JOB POSTING AND BIDDING. 10.1 When a new job is created or a job becomes vacant, the City agrees to post notice of the same on bulletin boards within fourteen (14) calendar days. Said notice shall be sent to all department heads and stewards at least one working day prior to the vacancy's posting date. Postings shall have a minimum duration of five (5) working days unless the City and the Union agree differently. Employees who are interested must make written application. Every effort will be made to fill said job or vacancy on the basis of seniority from the bargaining unit, if applicant has the necessary qualifications and experience to perform the duties. 10.2 The provision of this Article shall not apply to: (a) Emergency positions. (b) Student Intern, and other positions filled by students and/or trainees such as, Neighborhood Youth Corps, MDTA, Vocational Training and Cooperative Work Study Positions (c) Positions not included within the bargaining unit. (d) Positions accreted into the bargaining unit shall not require testing or posting. 10.3 In case of emergency, a City appointing authority may make an emergency appointment of any person to any position without regard to the provisions of this Agreement to carry on work that must be continued in the public interest, but no such emergency appointment shall continue for more than thirty (30) calendar days nor shall successive emergency appointments be made, and if a need exists for the position to continue beyond thirty (30) calendar days, the position shall be deemed vacant and posted in accordance with Section 1 of this Article. All such emergency appointments shall be reported to the Union within two (2) working days. 10.4 A vacancy will exist when there is a budget appropriation for the position, when no person holds or claims to hold the position, and when the appointing authority has established sufficient need and reason for the position to exist and has requisitioned that the position be filled. If a position which has been held by a member of the bargaining unit within the contract year is no longer held by such person and is not, within ten (10) calendar days, declared vacant by the City, the City shall so notify the Union. 10.5 The City agrees to furnish a copy of any job posting to the Union President for those jobs within the bargaining unit. 10.6 Employment and promotional lists for classified competitive positions shall be made available to the Union President. 10.7 The City shall have the right to hire temporary employees for a period not to exceed 6 months. The City shall notify the Union in writing of all such hires of temporary employees at the time of hiring and every 60 days thereafter. This provision shall not apply to positions where persons hold or claim to hold such positions or have been layoffs. 10.8 If the City fills temporary promotional vacancies, then the City shall make every effort to fill temporary promotional vacancies of a duration of 3 days or more first from the certified promotional list and secondly on the basis of seniority. JOB POSTING AND BIDDING. 10.1 When a new job is created or a job becomes vacantSection 1. In all cases of filling of regular full-time vacancies which are required to be posted, the City agrees length of continuous service shall be the governing factor (seniority). However, the Employee must also have the ability and physical fitness to post notice perform the work and must have a good work record including attendance, tardiness, and job performance. In determining an Employee's ability and physical fitness to perform the normal requirements of the same new job, consideration will be given to job experience, related job experience, education, and/or ability.
Section 2. A job, other than a supervisory one, becoming open as a regular full-time vacancy shall be posted on the appropriate bulletin boards within fourteen board for a period of three (143) calendar daysworking days by the Employer and assigned to the senior qualified bidder.
Section 3. Said A standard form of posted notice shall be sent to all department heads used for advertising such job vacancy and stewards at least one working day prior shall contain the following information: department, date of posting notice, description and rate of job that is vacant. Such bids shall be in writing and submitted by the Employee to the vacancy's posting date. Postings shall Employer.
(a) In the event of a transfer to the production department, the applicant must have a minimum duration of six (6) months seniority and a good work record, including attendance, tardiness, and performance.
(b) Anyone not making claim or refusing the job within seventy-two (72) hours after notice is posted shall forfeit any claim to the job unless it again becomes available.
(c) Where no one signs the bid, the Employer will assign the work to either a new Employee or to one of the part-time Employees most fitted for the job.
(d) With respect to hourly pay rates, the following applies. Up bidding can take place at any time. If an Employee bids up, laterally or down, and is placed in the new job, he/she cannot bid laterally or down for a six (6) month period. Within five (5) working days unless on the City job, if the Employee shall so elect, he/she shall be permitted to return to his/her former job, but will not be permitted to lateral or down bid for a six (6) month period. If within fifteen (15) working days on the job, the Employee is adjudged as having failed to perform satisfactorily, he/she shall be permitted to return to his/her former job and his/her replacement shall return to his/her former job. If an Employee is returned to his/her former job because he/she failed to perform satisfactorily, he/she will not be permitted to rebid into that department, from which he/she was disqualified, for a period of six (6) months.
