Each Owner shall maintain, repair and replace those portions of all storm water pipes and other storm water Improvements situated on their Parcel, excluding Common Area (which shall be maintained by the Association) or Shared Maintenance Areas as shown on the Maintenance Plat (which shall be maintained in accordance with Section 5.6, below).
Without the prior written approval of the Board of the Association, there shall be no change to any exterior lighting fixtures, installations and equipment serving the Master Association Maintenance Areas or Common Areas (solely or primarily), even if same are located within the common areas/elements owned or administered by a Parcel Specific Manager.
To the extent that the Parcel Owner determines to rebuild, and the Master Association thereafter determines to rebuild the applicable Master Association Maintenance Areas, the Parcel Owner shall have responsibility and priority for coordinating the rebuild, with the Master Association deferring to, and coordinating with, the Parcel Owner.
The obligation for conveyance of Common Areas shall not include or be extended to include the Master Association Maintenance Areas which are not required and/or intended to be conveyed to the Master Association.
To the extent that the Parcel Owner elects not to rebuild, then the Master Association may not mandate rebuild, it being recognized and agreed that the rights of the Master Association with respect to the Master Association Maintenance Areas are junior and subordinate to the rights of the applicable Parcel Owner.
In the event of damage to or destruction of any portion of the Common Areas and/or Master Association Maintenance Areas, the Master Association shall repair or replace the same from the insurance proceeds available, subject to the provisions of Article 11 of this Master Declaration.
The Master Association shall also maintain flood insurance on the insurable improvements on the Common Areas and Master Association Maintenance Areas in an amount equal to the lesser of 100% of the replacement costs of all insurable improvements (if any) within the Common Areas and/or Master Association Maintenance Areas or the maximum amount of coverage available under the National Flood Insurance Program, in either case if the insured improvements are located within an “A” flood zone.
The Association shall maintain the Common Maintenance Areas in accordance with the Community-Wide Standard.
Meetings should be held in each of the WSDOT regions, either at each Maintenance Area, or in a combination of Maintenance Areas when appropriate.
Hardscape and improvements maintenance shall include: the upkeep, repair and replacement of all lighting fixtures, bulbs, ballasts and wiring; benches; tables; utilities systems; concrete work; parking area and drive lane pavements; striping of parking areas; and all other improvements comprising the Maintenance Areas and any replacements thereof.
