Equipment Replacement Fund. The Commission shall establish an equipment replacement fund according to s. NR 162.08, Wis. Adm. Code, and maintain the equipment replacement fund as a separate fund. Annual deposits shall be made to the equipment replacement fund in amounts sufficient to meet the equipment replacement schedule developed by the Commission. Based on review of the equipment replacement fund information in the CWFP application, the total annual deposit is estimated at $87,000.

Equipment Replacement Fund. 7.1. In order to guarantee the renewal and replacement of equipment and facilities that are included in the Common Property or in order to perform material repairs therein, the Management Company shall be entitled, at its sole discretion, to include in the calculation of the amount collected from the User, an amount at a rate of up to 5% (five percent) of the total amount of the expenses according to an estimate of the annual budget (hereinafter: the "Equipment Replacement Fund"). 7.2. The payments to the Equipment Replacement Fund shall be deemed as a deposit kept by the Management Company, as a trustee of all the tenants in the Building and/or the Project, and will be kept by the Management Company in a separate bank account and will be invested by the Management Company in solid investments to the best of its professional judgment. 7.4. To the extent that it transpires that the sums that accumulated in the Equipment Replacement Fund are insufficient for the purpose of performing the additions, retrofitting, repairs and the like that are required, each User will pay in fourteen (14) days as of the date of receiving the demand of the Management Company, its relative part in the missing amount for the purpose of their performance. It is hereby clarified that the User shall not be entitled (even after the sale of the Unit) to reimbursement for the sums that were not used in the Equipment Replacement Fund. 7.5. The collection of the sums for the Equipment Replacement Fund shall not entitle the Management Company to Management Fees in respect of these sums, however only after the said sums were indeed used by the Management Company for the replacement and/or the repair of the equipment and the facilities. 7.6. Upon termination of the Management Agreement, and to the extent that the Management Company no longer provides management services for the Building and/or the Project, the Management Company shall transfer the Equipment Replacement Fund to the new Management Company and/or to the Representation, within its meaning in Section 8 hereunder, as the case may be. 7.7.   • Equipment Use Lessee agrees that the Equipment will be operated by competent, qualified personnel in connection with Lessee's business for the purpose for which the Equipment was designed and in accordance with applicable operating instructions, laws, and government regulations, and that Lessee shall use all reasonable precautions to prevent loss or damage to the Equipment from fire and other hazards. Lessee shall procure and maintain in effect all orders, licenses, certificates, permits, approvals, and consents required by federal, state, or local laws or by any governmental body, agency, or authority in connection with the delivery, installation, use, and operation of the Equipment.

  • New Equipment Where new types of equipment and/or operations, for which rates of pay are not established by this Agreement, are put into use after the ratification date of this Agreement within operations covered by this Agreement, rates governing such operations shall be subject to negotiations between the parties. This paragraph shall apply to all new types of equipment including office and clerical equipment. In the event an agreement cannot be reached within sixty (60) days after the date such equipment is put into use, the matter may shall be submitted to the National Grievance Committee for final disposition.   • Mandatory equipment (a) All Employees engaged to work on site will be supplied with safety footwear and safety helmets appropriate to the work that they perform before commencing work on a Project. The safety footwear will be of an equivalent standard to those made by: (i) Steel Blue; (ii) Xxxxxx; and (iii) Mongrel Boots. (b) These items must be worn at all times as instructed during the Project induction process. (c) Helmets must not be painted, drilled or modified in any way. Damaged and/or worn footwear and helmets will be replaced on demand.

  • Installation, Maintenance, Testing and Repair Unless otherwise agreed in writing by the Parties, to the extent required by Applicable Law, Interconnection provided by a Party shall be equal in quality to that provided by such Party to itself, any subsidiary, affiliates or third party. If either Party is unable to fulfill its obligations under this Section 14.2, it shall notify the other Party of its inability to do so and will negotiate alternative intervals in good faith.   • Equipment Maintenance The Contractor agrees that when Contract funds are used to pay for all or part of the purchase costs of any equipment that costs $5,000 or more per item, and the purchase of such equipment is identified in an exhibit to this Contract, such equipment is, upon the purchase or receipt, the property of the County and/or federal/state government. The Contractor shall be responsible for all proper care and maintenance of the equipment, including securing and insuring such equipment.

  • Metering Equipment 13.01. Utility will furnish, install, own and maintain metering equipment capable of measuring the flow of kilowatt-hours (kWh) of energy. The Customer's service associated with the CRG will be metered at a single metering point. The metering equipment will measure energy delivered by Utility to Customer and also measure energy delivered by Customer to Utility. Customer agrees to provide safe and reasonable access to the premises for installation of this equipment and its future maintenance or removal.

  • Equipment Location The Company recognizes that it is important when designing, constructing, and maintaining physical plant components, to have regard for the specific placement of equipment, with a view to the elimination of hazardous work situations. Accordingly, wherever practical to do so, new installations, or the rebuild of existing installations, will be designed accordingly.