(e) With respect to shift preference, the following applies: Notwithstanding the foregoing in Section 4(d), an Employee may bid to a preferred shift within his/her present department and job for which he/she is qualified and requires no additional training. When the Employee is awarded and accepts the new shift he/she, at the time this choice is made, waives his/her five (5) day trial period, and will not be permitted to return to his/her former shift. Shift preference bidding, as described in this section, will be allowed only once in any six (6) month period. Additionally, within the Production Department one (1) lateral bid may be made per shift within a six (6) month period. As is the case with a shift preference bid, when the employee is awarded and accepts the bid, he/she waives his/her five (5) day trial period, and will not be permitted to return to his/her former job.
(f) When an Employee accepts a job which has been posted, before his/her trial period begins, his/her name will be removed from all other active bid sheets. If more than one (1) Employee signs a bid sheet, when that bid sheet is removed from the bulletin board, it remains active until the job is filled. If the senior qualified Employee on a multi-signed bid refuses or is disqualified from the job, as outlined in Section 4(d), the 2nd senior qualified Employee will be given the opportunity to fill the open job. If the 2nd senior Employee refuses or is disqualified from the job, then the 3rd senior qualified Employee is given the opportunity to fill the job. This procedure is followed until the job opening is filled or until all names on the bid sheet have been exhausted, at which time the bid sheet becomes inactive.
(g) It is understood by both the Company and the Union agree differently. Employees that an Employee, who are interested must make written application. Every effort bids into and is awarded a job in the Production Department, will be made required to fill said accept training and become qualified in all Production Department jobs. It is also understood that the fifteen (15) day trial period outlined in Section 4(d) does not allow adequate time for an Employee to become fully qualified in all production jobs. If, after the fifteen (15) day trial period, the Employee is awarded the job, but does not actively and willingly accept training or, after receiving adequate training, does not become qualified in all Production Department jobs, his/her performance will be brought to the Union's attention before remedial action is taken by the Company. In any case, he/she will not be able to bump the Employee who filled his/her former job.
Section 5. An Employee who claims a job which has been posted need not be transferred by the Employer to the posted job if the transfer will affect the progress of an unusually important job or vacancy if there is an emergency which requires the Employee's retention on his/her present job. Nor shall he/she be transferred until a replacement has been secured for him/her. The Company will aggressively seek a replacement for any Employee who is waiting to be transferred. A person who successfully bids on a job must be moved within six (6) weeks or he/she should receive the basis rate of seniority from the bargaining unitpay (if higher), if applicant has the necessary qualifications and experience but still receives five (5) days to perform the duties.
10.2 The provision of this Article shall not apply to:
(a) Emergency positions.
(b) Student Internadjust, and other positions filled by students and/or trainees such as, Neighborhood Youth Corps, MDTA, Vocational Training and Cooperative Work Study Positions
(c) Positions not included within the bargaining unit.
(d) Positions accreted into the bargaining unit shall not require testing or posting.
10.3 In case of emergency, a City appointing authority may make an emergency appointment of any person to any position without regard to the provisions of this Agreement to carry on work that must be continued in the public interest, but no such emergency appointment shall continue for more than thirty (30) calendar days nor shall successive emergency appointments be made, and if a need exists for the position to continue beyond thirty (30) calendar days, the position shall be deemed vacant and posted in accordance with Section 1 of this Article. All such emergency appointments shall be reported to the Union within your time period starts after two (2) working days.
10.4 A vacancy will exist when there weeks for purposes of bidding rights. Awarded job bid is a budget appropriation for to be posted within seventy-two (72) hours of job being taken down. JOB POSTING AND BIDDING. 10.1 When Section 8.1 The parties agree that all appointments to positions covered by this Agreement with the exception of original hires shall be filled in accordance with this Article.
Section 8.2 These provisions shall apply when a new job is created or vacancy exists in the bargaining unit and the Employer intends to fill the vacancy. The Employer has the sole discretion to determine if a job becomes vacant, the City agrees to post vacancy shall be filled.

10.3 In case Section 8.4 The posting shall contain the opening and closing date for application, the classification, title, rate of emergencypay, job description, education requirements and desired qualifications.
Section 8.5 SMHA will make a City appointing authority may make reasonable effort to promote from within. If two or more applicants are equally qualified, internal applicants shall be preferred to outside applicants and more senior internal applicants to less senior internal applicants.
