Holiday Pay. (a) The following shall be considered as paid holidays for purposes of this Agreement: New Year's Eve Day Labor Day New Year's Day Thanksgiving Day Xxxxxx Xxxxxx Xxxx Day The Day After Thanksgiving Good Friday Christmas Eve Day Memorial Day Christmas Day July Fourth Employees required to work on any of the above named holidays shall receive double time for hours worked in addition to the regular holiday pay. Holiday Pay. Section 1. P-47 Employees shall be paid for specified holidays and the holidays in each of the Christmas Holiday Periods as provided hereinafter. Section 2. P-48
(a) Employees with the necessary seniority who have been laid off in a reduction of force, or who have gone on sick leave during the calendar month in which the holiday falls shall receive double time pay for hours worked in addition to the regular holiday pay. Section 5. P-51 When an eligible employee is on an approved leave of absence and returns to work following the holiday but during the calendar month in which the holiday falls, he shall be eligible for pay for that holiday.
Section 6. P-52 Employees eligible under these provisions shall receive eight (8) hours' pay for each of the holidays specified in this Article, computed at their regular straight-time hourly rate, exclusive of overtime premium.
Section 7. P-53 Employees whose work is in necessary continuous seven-day operations shall receive holiday pay in the event the holiday falls on one of their regularly scheduled days off, and they meet the other eligibility requirements of this procedure for paid holiday time; provided, however, that if the employee works a holiday which falls on his scheduled day off, or when such employees are scheduled to work on a holiday and do work, they shall not receive holiday pay under this procedure but shall be paid for time worked in accordance with Article VIII, Section 8.
Section 8. P-54 In applying this procedure, when any sort of the above-enumerated holidays falls on Sunday, and the day following is observed as the holiday by the State or layoffs are Federal Government, it shall be paid as such holiday.
Section 9. P-55 It is the purpose of the Holiday Pay provisions in Sections 1 through 8 of this Agreement to enable eligible employees to enjoy the specified holidays with full straight-time pay. If, with respect to a week (included in the Christmas Holiday Period in 2009, 2010, 2011 and 2012 an employee supplements his Holiday Pay by claiming and receiving an Unemployment Compensation Benefit, or claims and receives waiting period credit, to which he would not compensablehave been entitled if his Holiday Pay had been treated as remuneration for the week, the employee shall be obligated to pay to the Company the lesser of the following amounts:
(a) an amount equal to his Holiday Pay for the week in question, or
(b) an amount equal to either the Unemployment Compensation paid to him for such week or the Unemployment Compensation which would have been paid to him for such week if it had not been a waiting period. 2. Work in full the employee's last regularly scheduled straight time pay prior to the holiday and must have worked the scheduled workdays both immediately before and immediately after the holiday. Holiday pay is computed at the employee's first regularly scheduled standard rate at the time the holiday occurs and does not include incentive pay or shift differentials. The holiday counts as a day of work day subsequent to when computing overtime for employees eligible for holiday pay. Holiday pay is included in the paycheck covering the period in which the holiday occurs. For employees working a standard workweek, if the holiday falls on a Sunday, the following Monday will be recognized as the holiday. Should If a holiday occurs on a Saturday, the preceding Friday will be recognized as the holiday. For employees working a non-standard workweek, if the holiday falls on an employee's regularly scheduled day off, the preceding day or the following day may be recognized as the holiday, as determined by the General or Corporate Manager, or it may be paid. 2. An employee who is laid off for lack of work within ten (10) working days prior to a holiday, or is called back from lay-off within five (5) working days of the holiday will receive holiday pay provided they work their last scheduled shift prior to said holiday.
3. An employee who is out for sickness (Doctor's Slip) and has worked within ten (10) working days prior to or ten (10) working days after the holiday will receive holiday pay on an approved sick leave (Doctor's Slip). The holiday will not be counted in the count of ten.
4. Any employee who is out on a leave of absence or not on approved sick leave, or who did not work their last scheduled shift prior to, or their first scheduled shift following a holiday is not eligible for holiday pay.
5. Any active employee who is required to go on active duty in a military reserve or National Guard training period will receive holiday pay if a holiday falls during the training period provided that they make proper application to the Company and work the scheduled work day prior to and the scheduled work day following the training period and providing further that such training period is not less than two consecutive weeks or more than four weeks in any year.
6. An employee who can give sufficient proof that there has been a death in their immediate family which necessitated them to be out the day before or the day after and returns to work within ten (10) days after date of funeral shall receive holiday pay. By "immediate family" is meant, father and mother of the employee and father and mother of the wife or husband of the employee, sons and daughters of the employee, and spouse, brothers and sisters and grandchildren, step-brother, step-sister, sons-in-law, daughters-in-law, step-mother, step-fathers, grandparents, and dependents who live in the household of the employees.
7. If any of the above holidays fall within the vacation period, an employee must:
1. 28. Holiday Pay. 16.1 The Employer agrees to pay all employees for the number of hours of their regular assignment at their straight time hourly rates of pay, exclusive of shift and overtime premiums, for the ten full days and one-half day (10-1/2) as listed in 16.3 provided they meet all of the following eligibility rules:

