Filling of Vacancy. In filling a vacancy, the employee signing with the greatest seniority in the department shall be given first consideration. Before a vacancy or new position is filled, the Highway Commissioner and Union representatives shall attempt to mutually agree on the applicant to be selected. If mutual and final agreement is not reached at this point, a grievance may be filed by the Union.