Section 8.6 The Agency shall notify all applicants of the selection as soon as practicable. Upon written request, the Employer shall provide an emergency appointment of any person to any position without regard to the provisions of this Agreement to carry on work that must be continued in the public interest, but no such emergency appointment shall continue for more than thirty (30) calendar days nor shall successive emergency appointments be made, and if a need exists employee who has not been chosen for the position the reason why the employee was not chosen.

(c) Positions not included within The employee bidding on the job with the most Plant Seniority shall be given preference provided he is potentially qualified and is physically capable of performing the work involved. When an employee is prevented from bidding for any reason for six (6) months, he shall be eligible to bid on a posted job prior to the Company filling the vacancy from outside the bargaining unit.
(d) Positions accreted into An employee who bids and accepts the bargaining unit job shall not require testing be permitted to bid again for a period of six (6) months from the date he signs the bid. It is understood that the successful bidder may request another home base within the classification within six (6) months from the date he signs the bid. An employee who bids on a job from which he is subsequently displaced prior to the expiration of the six (6) month period by reasons of reduction in force or postingmedical bump, may bid again.
10.3 In case of emergency(e) An employee who bids and accepts the job, a City appointing authority may make an emergency appointment of any person to any position without regard but withdraws his bid before being transferred to the provisions job on which he bid, shall not be permitted to bid again for a period of this Agreement to carry on work that must be continued in twelve (12) months from the public interest, but no such emergency appointment shall continue for more than thirty date of withdrawal.

If a position which has been held by a member of an employee fails to perform satisfactorily after having worked on the bargaining unit within the contract year is no longer held by such person and is not, within posted job for ten (10) calendar days, declared vacant days he shall be returned to his former job. The trial period may be extended by mutual agreement between the Company and the General Grievance Committee. It is understood that the employee may request and shall be returned to his former job during any trial period. An employee who requests to return to his former job within the trial period or who fails to perform satisfactorily and is returned to his former job by the CityCompany will not be permitted to bid for a period of six (6) months from the date he returns to the job from which he bid. An employee who bids and accepts a job classification which he held previously, but requests to return to his former job classification, will not be permitted to bid again for a period of twelve (12) months from the date he returns to the job classification from which he bid.
(g) In cases where it becomes apparent prior to the expiration of the ten (10) days trial period that the employee is not qualified the Company may return the employee to his former job prior to the expiration of the ten (10) days period. Such employee will not be permitted to bid for a period of six (6) months from the date he is returned to the job from which he bid.
(h) If an employee fails to qualify on the job which has been posted, or requests that he be returned to his former job, the City Company shall so notify not be required to post the Unionjob again, but may fill the job opening in the following order of preference provided 25 working days have not elapsed from the time the bidding period ended:
1. From the original bidders' list.
10.5 The City agrees to furnish a copy 2. From the sources outside of any job posting to the Union President for those jobs within the bargaining unit.
10.6 Employment (i) In the event the Company cannot fill a job vacancy with a qualified employee from within the bargaining unit, or a qualified individual from outside the bargaining unit, it may elect to fill such a vacancy with the most senior bidder although such employee may not be fully qualified to fill the posted job.
(j) In the event the Company elects to fill a vacancy in the manner set forth in (i), it will provide normal on-the-job training and promotional lists instruction to assist the employee to qualify for classified competitive positions the vacancy.
(k) An employee who cannot fully satisfy the requirements of the job vacancy will maintain his original labor grade but not less than three (3) grades below the posted job. (l) An employee who is accepted under the provisions of (i) through (k) and who fails to perform satisfactorily during any training and instruction period shall be made returned to his former job. It is understood that the employee may request and shall be returned to his former job during such period. An employee who requests to return to his former job during any training and instruction period or who fails to perform satisfactorily and is returned to his former job by the Company will not be permitted to bid into any job involving training for a period of twelve (12) months from the date he returns to the job from which he bid. Such period will be reduced to six (6) months for any job for which he qualifies.
(m) In cases where it becomes apparent prior to the completion of any training and instruction period that the employee cannot achieve the expected progress, the Company may return the employee to his former job prior to the completion of the training and instruction period. Such employee will not be permitted to bid into any job involving training for a period of twelve (12) months from the date he is returned to the job from which he bid. Such period will be reduced to six (6) months for any job for which he qualifies.
