Employment exception Clause Samples

The Employment Exception clause serves to exclude certain obligations or restrictions from applying to individuals in the context of their employment relationships. Typically, this clause clarifies that provisions such as non-compete, confidentiality, or intellectual property assignments do not override or interfere with rights and duties established under employment law or specific employment agreements. By doing so, it ensures that the contract does not unintentionally conflict with or supersede existing employment rights, thereby protecting both the employer and employee from legal ambiguities or unintended consequences.
Employment exception. A person is not required to accept employment that reasonably necessitates relocation or for which the person is not qualified, taking into consideration that person's prior compensation and benefits, training, education and experience, including training and education received under that person's rehabilitation plan. The disability retirement benefit may not be discontinued except as provided by section 17929 or until the person is reemployed consistent with this section.
