Granting of Vacation Leave. 31.2.1 Both parties agree that although vacation leave credits are earned as a matter of right, the scheduling and granting of such leave must be authorized in advance by the Council before such leave is taken. The scheduling and granting of vacation leave should be so arranged as to adequately meet the operational requirements of the Council. 31.2.2 Subject to 31.2.1, an employee may: 31.2.2.1 during the first six (6) calendar months of employment be granted vacation leave up to the amount of earned credits; 31.2.2.2 after the first six (6) calendar months of employment be granted vacation leave in excess of the earned credits but only to the extent of credits that would be accumulated by the end of the fiscal year concerned. 31.2.3 If an employee has used more vacation leave than he has earned and his services are terminated for a reason other than death, or lay-off with two (2) or more years of continuous service, the salary overpayment resulting from the use of unearned vacation leave shall be recovered from the employee by the Council. 31.2.4 The Council shall give an employee as much notice as practicable and reasonable of approval, disapproval or cancellation of a request for vacation leave. In the case of denial, alteration or cancellation of such leave for operational reasons, the employer shall give the written reason therefore upon written request of the employee. 31.2.5 An employee’s vacation shall normally be taken in the fiscal year in which the employee becomes eligible to take it. The Council shall, subject to operational requirements as determined by the Council, make every reasonable effort: 31.2.5.1 to schedule an employee’s vacation leave at a time or times requested by the employee; and 31.2.5.2 after October 1st and after consultation with the employee, to assign the employee available vacation periods if the Council has been unable to schedule vacation during the periods preferred by the employee or if the employee has not filed with the Council his or her preference by October 1st.

(b) An employee's vacation shall normally be taken in the fiscal year in which the employee becomes eligible to take it. The Council shall, subject to operational requirements make every reasonable effort: (i) to schedule an employee's vacation leave at a time or times requested by the employee (ii) to permit an employee to use at an agreed time in the following vacation year, any unused vacation credits earned by the employee in the current vacation year, provided that the employee has filed by January 2nd such a request. If by January 2nd an employee has not utilized all vacation credits for the current vacation year, or obtained approval to schedule them in the following vacation year, the employee shall make every reasonable effort by January 15 to schedule the balance of the current year's vacation credits at times acceptable to the Council, or to provide a general plan acceptable to the Council on how they will be used by the end of the current vacation year. In the absence of such a plan or schedule acceptable to the Council, the Council may after January 15 schedule the balance of an employee's unused vacation leave in excess of two hundred twenty-five (225) hours.

Vacation leave requests for time off between December 1 and January 7 must be submitted by July 31, after which time they will be reviewed and responded to within two weeks. (iii) to grant employees their vacation preference and in situations where two (2) or more employees express a preference for the same period of vacation leave, length of service will prevail. If an employee applies to change the date of his/her initial vacation leave request after it has been approved, or submits his/her vacation leave requests for periods specified in 15.02 (b)(ii) after the dates specified in 15.02 (b)(ii), and such request conflicts with a leave request of another employee, length of service will no longer be the determining factor in granting the amended leave application. (c) to reply, as soon as possible in writing, to an employee's written vacation request but in any event not later than two (2) weeks from the date of receipt, except where an employee requests vacation leave for the periods specified in 15.02(b)(ii), in which case the reply will be within two (2) weeks of the deadlines set out in 15.02(b)(ii); (d) (i) where in any fiscal year an employee has not been granted all of the vacation leave credited to him/her, the unused portion of vacation leave shall be carried over into the following fiscal year;