(n) Any employee who bids on a job and is transferred to such job will receive the necessary information required to perform the job.
(o) The Company will make available to the Union Presidentcopies of bid slips and disposition of bids.

JOB POSTING AND BIDDING. 10.1 When a new job is created or a job becomes vacantSection 1. In all cases of filling of regular full-time vacancies which --------- are required to be posted, the City agrees length of continuous service shall be the governing factor (seniority). However, the Employee must also have the ability and physical fitness to post notice perform the work and must have a good work record including attendance, tardiness, and job performance. Section 3. Section 4. Postings The following rules for bidding shall apply: ---------
(a) In the event of a transfer to the production department, the applicant must have a minimum duration of six (6) months seniority and a good work record, including attendance, tardiness, and performance.
(b) Anyone not making claim or refusing the job within seventy-two (72) hours after notice is posted shall forfeit any claim to the job unless it again becomes available.
(c) Where no one signs the bid, the Employer will assign the work to either a new Employee or to one of the part-time Employees most fitted for the job.
(d) With respect to hourly pay rates, the following applies. Up bidding can take place at any time. If an Employee bids up, laterally or down, and is placed in the new job, he/she cannot bid laterally or down for a six (6) month period. Within five (5) working days unless on the City job, if the Employee shall so elect, he/she shall be permitted to return to his/her former job, but will not be permitted to lateral or down bid for a six (6) month period. If within fifteen (15) working days on the job, the Employee is adjudged as having failed to perform satisfactorily, he/she shall be permitted to return to his/her former job and his/her replacement shall return to his/her former job. If an Employee is returned to his/her former job because he/she failed to perform satisfactorily, he/she will not be permitted to rebid into that department, from which he/she was disqualified, for a period of six (6) months.
(e) With respect to shift preference, the following applies. Notwithstanding the foregoing in Section 4(d), an Employee may bid to a preferred shift within his/her present department and job for which he/she is qualified and requires no additional training. When the Employee is awarded and accepts the new shift he/she, at the time this choice is made, waives his/her five (5) day trial period, and will not be permitted to return to his/her former shift. Shift preference bidding, as described in this section, will be allowed only once in any six (6) month period.
(f) When an Employee accepts a job which has been posted, before his/her trial period begins, his/her name will be removed from all other active bid sheets. If more than one Employee signs a bid sheet, when that bid sheet is removed from the bulletin board, it remains active until the job is filled. If the senior qualified Employee on a multi-signed bid refuses or is disqualified from the job, as outline in Section 4(d), the 2nd senior qualified Employee will be given the opportunity to fill the open job. If the 2nd senior Employee refuses or is disqualified from the job, then the 3rd senior qualified Employee is given the opportunity to fill the job. This procedure is followed until the job opening is filled or until all names on the bid sheet have been exhausted, at which time the bid sheet becomes inactive.
(g) It is understood by both the Company and the Union agree differently. Employees that an Employee, who are interested must make written application. Every effort bids into and is awarded a job in the production department, will be made required to fill said accept training and become qualified in all production department jobs. It is also understood that the fifteen (15) day trial period outlined in Section 4(d) does not allow adequate time for an Employee to become fully qualified in all production jobs. If, after the fifteen (15) day trial period, the Employee is awarded the job, but does not actively and willingly accept training or, after receiving adequate training, does not become qualified in all production department jobs, his/her performance will be brought to the Union's attention before remedial action is taken by the Company. In any case, he/she will not be able to bump the Employee who filled his/her former job.
Section 5. An Employee who claims a job which has been posted need not --------- be transferred by the Employer to the posted job if the transfer will affect the progress of an unusually important job or vacancy if there is an emergency which requires the Employee's retention on his/her present job. Nor shall he/she be transferred until a replacement has been secured for him/her. The Company will aggressively seek a replacement for any Employee who is waiting to be transferred. A person who successfully bids on a job must be moved within six (6) weeks or he/she should receive the basis rate of seniority from the bargaining unitpay (if higher), if applicant has the necessary qualifications and experience but still receives five (5) days to perform the duties.
10.2 The provision of this Article shall not apply to:
(a) Emergency positions.
(b) Student Internadjust, and other positions filled by students and/or trainees such as, Neighborhood Youth Corps, MDTA, Vocational Training and Cooperative Work Study Positions
(c) Positions not included within the bargaining unit.
(d) Positions accreted into the bargaining unit shall not require testing or posting.
