Insurance of Employees. Insurance against any Claim in respect of any personal injury to or death of any person employed or engaged by the Service Provider which arises out of, or is caused or contributed to by, the performance or non-performance of the Services by the Service Provider or any Subcontractor or agent or employee of the Service Provider or Subcontractor: (a) at common law and for breach of any statutory duty or legislative requirements; and (b) for any compulsory statutory workers’ compensation benefits or other liability under the Workers’ Compensation and Injury Management Act 1981 (WA) or other applicable legislation. Sum insured Provide cover to such amount as prescribed from time to time by the Workers’ Compensation and Injury Management Act 1981 (WA) or any other applicable legislation. Insured The insurance must be in the name of the Service Provider. Scope of cover Insurance against all loss and/or damage to all items of the Service Provider's plant and equipment (whether owned, hired or leased) used in the performance of the Services. The Service Provider must insure all vehicles or items which are licensed as motor vehicles or are required to be so licensed (whether owned, hired or leased) used in the performance of the Services under: (a) compulsory motor vehicle third party insurance; and (b) a comprehensive motor vehicle and third party liability policy. Sum insured The limit of liability must be no less than $[insert] million for any one occurrence and unlimited as to the number of occurrences. Insured Other than for compulsory third party motor vehicle insurance, the insurance must be in the name of the Service Provider and, to the extent permitted by law, be extended to indemnify Western Power as principal for Claims from Third Parties.
Insurance of Employees. (a) Each Participant shall maintain insurances until the Date of Final Completion and while ever the rectification of Defects is carried out under clause 11.3, against liability for death of or injury to its employees including liability by statute and at common law.
(b) The NOPs' employee insurance policies will be for the maximum amount required by law, and where permitted by law, will extend to indemnify TfNSW for TfNSW's statutory liability to persons employed by any NOP.
(c) The Participants will ensure that every Subcontractor is similarly insured.
Insurance of Employees.
(a) The Contractor shall effect and maintain insurance covering all liability for death of, or injury to, persons employed or engaged by the Contractor in connection with this Agreement, including liability under any Applicable Laws (including under the Workers' Compensation and Injury Management Act 1981 (WA) (Workers Compensation Act) and at common law, which insurance must:
(i) provide cover for an amount not less than the amount stated in Item 10(a), in respect of any one accident to any one person or number of persons, arising out of any one occurrence and unlimited as to the number of occurrences;
(ii) where permitted by law, the insurance cover must be extended to indemnify Brightwater for Brightwater’s statutory liability for persons employed by the Contractor and contain a waiver of subrogation from the insurer in favour of Brightwater including where:
(A) Brightwater is liable pursuant to section 175 of the Workers Compensation Act; or
(B) Brightwater is sued by an employee of the Contractor (or an employee of a Subcontractor) as a result of the Contractor's negligence; and
(iii) be maintained by the Contractor for the duration of this agreement.
(b) The Contractor shall ensure that all Subcontractors effect and maintain insurance which complies with the requirements set out in this subclause 11.5 in respect of persons employed or engaged by Subcontractors.
Insurance of Employees. Before commencing the Works, the Contractor shall ensure that a suitable insurance policy is taken out giving cover to itself against any liability, loss, damage, claim, demand, action suit or proceedings, costs and expenses whatsoever arising under any statute or other legislative provision, including any Statute or such provision relating to injury or the death of any person employed by the Contractor in or about the execution of the Works under this Contract. The Contractor shall ensure that its subcontractors are similarly insured in accordance with this Clause 10.1.
Insurance of Employees. The Provider shall for the duration of this Agreement maintain insurance in respect of personal injury or death of any person arising under a contract of service with the Provider and arising out of an incident occurring during the course of such person's employment and shall comply with the Employer's Liability (Compulsory Insurance) Act 1969 and any related statutory orders made.
Insurance of Employees. (a) Before the Service Provider commences carrying out the Services, the Service Provider must insure against liability for death or injury to persons employed by the Service Provider including liabilities, under Law including relevant workers compensation legislation and at common law. The insurance cover must be maintained annually until the later of the date the Service Provider completes carrying out the Services and expiry of this Deed.
(b) Where permitted by Law, the insurance cover must be extended to indemnify the Principal for the Principal's statutory liability for persons employed by the Service Provider.
(c) The Service Provider must ensure that employees of the Service Provider’s Subcontractors are similarly insured as the Service Provider’s employees are required to be insured under this clause 10.3.
Insurance of Employees. 18.3.1 Before commencing the Work, the Contractor shall insure against liability for death or injury to persons employed by the Contractor, including liability imposed by statute and at common law. The insurance coverage shall be for an amount in the greater of (i) Ten Million Dollars ($10,000,000) or (ii) as required by law, and shall be maintained until all Work pursuant to the ORION 2 Contract, including remedial work, is Delivered. The Contractor shall ensure that all Subcontracts contain a similar provision.
18.3.2 The Contractor's insurers shall waive all rights of subrogation against ORION save those for which ORION indemnifies the Contraxxxx pursuant to Article 17.2 hereof.
Insurance of Employees. The Road User must ensure that it and any of its sub-contractors effect andmaintain employers’ indemnity insurance including workers’ compensation insurance in respect of all Authorised Persons. Such cover must:
(i) be in respect of liability for death of or injury to persons employed including liability by statute and at common law; and
(ii) be maintained while any work under this Agreement remains to be done; and
(iii) include a principal’s indemnity extension for Workers’ Compensation and Injury Management Xxx 0000 (WA) benefits and common law liability of at least $20,000,000 (or such other agreed amount).
