Employer Initiated Referral. An employee may be referred to the Employee Assistance Program by the Employer as a result of deteriorating attendance or job performance or inappropriate behaviour while at work, where it is believed that the cause of the problem is of a personal nature. Such referral must be made in the presence of a Union representative. In the event of an Employer initiated referral, an employee shall only be subject to discipline, discharge or termination by the Employer in relation to his or her attendance.

Involvement in the program will not jeopardize an employee’s job security or future promotional opportunities within the Employer's operations as an important aspect of the EAP program is to assist the employee so that job security and future prospects are preserved and enhanced.

Medicaid- Funded Hour(s) worked shall be defined as all hours worked by all employees covered by this Agreement in the Employer's in-home care program that are paid by Medicaid, excluding vacation hours, paid-time off hours, and training hours.
