Common use of Holiday Qualification Clause in Contracts

Holiday Qualification. In order to qualify for holiday pay or the premium rate for work performed on a holiday, the employee must work all the hours he/she was scheduled to work his/her last scheduled work day before the holiday and all the hours he/she was scheduled to work his/her next scheduled work day following the holiday, unless on approved sick leave. In addition, an employee must be actually on the active payroll of the Employer at the time the holiday occurs, i.e., must not be on layoff status, leave of absence or workers compensation leave.
