Limitation of Warranty Scope. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON THE MODULE(S) IS LIMITED IN DURATION OF THIS LIMITED WARRANTY. UNDER NO CIRCUMSTANCES SHALL LG BE LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, LOST GOODWILL, LOST REVENUES OR PROFITS, WORK STOPPAGE, MODULE(S) FAILURE, IMPAIRMENT OF OTHER GOODS, COSTS OF REMOVAL AND REINSTALLATION OF THE MODULE(S), LOSS OF USE, INJURY TO PERSONS OR PROPERTY ARISING OUT OR RELATED TO THE MODULE(S). LG’S TOTAL LIABILITY, IF ANY, DAMAGES OR OTHERWISE, SHALL NOT EXCEED THE INVOICE VALUE PAID BY THE CUSTOMER FOR THE MODULE(S) OR SERVICE(S) FURNISHED, WHICH IS THE SUBJECT OF A CLAIM OR DISPUTE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS LIMITED WARRANTY GIVES THE CUSTOMER SPECIFIC LEGAL RIGHTS; CUSTOMERS MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE.

Phono Solar shall have no responsibility or liability whatsoever for damage or injury to persons or property, or for other loss or injury resulting from any cause whatsoever arising out of or related to the Product(s), including, without limitation, any defects in the Product(s), or from use or installation. Under no circumstances shall Phono Solar be liable for any special punitive, incidental, or consequential damages, howsoever caused, including but not limited to loss of use, loss of profits, loss of production, or loss of revenues, arising, directly or indirectly from the sale or use of any Product(s), whether such claim is based on warranty, contract, negligence, strict liability or otherwise, Phono Solar´ s aggregate liability, if any, in damages or otherwise, shall not exceed the invoice value as paid by the Customer, for the single unit of Product(s) involved. The rights and limitations herein shall leave unaffected any legal rights existing under mandatory applicable laws.

