall be required to work on a holiday, the employee shall be paid at the rate of one and one-half (1 1/2) times his/her regular straight time hourly rate for such work. D. Permanent, part time employees shall be entitled to the holidays of this Article and shall receive as holiday pay an amount prorated on the basis of the average fraction of the standard workweek worked during the past fiscal year. E. If an employee is absent from work for any part of the last scheduled work day before or the first scheduled work day after the day on which a holiday is observed pursuant to the terms of this Article, such employee shall receive holiday pay provided such absence is for an authorized or excused reason such as, but not limited to, illness, accident, vacation, personal leave day, bereavement leave day, or extreme weather conditions. It is understood that such authorized or excused absence need not be with pay in order for the employee to be eligible for the holiday pay. F. Subject to prior mutual written agreement between the Town and the Association, a schedule for holiday observances which differs from the days indicated in A may be established for employees of the Greenwich Library and Greenwich Board of Education, provided that the number of paid holidays is equal to the number of holidays set forth in A. In the event no agreement is reached for such change, the holiday schedule set forth in A shall control. Notwithstanding the above, in the event Board of Education determines to include Columbus Day and/or Veterans’ Day as a regular school day, such day(s) shall become part of the regular work week and the premium pay as set forth in paragraph C of this Article shall not apply. In such event each employee affected by the change shall be granted a floating holiday for Columbus Day and Veterans’ Day as each may be discontinued at the discretion of the Board of Education. The floating holidays shall be used during the school year. An employee wishing to use such floating holiday shall provide the Board with advance notice and the Board shall not unreasonably deny, condition or withhold the employee’s ability to utilize the floating holiday on a date of the employee’s choosing.
PLANT HOLIDAYS 21:01 The following shall be recognized as statutory holidays: New Years Day Labour Day (a) Where any of the above mentioned holidays fall on a Sunday, the Monday following will be recognized as a holiday. If the holiday falls on a Saturday, the Company will designate the preceding Friday, or the following Monday to be observed as the holiday. The Company and Union Committee may agree on other arrangements. (b) Where any of the above mentioned holidays fall on a Tuesday, Wednesday or Thursday the Company and Union Committee by mutual agreement may designate the preceding Monday or following Friday to be observed as the holiday. (c) The Company and Union Committee may mutually agree on arrangements, whereby time that normally would be paid at overtime rates may be worked at straight time rates and substituted for a normal working day or any other arrangements that the two parties deem suitable. (d) All employees who have acquired seniority shall receive payment for such holidays based on their base rate multiplied by the number of hours which would normally have been worked on such day, subject to the following conditions: To be eligible for holiday pay, an employee must work the full of the work day immediately preceding the holiday and the full of the work day immediately following such holiday. Provided that this restriction shall not apply to: (i) An employee who has been absent and receiving Workers’ Compensation or sick benefits under the group insurance plan up to but not including the statutory holiday where such employee works the full work day immediately following such holiday. (ii) Nor shall this restriction apply to an employee who has worked the full workday immediately preceding such holiday but who is absent and received Workers’ Compensation or sick benefits under the group insurance plan for the work day immediately following such holiday. (iii) Nor shall this restriction apply to an employee who is absent either the work day immediately preceding or the work day immediately following such holiday by reason of bereavement as provided in Article 20:04. (iv) Nor shall this restriction apply to those persons granted a written leave of absence. (v) Nor shall this restriction apply to an employee who has been late up to seventy five (75) spaces (forty five (45) minutes) the work day immediately preceding the holiday or the work day immediately following such holiday. 21:02 An employee shall receive any overtime pay to which he/she is entitled in accordance with Articles 12:01 and 12:02 for the work that he/she performs on such statutory holiday, in addition to his/her holiday pay. 21:03 For the purposes of clarity, the parties agree that the benefit provided in this article constitute a greater right or benefit than provided for in the Employment Standards Act.
STATUTORY HOLIDAYS a) All hourly-rated employees who work on New Year’s Day, Good Friday, Victoria Day, Dominion Day, British Columbia Day, Labour Day, Thanksgiving Day, Remembrance Day, Christmas Day and Boxing Day shall be paid rate and one-half for all hours so worked. b) In the event one of the Statutory Holiday falls on a Sunday, the previous Friday or the following Monday shall be observed as the Holiday. In the event that one of the within named Statutory Holidays fall on Saturday, it shall be observed the preceding Friday or succeeding Monday as agreed between the Company and the Plant Committee. c) In the event of a Statutory Holiday falling on a Tuesday, Wednesday or Thursday, and where the Company and Plant Committee mutually agree, the said holiday may be observed the preceding Monday or following Friday respectively. d) At the option of the Company, but whenever possible, by mutual agreement with the Plant Committee, either Good Friday or Easter Monday shall become the designated Easter Holiday, and the Company shall notify its employees of the designation at least one (1) week prior to the said Holiday. e) When a Statutory Holiday falls on a Friday, employees working on a Tuesday to Saturday work week, by mutual agreement between the Company and the Plant Committee may work on the Friday Statutory Holiday at the straight time job rates and substitute Saturday as the Statutory Holiday. f) In the case of a maintenance employee where one of the Statutory Holidays is observed on his/her rest day, he/she shall have a day off without pay in lieu thereof at a mutually agreeable time. g) Not withstanding the above, in logging, a Statutory Holiday may be observed on another mutually agreed upon day in a week other than the week in which it occurs. An employee who qualifies for such Statutory Holiday on the day it occurs, and works on that day, will be paid for the Statutory Holiday at straight time rates. a) All hourly-rated and piece work employees who qualify for the paid holiday under the conditions set out below shall be paid for the holiday at their regular job rate of pay for their regular rate work schedule. The Parties hereto agree that the paid Statutory Holidays shall be as follows: New Year’s Day British Columbia Day Good Friday Labour Day Victoria Day Thanksgiving Day Dominion Day Remembrance Day Christmas Day Boxing Day b) Piece-work employees shall receive pay for the statutory holidays for which they qualify, based on the daily average earnings for the days actually worked during the previous thirty (30) working days. c) All hourly-rated employees working on a paid holiday shall receive rate and one-half for hours worked on such day in addition to the holiday pay to which he/she may be entitled. d) Xxxx and bunkhouse employees who work on a statutory holiday shall receive at the end of their regular work schedule, an additional day off with pay to be added to their leave and vacation allowance accumulated in accordance with Article VII, Section 3. e) To qualify for statutory holidays, an employee must have been on the Company payroll for the thirty (30) calendar days immediately preceding the statutory holiday and must have worked his/her last regularly scheduled work day before, and his/her first regularly scheduled work day after the holiday, unless his/her absence is due to a compensable injury or illness, which occurred within six (6) months of the holiday, or the employee is on authorized leave of absence in accordance with Section 2 or 3 of Article IX. f) In the case of illness or injury, the Company shall have the right to request a certificate from a qualified medical practitioner. g) Notwithstanding any of the foregoing provisions, the employee must have worked one (1) day before and one (1) day after the holiday, both of which must fall within a period of ninety (90) calendar days.
Work on Holidays An employee who is required to work, or works with prior approval, any part of a holiday shall receive holiday compensatory time for up to eight (8) hours, on an hour for hour basis, for the actual non-overtime hours worked in addition to their regular rate of pay. An employee who works overtime on a holiday shall be compensated in accordance with all applicable pay and overtime provisions. An employee must use holiday compensatory time within one (1) year after having accrued that time.
