Health and Welfare Assurances. The AE, in concert with the individual and their team, shall ensure mitigation of individual medical, behavioral, and socio-economic crisis situations in a timely manner. The AE shall manage individual situations related to incidents (including coordination with protective service entities), crisis situations, locating natural supports and funded service providers in a timely manner, diverting institutional placement, and if deemed appropriate by the Department, facilitate competency and guardianship appointments. The AE shall have at least one member who is certified by ODP to conduct investigations. The AE shall conduct periodic trend analysis by provider to identify potential systemic issues related to health and welfare. The AE shall provide ODP’s standardized and approved training curriculum to provider agency staff on how to identify and report critical incidents and reasonable suspicions of abuse, neglect, and exploitation. The AE shall utilize the CAP process to facilitate quality improvement strategies for providers related to identified issues involving the health and welfare or safeguards for individuals. The AE shall provide periodic training to individuals, families, guardians, and advocates regarding their rights, roles, and responsibilities for Incident Management. The AE shall provide ongoing standardized and approved training curriculum and technical assistance to providers relating to the needs of an individual or a provider. This shall include coordination of training resources that may fall outside the scope of an AE to provide directly. The AE shall develop and maintain a process to ensure that incidents are reviewed and approved in accordance with the timeframes and requirements outlined in the incident management bulletin and approved waivers. The AE shall develop and maintain a process ensures all required or optional investigations are conducted by an ODP certified investigator.

It is understood and intended by the parties to this Agreement that the purpose of this clause is to establish an Employer financed Health and Welfare Trust and that contributions thereto shall not be deemed to be wages to which any employee shall have any right other than the right to have such contributions paid over to the Trust fund in accordance herewith. Failure of an individual Employer to make all payments provided for, including liquidated damages for late payments, within the time specified, shall be a breach of this Agreement and will further require action by the Trustees as set forth in the Trust Agreement. Any increase in the required contributions set forth above will be paid equally (50% by the Employer and 50% by the Employee). The amount paid by the Employee will come from their NEAP contribution.

  • Health and Welfare Trust Fund Contingent upon the Fund being jointly and equally trusteed, the Employer shall contribute to the International Union of Operating Engineers Local 870 Health and Welfare Trust Fund in accordance with the attached Appendix A and forming part of this Agreement.