10.3 In case of emergency, a City appointing authority may make an emergency appointment of any person to any position without regard to the provisions of this Agreement to carry on work that must be continued in the public interest, but no such emergency appointment shall continue for more than thirty (30) calendar days nor shall successive emergency appointments be made, and if a need exists for the position to continue beyond thirty (30) calendar days, the position shall be deemed vacant and posted in accordance with Section 1 of this Article. JOB POSTING AND BIDDING. 10.1 When a new job is created or Section 1- The Facility reserves the right to determine when and if a job becomes vacantvacancy exists, and whether the City agrees vacancy should be filled on a full-time or part-time basis.
Section 2- The Facility may temporarily assign an employee to a vacant position until that position is filled under the terms of this Article.
Section 3- When the Facility has determined that a job vacancy exists it will post notice the job opening for a period of the same on bulletin boards within fourteen seven (147) calendar days. Said notice shall be sent to all department heads and stewards at least one working day prior to the vacancy's posting date. If the employee is awarded a need exists for vacancy in a classification with a lesser Start Rate (Article 14) than the position to continue beyond thirty classification, which the employee holds, then that employee will receive a pay rate which is the average rate of the employees in the bid classification with the same seniority as the employee awarded the bid. When an employee is prevented from bidding for any reason for six (6) months, he shall be eligible to bid on a posted job prior to the Company filling the vacancy from outside the bargaining unit.
(d) Positions accreted into An employee who bids and accepts the bargaining unit job shall not require testing be permitted to bid again for a period of six (6) months from the date he signs the bid. An employee who bids on a job from which he is subsequently displaced prior to the expiration of the six (6) month period by reasons of reduction in force or postingmedical bump, may bid again.
10.3 In case of emergency(e) An employee who bids and accepts the job, a City appointing authority may make an emergency appointment of any person to any position without regard but withdraws his bid before being transferred to the provisions job on which he bid, shall not be permitted to bid again for a period of this Agreement to carry on work that must be continued in twelve (12) months from the public interest, but no such emergency appointment shall continue for more than thirty date of withdrawal.

An employee who requests to return to his former job within the trial period or who fails to perform satisfactorily and is returned to his former job by the CityCompany will not be permitted to bid for a period of six (6) months from the date he returns to the job from which he bid. An employee who bids and accepts a job classification which he held previously, but requests to return to his former job classification, will not be permitted to bid again for a period of twelve (12) months from the date he returns to the job classification from which he bid.
(g) In cases where it becomes apparent prior to the expiration of the ten (10) days trial period that the employee is not qualified the Company may return the employee to his former job prior to the expiration of the ten (10) days period. Such employee will not be permitted to bid for a period of six (6) months from the date he is returned to the job from which he bid.
(h) If an employee fails to qualify on the job which has been posted, or requests that he be returned to his former job, the City Company shall so notify not be required to post the Unionjob again, but may fill the job opening in the following order of preference provided 25 working days have not elapsed from the time the bidding period ended:
1. From the original bidders' list.
10.5 The City agrees to furnish a copy 2. From the sources outside of any job posting to the Union President for those jobs within the bargaining unit.
10.6 Employment (i) In the event the Company cannot fill a job vacancy with a qualified employee from within the bargaining unit, or a qualified individual from outside the bargaining unit, it may elect to fill such a vacancy with the most senior bidder although such employee may not be fully qualified to fill the posted job.
(j) In the event the Company elects to fill a vacancy in the manner set forth in (i), it will provide normal on-the-job training and promotional lists instruction to assist the employee to qualify for classified competitive positions the vacancy.
(k) An employee who cannot fully satisfy the requirements of the job vacancy will maintain his original labor grade but not less than three (3) grades below the posted job. Such employee will be advanced one (1) labor grade according to the following training schedule: Labor Grade Training Period for Advancement ----------- ------------------------------- 10 60 days worked 11 and 12 90 days worked 13 to 15 120 days worked
(l) An employee who is accepted under the provisions of (i) through (k) and who fails to perform satisfactorily during any training and instruction period shall be made returned to his former job. It is understood that the employee may request and shall be returned to his former job during such period. An employee who requests to return to his former job during any training and instruction period or who fails to perform satisfactorily and is returned to his former job by the Company will not be permitted to bid into any job involving training for a period of twelve (12) months from the date he returns to the job from which he bid. (m) In cases where it becomes apparent prior to the completion of any training and instruction period that the employee cannot achieve the expected progress, the Company may return the employee to his former job prior to the completion of the training and instruction period. Such employee will not be permitted to bid into any job involving training for a period of twelve (12) months from the date he is returned to the job from which he bid. Such period will be reduced to six (6) months for any job for which he qualifies.