Holiday Pay. a) Bereavement leave;
b) Court duty leave;
c) Regularly scheduled vacation;
d) Illness verified by medical certificate as required by the Chief or Designate.

7.04 Firefighters who are off work and in receipt of Workers' Compensation Benefits for more than seventeen (17) continuous weeks will not accrue lieu days.

Holiday Pay. Eligible employees shall receive holiday pay equal to each employee’s regularly scheduled work shift for each of the holidays set forth above on which they perform no work. (For example, an employee who is regularly scheduled to work an 8 hour shift will be paid 8 hours holiday pay; an employee regularly scheduled to work a 10 hour shift will be paid 10 hours holiday pay.) 15.2.1 Full-time employees who are on work schedules other than eight (8) hours per day, five (5) consecutive days per week will receive full vacation and sick leave accrual for each of the observed holidays for which they are entitled to be paid.
15.2.2 An eligible employee shall be any employee who has been an employee of the City at least one (1) day prior to the holiday.
15.2.3 No employee shall receive holiday pay if the employee is absent on their scheduled work day either immediately preceding or immediately following the holiday, unless the employee was in paid status for such day before and day after, or unless the employee has previously applied to their supervisor in writing for permission to be so absent. However, in emergency situations where an employee is unable to procure prior approval for such absence they may submit a written request for holiday pay, stating the reason for their absence to their supervisor. If the supervisor considers the reason for the absence excusable, the holiday pay shall be paid. Should the supervisor either question the validity of the request or consider the reason for the absence insufficient cause for being absent, the supervisor shall contact the Union to discuss the case and together the Union and City shall render a decision. F. If employees covered by this Agreement work on any holiday set forth in Paragraph A. in no event shall the pay for such holiday exceed regular pay plus double time.
G. Employees covered by this Agreement who do not work on the holidays hereinbefore designated, and who meet the eligibility requirements hereinbefore set forth, shall be compensated for such holiday based on pay for normal work day as defined in Article 16, at the straight time hourly rate, excluding premiums of the particular employee.
H. When an employee agrees to work on one of the hereinbefore designated holidays or layoffs are the day observed in lieu thereof, if any, and does not compensablework as agreed, he shall not receive the pay for such holiday. This shall not apply if the employee is off sick or in an emergency.
I. Employees scheduled to work on one of the hereinbefore designated holidays, or on the day observed in lieu thereof, if any, who do not work shall not receive any pay.
J. For seven (7) day operation employees (D.P.W. Maintenance Division), when a holiday is concurrent with the employee's sixth (6th) or seventh (7th) workday and the employee does not work, the employee shall be eligible for holiday pay provided, he/she shall have received at least eight (8) hours pay exclusive of overtime in the calendar week prior to, during or after the holiday, provided the employee continues on the payroll through the holiday and would otherwise be qualified for the holiday.

Holiday Pay. Section 1. To the extent permitted by the curtailment of scheduled service, therefore, employees shall not be required to work on the following days.
1 ) Requests for the floating holidays must be made no more than ninety (90) days and no less than twenty-four (24) hours in advance or 9:00 AM the preceding day in the Transportation Division (Bus and Rail). Requests on the ninetieth (90th) day will be granted according to seniority. Thereafter, requests will be granted on a first-come, first- served basis; seniority will not be a factor.

Section 3. The holiday allowance pay, as provided in Section 1 hereof, shall be used toward such weekly guarantees as are provided for in the Agreement. Pay for work performed on such holidays as provided in Section 2 hereof, shall not compensablebe used toward such weekly guarantees. This section does not apply if the employee elects to bank their holiday allowance pay as provided for in Section 2 hereof.
Section 4. If and when a day other than New Year’s Day, Xx. Xxxxxx Xxxxxx Xxxx Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day or Christmas Day becomes generally observed to a point where the service therefore can be curtailed to a holiday schedule, the observance of the Employee’s Anniversary of Employment as a holiday will then be shifted to such newly observed holiday.
Section 5. Management agrees to meet with and provide a copy of the reduced service day(s) proposal to the ATU. The ATU membership will then vote on whether to allow or disallow the contract waivers needed to operate reduced service days.
Section 6. When a holiday or its observance falls on a Monday, third shift non-transportation employees will observe that holiday on the previous Sunday.

