Frequency Coordination. It is necessary to "coordinate" the frequencies to be used on the paths to be activated with other potentially interfering frequencies used either by ART or by third parties, and engineer the path layouts, in order to optimize path performance. ART's Engineering Department shall be responsible for all Spectrum Services. In addition, ART shall maintain, or cause to be maintained, databases and systems to support coordination with other 38 GHz service providers. Frequency coordination information and engineering databases shall remain the property of ART and shall be considered Confidential Information by Purchaser and subject to the provisions of Section 16.

Frequency Coordination. MSV and MSV Canada shall be responsible for the timely preparation and submission of all filings required by the International Telecommunication Union (or any successor agency thereto) and all relevant domestic communications regulatory authorities regarding radio frequency and orbital position coordination. Such filings shall be made in accordance with the Radio Regulations of the International Telecommunication Union (or any successor agency) and the laws and regulations of all domestic communications regulatory authorities having jurisdiction over MSV and MSV Canada. Contractor shall provide such reasonable cooperation and support as may be reasonably requested by MSV (and/or MSV Canada through MSV) in support of the preparation and submission of such filings. ART's Engineering Department shall be responsible for all frequency coordination, spectrum management, path engineering and transmission engineering in connection with the Services. In addition, ART shall maintain, or cause to be maintained, databases and systems to support coordination with other 38 GHz service providers. Frequency coordination information and engineering databases shall remain the property of ART and shall be considered confidential information by Reseller and subject to the provisions of Section 15.1.
Frequency Coordination. In addition to the Rights of Use granted to Xxxxxx under Section 3.0 hereof, ART shall also provide Xxxxxx with channel conflict assessment services ("Frequency Coordination") for links sold by Xxxxxx to the PCS market. Xxxxxx shall notify ART at least 15 working days prior to each shipment made under this agreement, and ART shall be solely responsible for Frequency Coordination and provide to Xxxxxx the frequency assignment within 5 business days of Xxxxxx notification to ART, including the assignment of the frequency to be used by the end-user and avoidance of channel conflicts. Frequency Coordination. Inmarsat will be responsible for all the frequency coordination activities related to Alphasat mission (including TDP’s); resolution of potential problems related to TDP selected frequencies are specifically excluded from Inmarsat’s responsibilities.