(n) Any employee who bids on a job and is transferred to such job will receive the necessary information required to perform the job.
(o) The Company will make available to the Union Presidentcopies of bid slips and disposition of bids.
10.7 (p) The City shall have Company will refrain from posting jobs during the right to hire temporary employees for a period not to exceed 6 months. The City shall notify the Union scheduled vacation periods except in writing of all such hires of temporary employees at the time of hiring and every 60 days thereafter. JOB POSTING AND BIDDING. 10.1 When A. A job posting system is established which provides a new procedure whereby employees may bid on permanent job is created or a job becomes vacantopenings. For Operations, the City agrees posting will include an opportunity for current employees in that particular job classification to post notice exercise shift preference before filling the open position. Engineering employees bid job and shift. For engineering openings, the Company will contact employees in classification to solicit shift preference and if no one elects to fill the opening it will be posted for bid. Engineering employees will have up to twenty-four (24) hours to provide their shift preference response.
B. There will be a seven (7) day posting period for bid sheets to give an opportunity for all shifts to see the posting. It will be taken down as near as possible to the time of the same on bulletin boards within fourteen (14) calendar days. Said notice shall be sent to all department heads and stewards at least one working day it was originally posted but not prior to the vacancy's posting datefull 7-day period.
1. Postings The senior qualified bidder must accept assignment to the job bid upon, subject to paragraph D below.
2. There will be a selection process for the following positions: Process Flow Coordinator, Optimizer, Training Coordinator, Head Grader, Shipping Clerk, Shipping Clerk Handy, and Value Tech. These jobs will be awarded to the most qualified bidder possessing the necessary standards of qualifications and ability. This will be determined via a selection process including interviews and tests. In the event two or more applicants possess equal qualifications, the one with the most Company seniority will be given preference. Those assigned through this process, who are unable to maintain performance standards will be returned to the basic wage.
3. The forklift job classification will be reclassified into the respective work areas (Mill B outfeed, infeed finish, outfeed finish, and shipping).
4. The Company commits to make every effort to allow those employees who so desire, to maintain their qualification. Employees will be responsible to work directly with their team leader to ensure adequate notice is given to allow for these assignments prior to the lapse in qualifications. Operational needs and efficiencies will take precedence over making these assignments.
1. A successful bidder shall have a minimum duration 30-day trial period. If employee elects to return to his/her former classification, he/she shall not be allowed an additional bid. An employee returned to his/her former classification by the Company for reasons of disqualification or curtailment will be allowed an additional bid.
2. An employee may disqualify himself/herself at any time during this thirty (30) day trial period. Once an employee is on the job and deemed qualified by the Company using the on-the- job training process, the employee will have five (5) working days unless or the City and the Union agree differently. Employees who are interested must make written application. 3. E. Engineering employees will have a 30-day trial period for the position to exist each shift he/she bids, and has requisitioned that the position be filled. If a position which has been held by a member each bid will count as one of the bargaining unit 3 bids per year.
1. Employees off work due to an industrial or non-industrial injury or extended illness, may bid and apply their seniority on current job postings. Such bids must be received during the posting period. Employees returning from injury or illness must have a full medical release and be able to return within fifteen (15) calendar days from when the job posting period closes. Employees are responsible to work through Union Stewards to identify any current job bidding opportunities. In the case of multiple job postings, employees in such “off-work” situations will be allowed to apply their seniority to only one specific job bidding opportunity.
2. The Company will attempt to provide appropriate light duty work, (if such work is available), as approved by licensed physicians, for any employee who is injured on or off the job. Industrial injuries will have first priority.
3. These jobs will be assigned to injured employees for short-term recuperation prior to returning to their regular classification.

JOB POSTING AND BIDDING. 10.1 When SECTION 14.1 A Pilot may bid when a new job or permanent vacancy occurs, or when a new job or crew position is created or created. JOB POSTING AND BIDDING. 10.1 A) When a new job is created or a job position covered by this agreement becomes vacant, such a vacancy shall first be posted, in a conspicuous place, within the departments where bargaining unit employees work, listing the pay, duties and qualifications of the vacant position. The vacancy shall remain open and posted for (7) days. All Members who apply, shall apply in writing within the seven (7) days of the posting. In any grievance proceedings involving this paragraph, the burden of seniority proof shall be on the Union to show that the member applicant not appointed possesses the qualifications to perform this job.