The deliberation and decision shall be based upon both the following considerations:
(a) whether the absence would have been granted had prior approval been sought, he/she may and in addition; (b) whether the reason for not seeking prior approval was a valid one. Such decision shall be required final and binding and not subject to provide medical certification of such illness or disablement in order to receive holiday paythe grievance procedure.
(c) Holidays occurring 15.2.4 If a holiday is observed during leaves of absence of any sort or layoffs are an employee's vacation period, the employee shall be paid for such holiday and it shall not compensablecount against the employee’s accumulated vacation leave.

a. Any employee taking an unexcused absence on the day before or after a holiday shall not be paid for purposes that holiday. An unexcused absence shall include, but not be limited to the following: AWOL, any vacation day or personal day that has not been previously approved. The Chief of Police may, at his discretion, require a non-dispatch employee using paid sick leave on the day before or after a holiday to provide written proof of illness, if the employee has used paid sick leave in conjunction with a holiday previously within the term of this Agreement: New Year. The Chief of Police must notify an affected employee that he/she is to provide said notice prior to the use of a sick day.
b. If an employee is scheduled to work on a holiday and does so, compensation will be at one and one-half (1 ½) times the Employee's Eve Day Labor Day New Yearhourly rate for each hour worked. Should the employee be sick or disabled Company, on either of these days, he/she will be excused provided the employee works at least one day in either the week before or after the holiday. An employee who is scheduled to work on the holiday and does not report for work for reasons other than illness will not be paid for the holiday. Where orderly operation may require, the employer will have the ultimate right to allocate the floating holiday. So far it is practicable, the holiday shall be required taken at the time reguested by the employee. Employees will only be eligible for this floating holiday after the completion of one year of continuous employment with the Company. Employees returning from lay off must work for three months before they are eligible for the floating holiday. 6.03 A regular full-time employee appointed to full time on or before April 11, 2010 will be entitled to a floating paid holiday once each year in lieu of Remembrance Day. A regular full-time employee appointed to full time on or after April 11, 2010 will be entitled to a floating paid holiday once each year in lieu of Remembrance Day after completing five years (four years effective June 17, 2012) of full-time service. Such day off, with pay, will be scheduled by mutual agreement between the Employer and the employee's first regularly scheduled work day subsequent .
6.04 The Employer may designate the Good Friday statutory holiday to be observed in the following week for those employees who volunteer to do so provided it gives the Union fourteen (14) days advance notice. In situations where there are more volunteers in a department who wish to observe Good Friday in the following week than are needed by the Employer, the senior employee will be given preference subject to the Employer having sufficient qualified employees on duty to efficiently operate the business. For those full-time employees who observe Good Friday in the following week they will be given either the Monday or Saturday as their day off in the week following Good Friday, unless mutually agreed to between the Employer and the employee.
6.05 The Employer will schedule employees to work on a statutory holiday on a fair rotation basis from among those qualified employees in the department who have indicated their interest in being scheduled on statutory holidays. If insufficient qualified employees volunteer for the holiday. Should , the Employer shall have the right to schedule qualified employees to work the holiday in reverse seniority order and those so scheduled will work the holiday.

Holiday Pay. (a) The following A. When a holiday occurs on an employee’s scheduled work day and the employee receives the day off, the employee shall be compensated for their scheduled hours at regular pay, and such compensation shall be considered when computing overtime pay for that pay period.
B. If an employee is required to work a holiday (not including callback), the employee shall be compensated at two and one-half time (2 ½) basic hourly pay times their hours worked. The scheduled hours shall be included when computing overtime pay for that pay period.
1. If the date that the State of Nevada recognizes a holiday differs from the date for the same holiday defined under Section f and the employee works both of these days, the employee may choose which of the two days to enter as holiday worked on their timesheet. The date not chosen should be entered as base pay on the timesheet. If an employee works only one of the days, they should report holiday worked on their timesheet for the day they actually worked. Under current state law, PERS will only be paid holidays for purposes holiday worked reported on a date recognized by the State for a holiday.

