FIXTURES, FURNISHINGS AND EQUIPMENT. The Tides shall be responsible for supplying and maintaining all fixtures, furnishings and equipment throughout the Stadium. Such fixtures, furnishings and baseball operational equipment shall include, but not be limited to, the following: baseball equipment and furniture for professional baseball games, office equipment and supplies, restaurant furnishings and equipment, concessions areas, merchandise sales areas, locker rooms, suites, press areas, television broadcast areas, grounds, loading dock and maintenance areas, lobbies and picnic areas.

FIXTURES, FURNISHINGS AND EQUIPMENT. 10.1 Unless otherwise provided herein, or agreed to between the parties, the City shall own and have title to all Fixtures, Furnishings and Equipment, and all replacements thereof, throughout the Term. 10.2 Unless otherwise provided herein, or agreed to between the parties, any contract entered into by RG Facilities for the replacement of any of the Fixtures, Furnishings and Equipment shall require that title to the replacement of Fixtures, Furnishings or Equipment be transferred to the City free and clear of any encumbrances no later than upon delivery of the replacement item to the Victoria Centre Facility. 10.3 The City and RG Facilities may, from time to time, on terms mutually acceptable to both parties, mutually designate and determine that certain of the Fixtures, Furnishings and Equipment, and replacements thereof, otherwise provided by RG Facilities to the City under the Design-Build Contract, be acquired and held by RG Facilities and utilized by RG Facilities solely in the operation, management and maintenance of the Victoria Centre Facility so that the consequences of ownership of such fixtures, furnishings and equipment will be attached to RG Facilities throughout the Term.
FIXTURES, FURNISHINGS AND EQUIPMENT. Master Franchisee shall, and shall require Franchisees to, purchase and install, at Master Franchisee’s or Franchisee’s expense, as applicable, all fixtures, furnishings, equipment (including, without limitation, a facsimile machine, telephone(s), computer, printer, and cash register, point-of-sale recording system, and an audio and video surveillance system), décor, and signs as Franchisor may reasonably direct from time to time; and shall refrain from installing or permitting to be installed on or about the premises of any Wayback Burgers Restaurant, without Franchisor’s prior written consent, any fixtures, furnishings, equipment, décor, signs or other items not previously approved as meeting Franchisor’s standards and specifications.
FIXTURES, FURNISHINGS AND EQUIPMENT. Subtenant shall assign, transfer, and convey to Sublandlord all of Subtenant’s right, title, and interest in and to certain fixtures, furnishings, and equipment used by Subtenant (the “FF&E”) in connection with Subtenant’s business located at the Premises. Subtenant shall execute and deliver to Sublandlord a xxxx of sale substantially in the form of Exhibit A attached hereto (the “Xxxx of Sale”) evidencing transfer and conveyance of the FF&E effective as of the Termination Date. A description of the FF&E is contained in Schedule 1 to the Xxxx of Sale.
FIXTURES, FURNISHINGS AND EQUIPMENT. Tenant hereby agrees that all equipment installed by Landlord as part of the Landlord’s Work (i.e., equipment installed within or outside the Premises that relates to the Tenant’s use of the Premises including built-in electrical, heating, cooling, plumbing systems and other building mechanical equipment), shall be maintained, repaired and periodically inspected by Tenant, but shall become part of the Premises, and remain Landlord’s property after the expiration or termination of this Lease. Notwithstanding the foregoing, Landlord shall have no obligation to provide any furniture, fixtures or equipment to the Premises, except as provided for in the Landlord’s Work or the DDs. Tenant shall, at its sole cost and expense, purchase and install any furniture, fixtures or equipment, excluding the equipment referenced in the preceding sentence, required to operate the Premises for the Permitted Use upon or after the Commencement Date.

  • Fixtures and Equipment Each of the Company and its Subsidiaries (as applicable) has good title to, or a valid leasehold interest in, the tangible personal property, equipment, improvements, fixtures, and other personal property and appurtenances that are used by the Company or its Subsidiary in connection with the conduct of its business (the “Fixtures and Equipment”). The Fixtures and Equipment are structurally sound, are in good operating condition and repair, are adequate for the uses to which they are being put, are not in need of maintenance or repairs except for ordinary, routine maintenance and repairs and are sufficient for the conduct of the Company’s and/or its Subsidiaries’ businesses (as applicable) in the manner as conducted prior to the Closing. Each of the Company and its Subsidiaries owns all of its Fixtures and Equipment free and clear of all Liens except for (a) liens for current taxes not yet due and (b) zoning laws and other land use restrictions that do not impair the present or anticipated use of the property subject thereto.

  • Supplies and Equipment The Union and employees will not use state-purchased supplies or equipment to conduct union business or representational activities. This does not preclude the use of the telephone for representational activities if there is no cost to the Employer, the call is brief in duration and it does not disrupt or distract from the Employer’s business.
