Common use of Impact of Leave Clause in Contracts

Impact of Leave. During the currency of an agreement under clause 18.4 the following will apply: (a) Any Employee who takes paid leave on full pay shall receive the Benefits and salary referred to in clause 18.4; (b) If an Employee takes leave without pay the Employee will not be entitled to any Benefits during the period of leave; (c) If an Employee takes leave on less than full pay, he or she shall receive a proportional amount of salary based on the full time salary payable during the leave; and (d) Any other payment under this Agreement, calculated by reference to the Employee's salary, however described, and payable: (i) during employment; or (ii) on termination of employment in respect of untaken paid leave; or (iii) on death, shall be at the rate of pay which would have applied to the Employee under