Under no circumstances shall Sunrise be liable for incidental, consequential or special damages, howsoever caused. Loss of use, loss of profits, loss of production, and loss of revenues are specifically and without limitation excluded. Sunrise’s aggregate liability, if any, in damages or otherwise, shall not exceed the invoice value as paid by the CUSTOMER, for the single unit of MODULE.
Limitation of Warranty Scope. To qualify for warranty coverage, UPSOLAR must be notified by the CUSTOMER of any defective MODULES within 10 days after the CUSTOMER learns of such defect. Such notice shall provide UPSOLAR with available information on the nature of the defect and shall state the date code and/or serial number of the MODULE and other relevant facts known to CUSTOMER, all as a condition to UPSOLAR’s obligation under the LIMITED WARRANTIES. The LIMITED WARRANTIES apply to MODULES sold by UPSOLAR globally. There are, however, market- specific limitations to MODULE sales within a specific market (TERRITORY) which are installed by the CUSTOMER in the same TERRITORY, and UPSOLAR shall have no obligations under the LIMITED WARRANTIES or otherwise with respect to any MODULES sold or installed outside the TERRITORY in which the MODULES were originally sold. UPSOLAR reserves the right to demand the return of any MODULE claimed to be defective in order to evaluate the cause of the defect as a further condition to UPSOLAR’s warranty liability. UPSOLAR shall not be liable under the “Limited Warranty for PV Modules” for any defective MODULE as to which the alleged defect arises out of UPSOLAR’s compliance with any request, instruction, design change, drawing or specification furnished or imposed by CUSTOMER or any other person or company, or as to which the serial number or date code has been removed, altered, obliterated, defaced or rendered illegible. UPSOLAR shall not be liable for any damage to MODULES occurring in shipping or in storage, or for any damage caused by abuse, mishandling, improper installation (e.g., an installation that does not comply with the installation guidelines for the MODULES provided by UPSOLAR and/or that is not installed by a qualified professional licensed solar installer), misuse, unauthorized repair or modification, or failure of any system in which the MODULES are installed or integrated, or with which they are used. UPSOLAR shall have no responsibility or liability whatsoever, whether under the LIMITED WARRANTIES or otherwise, for damage or injury to persons or property, or for other loss or injury resulting from any cause whatsoever arising out of or related to the MODULES, including, without limitation, any defects in the MODULES, or from use or installation. UPSOLAR’s aggregate liability, if any, in damages or otherwise, shall not exceed the invoice price paid by the CUSTOMER, for the single unit of MODULE.
Limitation of Warranty Scope. FURTHER CLAIMS ARE EXCLUDED, IN PARTICULAR CLAIMS FOR DAMAGES, WHICH DO NOT OCCURRE TO THE BOS EQUIPMENT ITSELF. THIS SHALL NOT APPLY IN INSTANCES OF INTENT AND GROSS NEGLIGENCE OR CULPABLE VIOLATION OF IMPORTANT CONTRACTUAL OBLIGATIONS. IN THE EVENT OF CULPABLE VIOLATION OF IMPORTANT CONTRACTUAL OBLIGATIONS, SUNPOWER SHALL SOLELY ASSUME LIABILITY FOR DAMAGES THAT ARE TYPICAL FOR THE CONTRACT AND COULD HAVE REASONABLY BEEN FORESEEN – EXCEPT IN INSTANCES OF INTENT OR GROSS NEGLICENCE. THE EXCLUSION OF LIABILTY SHALL NOT APPLY TO GUARANTUEES WITH RESPECT TO QUALITY, PROVIDED THAT IT WAS SPECIFICALLY INTENDED TO SAFEGUARD CITY SOLAR AGAINST DAMAGES. MOREOVER, THE EXCLUSION OF LIABILTY SHALL NOT APPLY IN INSTANCES WHERE LIABILTY IS ASSUMED, UNDER PRODUCT LIABILTY LAW, FOR PERSONAL INJURY OR PROPERTY DAMAGE AT OR ON PRIVATELY UTILIZED OBJECTS, FOR DEFECTS IN THE DELIVERED BOS EQUIPMENT. SUNPOWER IS NOT LIABLE FOR DAMAGES THAT ARISE OUTSIDE ITS SCOPE OF PERFORMANCE, ARE INFLUENCED BY IMPROPER UTILIZATION OR TREATMENT, ERRONEOUS INSTELLATION AND OPERATION BY CITY SOLAR OR ANY THIRD PARTIES, NATURAL WEAR AND TEAR AND INAPPROPRIATE OPERATING MATERIALS OR REPLACEMENT MATERIALS. AN IMPROPER USE IS ASSUMED IF THE BOS EQUIPMENT IS NOT BEING USED IN ACCORDANCE WITH THE CONDITIONS OF OPERATIONS STATED IN SUNPOWER´S DATASHEETS AND BROCHURES.

Under no circumstances shall Boviet be liable for incidental, consequential or special damages, however caused. Loss of use, loss of profits, loss of production, loss of revenues are therefore specifically but without limitation excluded. Boviet's aggregate liability, if any, in damages or otherwise, shall not exceed the invoice value as paid by the customer, for the unit of product or service furnished or to be furnished, as the case may be, which is the subject of claim of dispute.
Limitation of Warranty Scope. These warranties of Schüco products are the only expressed warranties provided by Schüco. No employee, representative, agent, nor any other person, has authority to assume or incur on behalf of Schüco any obligation, liability, or responsibility in place of or in addition to these warranties. Furthermore, claims seeking the reimbursement of costs such as, for example, accrued transport costs, costs of any required performance testing, costs for dismantling and/or assembly, on-site inspection, other indirect costs associated with the making of a warranty claim are expressly excluded.

Loss of use, loss of profits, loss of production, and loss of revenues are specifically and without limitation excluded. Perlight Solar´s aggregate liability, if any, in damages or otherwise, shall not exceed the invoice value as paid by the CUSTOMER, for the single unit of MODULE.

Under no circumstances shall Aptos be liable for indirect, incidental, consequential or special damages, unless said damages arise directly from sole the acts, omissions or gross negligence of Aptos. Loss of use, loss of profits, loss of production, and loss of revenues are specifically and without limitation excluded. In no event shall Aptos’ aggregate liability arising out of or related to the sale of the Modules, whether arising out of or related to breach of contract, tort (including negligence) or otherwise (including but not limited to all costs, expenses, and fees) exceed the total of the amounts paid to Aptos for the Modules sold hereunder. Aptos shall have the right to provide a different type or model of the Modules if Aptos is unable to replace the same type or model of the Modules.
