Common use of Granting of Leave Clause in Contracts

Granting of Leave. Subject to the provisions of subclause 24.3.2 Amounts of leave, and subclause 24.5 Granting of leave in advance, of this clause, an employee shall not be entitled to, and an employer shall not be required to grant leave pursuant to this clause until the amount of leave to which the employee has become entitled equals 13 weeks in respect of the first period of entitlement and 8-2/3 weeks in respect of any subsequent periods of entitlement. Except as provided in subclauses 24.3 Amounts of leave and 24.6 Payment for period of leave, of this clause, payment shall not be made to an employee in lieu of any long service leave or part thereof to which the employee is entitled hereunder nor shall any such payment be accepted.
