Level of Participation. Set forth as Exhibit B hereto is a list of Products currently being sold by Labatt to the Stripes stores and the monthly volume, by Product, of such purchases. Such list may be modified from time to time by mutual agreement of the parties. The term “Products” herein means the Products shown on Exhibit B, including any successors to such Products and any other Products as may be agreed upon from time to time. The pricing from Labatt provided for herein is based on Stripes continuing to purchase at least [***]% of such [***] volumes (in the aggregate) of the Products for all Stripes stores that provide food service and to which Labatt is capable of (and does not object to) delivering. Stripes’ failure to purchase at least [***] of such [***] volumes (in the aggregate) of the Products, during any period of [***] or more [***] during the term of this Agreement, shall constitute a default by Stripes of this Agreement.
Level of Participation. The Spectrum of Engagement identifies the differing levels of participation. Consider the goals, timeframes, resources and levels of concern in the decision (s) to be made. Once engagement goals are established, the positioning on the Spectrum and necessary approaches will become apparent.

If in favor of an investment in such Security, provide the Investment Committee with a non-binding estimate of the amount such Partner would be willing to contribute with respect to such Security, not to exceed the maximum participation for such Partner provided in the Notice of Suitability.

Notwithstanding the foregoing, if any such purchase or subscription would cause the “Constructive Ownership” or “Beneficial Ownership” of Capital Stock of any “Person” (as such terms are defined in the Charter) to be in violation of the Ownership Limits (except that, for these purposes, the Common Stock Ownership Limit shall be increased to the extent set forth in, and subject to the terms and conditions of, the Ownership Limit Waiver (if and to the extent then in effect)), then the Investors shall be entitled to purchase or subscribe for shares of Common Stock or Common Stock Equivalents under this Section 2.3 up to, but not exceeding, the limitations set forth in this Section 2.3(d) and in Section 2.3(g).
Level of Participation. In order to provide effective administration for employment of personnel and budget matters, each Member District shall present to the System an annual needs/budget report on or before April 1. This report is to advise the System of the Member District’s level of participation within each shared program for the following year.
