Example 2. A NGEP makes a statement concerning an insured de- pository institution or affiliate at a widely attended conference or seminar regarding a general topic. A public or private meeting, public hearing, or other meeting regarding one or more specific institutions, affiliates or transactions involving an application for a deposit facility is not considered a widely attended conference or sem- inar.

Example 2. An American mu- seum is organizing an exhibition of works by 20th century American art- ists, which will travel to one other U.S. museum. There are more than 100 ob- jects in the exhibition. The majority of the paintings, drawings and sculpture, valued at more than $500,000,000, are from galleries, museums and private collections in the United States. The organizing curator has selected ten works of art, mostly drawings and pre- paratory sketches relating to paintings in the exhibition, valued at less than $5,000,000, which will be borrowed from foreign lenders.
Example 2. An employee on the 3/12.5 work schedule works a regular schedule of 75 hours in a pay period and is assigned to work, in the same pay period, 10 of the 10 “payback” hours owed to the City during a 28-day work period; such employee shall not earn overtime compensation during the pay period until hours worked during the pay period exceed 85 hours. In this example, the 10 “payback” hours owed to the City and worked during the pay period would not receive additional compensation, but would count toward reaching the minimum 80-hour threshold for calculating overtime compensation. However, because the employee owes 10 hours back to the City, the employee would only be compensated at time and one-half for hours worked in excess of 85 hours during the pay period. Ten “payback” hours are owed to the City during each 28-day work period because the 3/12.5 work schedule employee was paid for those hours in advance at the rate of 5 hours for each of the 2 pay periods in a 28-day work period.
Example 2. A NGEP meets with an insured depository institution and states that the institution needs to offer new loan programs in the NGEP’s community. The NGEP and the insured depository institution reach a mutual arrangement or understanding that the institution will provide additional loans in the NGEP’s community. The institution tells the NGEP that it will issue a press release announcing the program. Later, the insured depository institution issues a press release an- nouncing the loan program. The press release incorporates the key terms of the understanding reached between the NGEP and the insured depository insti- tution. The written press release re- flects the mutual arrangement or un- derstanding of the NGEP and the in- sured depository institution and is, therefore, a written arrangement or understanding.
