Information obligation. TAMINCO shall be bound to provide the MANAGER with all necessary information and data which are necessary for the correct, complete and timely compliance and performance of this Agreement. The MANAGER has the obligation to notify TAMINCO of all data, information or developments relevant to the trading activities of TAMINCO and its affiliated group companies which he obtained when exercising his mandate.
Information obligation. The Network Partner shall notify SIX in a timely manner of any changes in its area that may be relevant with regards to the performance of this Agreement.
Information obligation. The supplier must make all required information available to the LEIBER Group in all phases of the cooperation, that is, from product development to series production, up to and including spare part supply. If the supplier determines that they are deviating from defined agreements (for example, concerning the project plan, deadlines, test methods, test equipment, test sequence and test scope, delivered quantities, packaging, drawings and specifications for product and process quality), they are obligated to inform the Purchasing department of the LEIBER Group about this in writing immediately (at latest within seven days) and to coordinate the initiated corrective measures with the LEIBER Group. This also applies if the requirements contained in the part requirements document as well as project goals and content are not being met in the individual phases. The following items are notifiable according to VDA, among other things, and require clarification with the LEIBER Group as to whether a series approval is required: Use of another chemical composition (deviation from the specifications in the material data sheet) Use of new or modified tools (exception: wear tools) for series production Modified / changed process Relocation to another site Change in suppliers After interruption in production of 12 months or longer Changes to the process parameters Other changes to defined agreements If the supplier is planning a change to their process or to the product, they must announce this in writing to the LEIBER Group and have it approved of in advance. The approval procedure is to be coordinated with the LEIBER Group. Usually, the approval procedures are required according to the requirements of VDA Vol.2 (PPF) or AIAG (PPAP). All changes require the approval of the LEIBER Group. The information obligation also exists if the produced products have quality deviations. The information must be provided in full in a timely manner so that the LEIBER Group can check the effect and the change can be objected to before it is applied, and also so that suitable measures (for example, new PPAP, auditing the new/modified process/production site) can be initiated.

The Supplier is obliged to inform the Buyer about organizational changes that affect his ability to deliver (e.g. sale, company takeover, change of management, personnel changes in key positions). All verification documents of certificates and customer approvals of the Supplier must be made available to the Buyer in the current version. The changes in the approval or certification status should be notified unsolicited and in due time to the Buyer. If the Supplier receives a special customer status from the Buyer’s customer (OEM) or if he loses the QMS certificate (IATF 16949, VDA 6.1 or ISO 9001), the Buyer must be informed immediately. Failure to pass a re-qualification test must be reported to the Buyer and may trigger a new PPF procedure. If it becomes apparent that agreements made (e.g. on quality features, delivery dates, delivery quantities) cannot be complied with, or if the Supplier detects a deterioration in quality, he shall be obliged to inform the Buyer immediately of this and of the circumstances surrounding it and take corrective action. He is obliged to disclose the relevant data and facts. The Supplier is obliged to report to the Buyer any incidents involving additional freight costs (number of special transports). The Supplier shall notify the Buyer in writing and in a timely manner of any planned changes to production processes and inspection procedures affecting the product quality, changes to the product or relocations of production sites, (see Trigger matrix for PPF-relevant events according to VDA 2). The Supplier shall notify the Buyer in writing at least nine months prior to the PPF execution. The Buyer will then decide whether the planned change is subject to initial sampling. All changes to the product and production process must be recorded in a product change history.

In case it becomes noticeable that agreements made e.g. on quality characteristics, schedules, delivery volumes cannot be fulfilled, or in case the Supplier detects a decline in quality, the Supplier is obliged to inform the Buyer thereof as well as about detailed circumstances promptly and to initiate corrective actions. The Supplier is obliged to disclose respective process documentation and manufacturing data. The Supplier shall inform the Buyer timeously before any changes that are being planned for production processes, testing procedures and any change of production location that may effect the product quality. The Buyer shall then decide whether the changes planned require new sampling. Any changes to the product and production process are to be documented in a product life cycle (change history) by the Supplier.

In case it becomes noticeable that agreements made e.g. on quality characteristics, schedules, delivery volumes cannot be fulfilled, or in case the Supplier detects a decline in quality, the Suppli- er is obliged to inform the Buyer thereof as well as about detailed circumstances promptly and to initiate corrective actions. The Supplier shall inform the Buyer timeously before any changes that are being planned for pro- duction processes, testing procedures and any change of production location that may effect the product quality. The Buyer shall then decide whether the changes planned require new sampling. Information obligation. The Client must inform the Processor as soon as reasonably possible of any legitimate inspection or audit of the Client Data processing by any competent authority which relates to the Data processing by the Processor.
