Frequency Coordination. It is necessary to "coordinate" the frequencies to be used on the paths to be activated with other potentially interfering frequencies used either by ART or by third parties, and engineer the path layouts, in order to optimize path performance. ART's Engineering Department shall be responsible for all Spectrum Services. In addition, ART shall maintain, or cause to be maintained, databases and systems to support coordination with other 38 GHz service providers. Frequency coordination information and engineering databases shall remain the property of ART and shall be considered Confidential Information by Purchaser and subject to the provisions of Section 16.

Frequency Coordination. NOAA will take responsibility for ITU frequency filing (via NTIA) for the F-7/C-2 mission, including all frequencies used for TT&C and scientific payloads. Such filings shall be made in accordance with the Radio Regulations of the International Telecommunication Union (or any successor agency) and the laws and regulations of all domestic communications regulatory authorities having jurisdiction over MSV and MSV Canada. Frequency Coordination. As FCC Regulations require, the implementation and operation of the System, the Network Master Site, the Subscriber Equipment and such other related communications equipment and the use and sharing of the Shared Spectrums among the Parties and the Participants, as provided in the Participation Agreement, will require a Frequency Coordinator to perform Frequency Coordination and to demonstrate to the FCC pursuant to 47 CFR §90.175 (Frequency Coordinator Requirement) that such frequency Coordination has been accomplished. Accordingly, the Parties agree that the Frequency Coordination services of APCO shall be employed in order to satisfy the requirements of FCC Regulations, including, without limitation, 47 CFR §90.175, in a prompt and timely manner and as necessary in order to cause the System to become operational. The Parties will cooperate fully in retaining Frequency Coordination from APCO and, in that regard, each Party shall be responsible for making and filing required applications and submitting necessary technical information and system requirements to APCO. In making and filing the APCO application(s), each Party shall clearly establish, and require APCO to do likewise in all filings or applications made with the FCC, that the Shared Spectrums or frequencies are being coordinated on a shared basis and that each Party retains ownership and control of its respective FCC License and the frequencies or spectrums subject thereto or assigned thereby. The Parties will pay their own costs and expenses in employing the services of APCO.
Frequency Coordination. Contractor is not responsible for radio frequencies coordination, or the preparation of filings for International Telecommunications Union/International Frequency Registration Board (ITU/IFRB) registration or FCC requirements; provided, however, that Contractor shall render assistance to Purchaser and its designees as may be reasonably requested in connection with their filings with the FCC or other governmental agencies.