Holiday Pay. 16.2 All regular, probationary and temporary employees shall be paid at their basic wage rate for their scheduled tours on each holiday whether they work or are excused. If such regular or temporary employee works, he or she shall also be paid under Article XV. Occasional and summer occasional employees shall receive no pay for a holiday not worked but shall receive one and one half (1-1/2) times their basic hourly rate for all time actually worked on a holiday.
16.3 Employees required failing to work as scheduled on any a holiday shall not be entitled to the above holiday credit unless a reason satisfactory to the Company is given by the employee for such failure. Employees failing to work as scheduled on either of the above named holidays scheduled work days which immediately precede or follow the holiday shall receive double time for hours worked in addition not be entitled to the regular above holiday paycredit unless a reason, satisfactory to the Company, is given by the employee for such failure, or unless they actually work the holiday.
16.4 An employee may select four (4) days each calendar year as “Personal Holidays”. All The days need not be the same each year. Beginning January 2 and concluding on January 12, employees shall be polled in order of seniority for selection of their personal holidays and their accompanying pay within the calendar year. After January 12, personal holiday selections shall apply to all employees covered by this Agreement with the following exception: July Fourth is not a paid holiday for child nutrition and bus drivers. When a holiday falls be on a Saturday first-come, first-served basis and seniority will not prevail. An immediate emergency is defined as a serious health condition of absence a family member or an unexpected situation regarding safety or property damage.
16.6 Employees may not carry over personal holidays from one year to another. Any unused personal holidays at the end of the calendar year will be forfeited. In addition, employees who leave the Company for any sort or layoffs are not compensablereason prior to taking their personal holidays will forfeit their unused holidays.

Holiday Pay. (a) The following Holiday Pay will be administered as follows:
A. If a holiday occurs during an Employee’s vacation, he shall receive Holiday Pay in addition to Vacation Pay or shall be considered given an additional day’s vacation or an extra day’s pay, at management’s discretion. The Holiday Pay shall not exceed eight (8) hours.
B. If a holiday occurs during a leave of absence, the Employee shall not be paid for that holiday.
C. Holidays not worked that fall during an Employee’s regularly scheduled workweek shall be paid at eight (8) hours straight-time and shall be counted as paid holidays days worked for purposes the purpose of this Agreement: New Year's Eve Day Labor Day New Year's Day Thanksgiving Day Xxxxxx Xxxxxx Xxxx Day The Day After Thanksgiving Good Friday Christmas Eve Day Memorial Day Christmas Day July Fourth computing overtime for that week.
1. If a holiday occurs on a regularly scheduled day off, and the Employee does not work, he shall receive an additional eight (8) hours straight-time pay for that workweek.
2. Employees required to work on any a holiday, shall be paid eight (8) hours straight-time Holiday pay, plus time and a half for the hours worked on that day.
a. If an Employee is scheduled to work on a holiday and does not report to work, he shall not receive Holiday Pay without his Department Head’s written approval.
b. To receive Holiday Pay, an otherwise eligible Employee must be at work on the scheduled workday immediately preceding and immediately following the day on which the holiday is observed. If an Employee is absent on one (1) or both of these days because of an illness or injury, the Employer reserves the right to request that the Employee provide medical verification.
c. If an Employee leaves work early, he shall receive Holiday Pay only for the actual hours worked unless the reason for the “early out” is at management’s request. In such cases, the Employee shall receive eight (8) hours Holiday Pay plus the hours worked.
D. Employees hired from Farmland immediately after the purchase of the above named holidays shall receive double time for hours worked in addition to the regular holiday pay. All holidays and their accompanying pay shall apply to all employees covered by this Agreement with the following exception: July Fourth is not a paid holiday for child nutrition and bus drivers. When a holiday falls on a Saturday or Sunday, that holiday refinery shall be scheduled on entitled to receive holiday pay upon initial hire by the nearest weekday to it which school is not in session Company. Probationary employees and which is not otherwise a holiday. Custodial and maintenance employees shall have an additional holiday during Christmas week. This holiday shall be scheduled such that this holiday together with Christmas Day and Christmas Eve Day shall constitute three consecutive work days off at Christmas. Custodial and Maintenance employees shall also have an additional holiday during New Year's week. This holiday shall be scheduled such that this holiday together with New Year's Day and New Year's Eve Day shall three consecutive work days off at New Year's. Custodial and maintenance temporary employees will receive one paid holiday during the scheduled spring break.
(b) To not be eligible for holiday pay, an employee must:
1. Be a regular full time or part time employee and have attained seniority (fulfilled the probationary period) on the date the holiday occurs.
2. Work in full the employee's last regularly scheduled straight time pay prior to the holiday and the employee's first regularly scheduled work day subsequent to the holiday. Should the employee be sick or disabled on either of these days, he/she may be required to provide medical certification of such illness or disablement in order to receive holiday pay.
(c) Holidays occurring during leaves of absence of any sort or layoffs E. The Employer shall have the right to determine which employees are not compensablescheduled to observe the holidays specified in this Article as non-work days.