C.1) A newly hired member will be paid at Step 1 of the salary schedule, unless agreed upon between the City and the Union.
D) For the purposes of this Article, the qualifications to be considered for appointment; promotions shall include knowledge, education, skills, current performance, attendance, demonstrated willingness to handle increased or varied responsibilities, and seniority. For all Civil Service promotions, the City shall abide by Massachusetts General Laws Chapter 31.
E) In the absence of management staff (department head, assistant director or general xxxxxxx) for more than two (2) days, management staff and/or the Mayor may assign such duties to other management staff or assign a replacement from within the bargaining unit to assume the duties and responsibilities of the position. If a replacement comes from within the bargaining unit, if applicant has the necessary qualifications replacement shall be the most senior, qualified employee in the highest level position in the department, excluding management (department head, assistant department head, and experience general xxxxxxx). (c) Positions not included within the bargaining unitunit for a minimum of four (4) consecutive hours, members shall be paid commensurate with the work they are performing. The absence of a higher grade employee does not mean or require a lower grade employee will assume the higher grade title or responsibilities. No employee will be paid at the higher pay rate unless such assignment to the higher grade is approved by the department head or his/her designee. In accordance with this agreement, once approved, the department head shall offer the upgrade to the most senior, qualified unit member holding the highest level position which is lower than the position being filled.

10.6 Employment and promotional lists for classified competitive positions position shall be made available to re-posted in the Union President.
10.7 The City shall have the right to hire temporary employees revised form for a period of five (5) calendar days. A reduction in minimum qualifications for this purpose shall not be considered a permanent change and shall not affect the pay scale as related to the position.
b. When the vacancy is posted, the posting will note the classification, duties, pay grade, starting date/time, minimum qualifications, whether tests must be taken by the bidder, and the proposed schedule for such tests. The number and type of test(s) shall appear on the job posting, and shall be the only tests an employee must take to satisfy the job posting.
c. All vacancies within a department will be filled by awarding the posted position to the depart- mental employee who bids, meets the minimum qualifications, and ranks highest in the competitive selection process. In the event no qualified employee within the department bids for a vacant position, it shall be filled by awarding the position to the unit employee who bids, meets the minimum qualifications, and ranks highest in the competitive selection process.
d. The Employer's objective in conducting its testing program is to assure an open selection process free from discrimination in accordance with EEOC guidelines. The Employer assures the Union that continuing efforts will be made to acquire the best independently provided objective tests and/or examinations available so that tests/examinations directly relate to the skills, abilities, and qualifications required for the position. Weighing of the competitive selection factors shall be as follows: Written Exam 300 points Seniority 100 points Oral Exam 200 points For purposes of scoring the competitive selection factor of seniority, each employee shall be credited with 20 points for each year of seniority.
e. During any posting period in which employees are being considered for a transfer/promotion, the Employer may fill a regular job opening on a temporary basis. A vacancy may be filled by a temporary employee only after the position has been posted.
f. At the time a bid is received by the Human Resources Department, it will be dated and a copy returned to the employee. Only bids providing all requested information and received by the Human Resources Department within the posting period will be considered by the Employer prior to making a transfer/promotion. Once a regular job opening is posted, other methods of filling a regular job opening shall not be used until all bidders are considered and a decision made and communicated to all bidders and the Local President. The Local President may have access to test scores upon request.
g. An employee who does not provide all requested information or deliberately falsifies information in his bid may be disqualified.
h. Any bidder must be at work or otherwise available following the closing date of the bid and during the period when bidders are being considered. If a bidder is not at work or otherwise available to be considered, the bidder may be disqualified; in proper cases, exceptions will be made at the discretion of the Employer.
i. An employee who is promoted to another classification or transferred will be given a reasonable trial period, but not to exceed 6 months. The City shall notify the Union in writing of all such hires of temporary employees at the time of hiring and every 60 ninety (90) days thereafter. This provision shall not apply to positions where persons hold or claim to hold such positions or have been layoffs.
