Agency Staff. Any Agency Staff with access to Personally Identifiable Information (PII) must comply with the privacy and security requirements as set forth in Exhibit D. For purposes of this Agreement, Agency Staff are Agent or non-Agent employees, contractors, or subcontractors who perform administrative tasks on behalf of the Agency to assist consumers. Agency Staff may not enroll consumers into QHPs, unless properly licensed and certified with the Exchange. Prior to accessing PII, Agency Staff shall complete the fingerprinting and background check requirement as set forth in Section C subsection 5 of Exhibit D. Staff must also complete privacy and security awareness training pursuant to Section C subsection 6 of Exhibit D prior to accessing PII. Additionally, Agency must ensure that the Exchange has a complete roster of all active Agency Staff who perform any service under this Agreement. This is an ongoing obligation throughout the entire term of this Agreement. Should Agency need to update its Agency Staff roster for any reason, Agency shall request the appropriate form from the Exchange to complete the update.

Agency StaffThe Union agrees that the Employer may continue to util- ize staff from temporary employment agencies to cover unexpected peak load situations, short-term coverage of employees absent due to illness, and other projects of short duration for which hiring employees would not be feasible or practical.
Agency Staff. Staff are hired by the agency and are public servants as defined in the PSOA. The agency’s employment matters are governed by the Canada Labour Code and the Canada Human Rights Code.

If any agency staff is found to have violated this agreement unintentionally, the agency must report this violation to the Working Group and the agency staff member(s) must go through corrective training. The Working Group is responsible for providing appropriate additional training to agency staff member(s). More than one (1) unintentional offense per agency staff member will result in suspension of Assessment Tools administration rights for 60 days. ii. If any agency staff member(s) is found to have violated this agreement intentionally, the agency must report this violation to the Working Group. The Working Group will investigate the violation and make a determination as to whether training, suspension, and/or revocation of the right to administer the Assessment Tools are necessary. More than one (1) intentional offense will result in permanent revocation of Assessment Tools administration rights for the agency staff.
Agency Staff. 12.1. In the event that any Agency staff (“Cast UK Employee”) with whom the Client has had personal dealings accepts an Engagement with the Client while employed by the Agency or within 12 months of leaving the Agency, the Client shall be liable to pay a fee to the Agency equal to the greater of: 12.1.1. an Introduction Fee to the Agency calculated in accordance with clause 3.3 in relation to that Cast UK Employee; or 12.1.2. the preceding 6 calendar months’ commission revenue generated by the applicable Cast UK Employee for the Agency on all matters. 12.2. The Client shall be bound by the covenant set out in clause 12.1 during the term of these Terms, and for a period of 12 months after termination or expiry of these Terms, or the last Introduction made by the Agency, whichever is the earlier.

Agency Staff. The use of Agency staff to fill for sickness, vacation and other absences covered by this Collective Agreement will only be used as a last measure, after all available employees with the appropriate qualifications have been canvassed and offered the opportunity to work the shift in accordance with the procedure set out in Article 15.06. Agency Staff are not employees of the Employer and will not be covered under the terms of this Collective Agreement.
