Limit on compensation. The Department’s liability to pay any compensation under or in relation to this clause 60 is subject to the Provider’s: strict compliance with this clause 60; and
Limit on compensation. 8.2.1. Any Service Credits due to the Client shall be the Client’s sole and exclusive remedy with respect to such failures and shall be in lieu of any other remedy which the Client may have at law.
8.2.2. The maximum compensation for Unavailable Time the Client can receive in any month is an amount equal to 100% of the Rental due in respect of that Service for the month in which the failure(s) occur and the maximum compensation in aggregate the Client can receive is an amount equal to 25% of the annual rental for the period covered by a 12 months cycle, the first such cycle starting on the Go Live Date.
Limit on compensation. Failure or delay on the part of any Lender or any Issuing Bank to demand compensation pursuant to this Section shall not constitute a waiver of such Lender’s or such Issuing Bank’s right to demand such compensation; provided that the Borrower shall not be required to compensate a Lender or an Issuing Bank pursuant to this Section for any increased costs or reductions incurred more than 60 days prior to the date that such Lender or such Issuing Bank, as the case may be, notifies the Borrower of the Change in Law giving rise to such increased costs or reductions and of such Lender’s or such Issuing Bank’s intention to claim compensation therefor; provided further that, if the Change in Law giving rise to such increased costs or reductions is retroactive, then the 60–day period referred to above shall be extended to include the period of retroactive effect thereof. If, following any demand by any Lender or any Issuing Bank under this Section, the item for which such demand was made is changed to reduce or eliminate the effect on the applicable Lender or Issuing Bank, such Lender or Issuing Bank shall promptly so inform the Borrower and equitable reduce any amounts thereafter payable by the Borrower under this Section.
Limit on compensation. 5.1 The maximum compensation that a Communications Provider can receive for late provision is an amount equal to 60 multiplied by the relevant individual DFX Service monthly rental and the maximum compensation that a Communications Provider can receive for late repair is an amount equal to 200 multiplied by 15% of the relevant individual DFX Service monthly rental.
Limit on compensation. The Department’s liability to pay any compensation under or in relation to this clause 309 is subject to the Provider’s: strict compliance with this clause 309; and substantiation of any amounts claimed under clause 312. The Department will not be liable: to pay compensation for loss of prospective profits attributable to a termination or reduction in scope under this clause 309; for loss of any benefits that would have been conferred on the Provider had a termination or a reduction in scope made under this clause 309 not occurred; or for any amounts that would, in aggregate, exceed the maximum Fees, Funds, Reimbursements, Wage Subsidies or Ancillary Payments that would have been payable by the Department under this Agreement in respect of the relevant Services, but for a termination or a reduction in scope made under this clause 309. In addition, in relation to a reduction in scope under this clause 309, the Department will not be liable to pay the Provider, and the Provider agrees that its reasonable costs do not include: any amounts owed by the Provider under any contract of employment or to any of its Subcontractors; and payment of any liabilities arising from commitments the Provider has made in relation to the conduct of the Services beyond the end of the Financial Year in which the reduction in scope takes place. If the Department terminates, or reduces the scope of, this Agreement under this clause 309: the Department’s actions will not constitute a breach of this Agreement; and the Parties agree that the amounts payable to the Provider under this clause 309 represent a reasonable pre-estimate of any loss that may be incurred by the Provider.

Limit on compensation. The annual Compensation of a Participant taken into account under the Plan for any Plan Year shall be limited to $150,000 (or such other annual compensation limit as may be specified in legislation subsequent to Public Law 103-66 (OBRA `93) which established the $150,000 limit), plus cost of living adjustments permitted under applicable law.
Limit on compensation. Subject to Articles 2.5.7(g), 2.5.10 and 2.5.13 of the Agreement, in no event shall the aggregate compensation payable pursuant to Article 1.1 of Schedule 2.2 exceed the sum of one million ($1,000,000.00) dollars in any calendar year, subject to the adjustment for CPI as set out below.

9.3.3 The maximum compensation for Unavailable Time the Client can receive in any month is an amount equal to 100% of the Rental due in respect of that Service for the month in which the failure(s) occur and the maximum compensation in aggregate the Client can receive is an amount equal to 35% of the annual rental for the period covered by a 12 month cycle, the first such cycle starting on the Go Live Date.
Limit on compensation. Pay Inmold, Inc. or pay or award salary, bonus, dividends, or compensation of any kind to any officer of the Borrower, in any one fiscal quarter, in an aggregate amount in excess of five percent (5%) of the Borrower's gross revenues for that quarter.
