Excessive Floor Load. Landlord shall have the right to prescribe the weight and method of installation of safes, computer equipment, and other heavy fixtures or equipment. Tenant will not install in the Demised Premises any item of Tenant's Property or fixtures that will place a load upon the floor exceeding the designed floor load capacity of the floor and the Building. Landlord may prescribe the placement and positioning of all such objects within the Demised Premises and/or Building, and, if necessary, such objects shall be placed upon platforms, plates or footings of such size as Landlord shall prescribe. All damage done to the Building or the Demised Premises by installing or removing a safe or any other article of Tenant's Property or fixtures, or due to its being in the Demised Premises, shall be repaired at the expense of Tenant.

Excessive Floor Load. Tenant will not, without Landlord’s prior written approval (which approval shall not be unreasonably withheld, delayed, or conditioned), install in the Leased Premises any fixtures, equipment or machinery that will place a load upon the floor exceeding the designed floor load capacity (provided, that Landlord shall notify Tenant, together with approval of Landlord’s Work, of the designed floor load capacity). Notwithstanding the foregoing, Landlord has approved the installation of certain Tenant fixtures, including but not limited to certain freezers, which have an estimated floor load capacity of 1,200 lbs. Landlord hereby confirms that the floor load capacity of the Leased Premises is sufficient to accommodate said freezers and other fixtures. Tenant shall be liable for all damage done to the Building by installing or removing a safe or any other article of Tenant’s office equipment, or due to its being in the Leased Premises, except for any damage resulting from normal wear and tear, casualty or condemnation. Landlord, after not less than thirty (30) days’ prior written notice to Tenant, may repair any such damage at Tenant’s expense, and Tenant shall pay Landlord’s reasonable out-of-pocket costs (as documented, in writing, to the reasonable satisfaction of Tenant) plus ten percent (10%) for Landlord’s overhead and supervision in performance of such repairs as Additional Rent within thirty (30) days after receiving documentation that reasonably evidences such repair costs.

Tenant will not, without Landlord’s prior written approval (which approval shall not be unreasonably withheld, delayed, or conditioned), install in the Leased Premises any fixtures, equipment or machinery that will place a load upon the floor exceeding the designed floor load capacity of 100 pounds per square foot (80 live/20 dead – including partitions) on floors 4 – 11 or 80 pounds per square foot on the P-6 level (60 live/20 dead – including partitions) or 25 pounds per square foot in the parking area. Tenant shall be liable for all damage done to the Building by installing or removing a safe or any other article of Tenant’s office equipment, or due to its being in the Leased Premises. Landlord, after not less than ten (10) days prior written notice to Tenant, may repair any such damage at Tenant’s expense, and Tenant shall pay Landlord’s reasonable out-of-pocket costs (as documented, in writing, to the reasonable satisfaction of Tenant) plus a reasonable amount (not to exceed ten percent (10%)) for Landlord's overhead and supervision in performance of such repairs as Additional Rent within thirty (30) days after receiving documentation that reasonably evidences such repair costs.

To the extent Tenant desires a raised floor load limit, Landlord shall reasonably cooperate with Tenant, provided that (i) Tenant pays for all reasonable costs in connection with such raised floor load limit, including Landlord’s third party consultants, and (ii) the alteration or improvement does not adversely affect the Building or any of the base Building systems, now or in the future (and if it does adversely affect the Building or the base Building systems, Landlord shall have the right to require Tenant to remove the same).
