Government Assistance. 9.1 Upon application in the prescribed manner, and subject to compliance with applicable laws and relevant procedures, the Government or its nominee will:
(a) use their good offices to provide the right of ingress and egress from the Contract Area and any facilities used in Petroleum Operations, wherever located, and which may be within their control;
(b) use their good offices, when necessary, to assist the Contractor in procurement or commissioning of facilities required for execution of Work Programmes including necessary approvals, permits, consents, authorisations, visas, work permits, Licenses including Licenses and Leases, rights of way, easement, surface rights and security protection at the Contractor’s cost, required pursuant to this Contract and which may be available from resources within its control; and
(c) in the event that onshore facilities are required outside the Contract Area for Petroleum Operations including, but not limited to, storage, loading and processing facilities, pipelines and offices, use their good offices in assisting the Contractor to obtain from the authorities of the state in which such facilities are required, such licenses, permits, authorizations, consents, security protection at the Contractor’s cost, surface rights and easements as are required for the construction and operation of the said facilities by the Contractor.
Government Assistance. The Borrower promises to apply for all government grants, assistance and rebates in respect of Taxes.
Government Assistance. Article 10 Discovery, Development and Production
Government Assistance. The Trustor will provide information to local government agencies for SSI, Medicaid, food stamps and subsidized housing recipients as requested for benefit verification and/or recertification.
Government Assistance. Upon application in the prescribed manner, and subject to compliance with applicable laws and relevant procedures, the Government or its nominee will:
Government Assistance. The Beneficiary or the Beneficiary’s representative must, within five (5) days of the event, notify the trustee whenever the Beneficiary:
a. applies for governmental assistance,
b. has an application for governmental assistance approved or denied, or
c. has governmental assistance terminated. Notice under this provision must be made in writing, to the Trustee, at such address as the Trustee may designate. The Trustee shall not be held liable for making any disbursements which result in a reduction of government assistance, termination of government assistance or ineligibility for government assistance when the Trustee did not have actual notice of such government assistance or of circumstances giving rise to reduction, termination or ineligibility at the time such disbursements were requested or made. In addition, if a Beneficiary or the Beneficiary’s representative waives Trustee liability in a signed writing as a condition to receiving a distribution that would, or could be expected to, result in a reduction, termination or determination of ineligibility for government assistance, the Trustee shall not be held liable for the results of the distribution.
Government Assistance. 8.4.1 The Government shall use reasonable efforts to assist, to the extent requested:
8.4.1.1 the Concessionaire in obtaining Customs clearance for the import of plant, machinery, equipment and materials whether by the Concessionaire or its Contractors for the CHP5 Project;
8.4.1.2 the foreign personnel staff of the Concessionaire and its Contractors to obtain visas and work permits required for entry into and departure from Mongolia for the CHP5 Project;
8.4.1.3 with the Concessionaire's engagement in discussion with the Ministry of Finance and any Relevant Authority in relation to payment, exemption or reimbursement of Taxes in respect of the CHP5 Project; and
8.4.1.4 to secure any available tax incentives and stabilisation benefits from any Relevant Authority, as required by the Concessionaire.
8.4.2 The Government shall provide such support and assistance to the Concessionaire as is specified in Error! Reference source not found., Part 2 in respect of the availability of Foreign Currency in Mongolia, the convertibility of Togrog into Foreign Currency, the transfer of funds (including dividends) to and from Mongolia and the other matters specified in such part.
Government Assistance. Any and all direct or indirect assistance received by Contractor as a result of government assistance or bail-out plans will be forwarded directly to United to the extent reimbursed by United to Contractor or included in future payments by United to Contractor. Examples include, but are not limited to, direct payments to Contractor, loan programs, reimbursement of security fees, and waivers of any and all fees and taxes.
Government Assistance. Schedule 4.21 attached hereto describes all agreements, loans, other funding arrangements and assistance programs (collectively called " GOVERNMENT ASSISTANCE PROGRAMS") which have been provided to the Seller and its Affiliates in respect of the Operations from any Government Entity.
Government Assistance. There are no agreements, loans, other funding arrangements and assistance programs (collectively, “Government Assistance Programs”) which are outstanding in favour of the Corporation from any federal, provincial, municipal or other Governmental Authority.