10.8 If the City fills temporary promotional vacancies, then the City shall make every effort to fill temporary promotional vacancies of a duration of 3 days or more first from the certified promotional list and secondly on start date in the basis of seniority. The person filling such position must be qualified new position, to demonstrate in actual performance whether he has the ability to perform the work. This section If he does not have the ability to perform the work, he shall be returned to the position from which he was transferred/promoted and given a written notice of reason. A copy of this notice will be sent to the employee's local president.
j. If the employee requests within a one (1) month period (from the start date in a new position)following a transfer/promotion from another classification, he shall be returned to his original position from which he was promoted or transferred; but, in any event, he shall be returned within the one (1) month period following his request.
k. In the event that an employee is returned to the classification from which he was transferred/promoted, the Employer shall consider the other bidders prior to posting.
l. An employee shall not be eligible to successfully bid for transfer or promotion more than twice in one year.
m. An employee who has bid for a transfer/promotion in accordance with the provisions of this article and who has more seniority than the employee selected for transfer/promotion will be notified in writing of the reason(s) for the selection decision, and will be provided the name and seniority date of the employee transfer/promoted. A copy of this notification will be sent to the Local President.
n. Should a regular job opening within a department fail to receive any bids for a minimum of three (3) different but consecutive posting periods, the Employer may discontinue posting for one (1) year such regular job openings which subsequently occur in that classification within that department. Thereafter the Employer will again post any such regular job openings, and the provisions of this paragraph shall be repeated.
o. In the event a probationary employee is displaced by another employee being returned to their position under the provisions of (i) or (j) above, that employee shall maintain bidding rights only for a period of one year. An employee securing a job under this provision shall be subject to 10.3 and 27a full, new-hire probationary period as outlined in Article 16 Section (a) of this Agreement.
p. In the event a non-probationary employee is displaced by another employee being returned to their position under the provisions of (i) or (j) above, that employee shall be returned to the position from which they were transferred or promoted. All employees affected in a similar manner, shall be returned to the position from which they were transferred or promoted.
q. Criminal history background checks may be required for new and/or existing employees per county policy.

10.2 The provision of this Article shall not apply to:

10.3 In case of emergency, a City appointing authority may make an emergency appointment of any person to any position without regard to the provisions of this Agreement to carry on work that must be continued in the public interest, but no such emergency appointment shall continue for more than thirty (30) calendar days nor shall successive emergency appointments be made, and if a need exists for the position to continue beyond thirty (30) calendar days, the position shall be deemed vacant and posted in accordance with Section 1 of this Article. All such emergency appointments shall be reported to the Union within two (2) working days.
10.4 A vacancy will exist when there is a budget appropriation for the position, when no person holds or claims to hold the position, and when the appointing authority has established sufficient need and reason for the position to exist and has requisitioned that the position be filled. If a position which has been held by a member of the bargaining unit within the contract year is no longer held by such person and is not, within ten (10) calendar days, declared vacant by the City, the City shall so notify the Union.
10.5 The City agrees to furnish a copy of any job posting to the Union President for those jobs within the bargaining unit.

9.3 Posted jobs shall successive emergency appointments be madeawarded as outlined in Articles 8 and 9. However, and if a need exists for the position job cannot be filled internally as provided by paragraph 9.2, then the Employer shall have the right to continue beyond thirty (30) calendar daysfill the job from any available source; provided, however, any person filling the job must meet the same qualifications used to judge employees.
9.4 Whenever possible, the position shall successful bidder will be deemed vacant awarded the job and posted in accordance with Section 1 of this Article. All such emergency appointments shall unsuccessful bidders will be reported to the Union within two (2) working days.
10.4 A vacancy will exist when there is a budget appropriation for the position, when no person holds or claims to hold the position, and when the appointing authority has established sufficient need and reason for the position to exist and has requisitioned that the position be filled. 10.5 9.5 The City agrees Employer shall prepare a form to furnish be used by employees for the purpose of bidding on posted jobs. Employees covered by this Agreement who wish to bid on a copy of any posted job posting listing must apply in writing to the department supervisor during the seven (7) day posting period set forth in paragraph 9.2 above. Employees that fail to apply during the seven (7) day posting period set forth in paragraph 9.2 shall not receive preferential or priority status over qualified outside candidates. Any employee who is on annual leave or who is on military active duty for training during the posting period, and who has sufficient seniority will be considered to have submitted a bid for the posted job, and may file a protest in writing within five (5) days after his originally scheduled return from annual leave or military active duty for training.
9.6 The Union President for those shall be notified of all jobs awarded which are within the bargaining unit.
