Common use of Living Away From Home Allowance Clause in Contracts

Living Away From Home Allowance. 27.1 For the purpose of this Clause, a “distant project ” is one where the location of the “on-site project work” is such that because of its distance or because of the travelling facilities available to and from the location, it is reasonably necessary for an employee to live and sleep at some place other than his/her usual place of residence. 27.2 It is not compulsory for employees to work at a distant project. 27.3 Where an employee is sent other than at his or her own request to work at a “distant project” as defined in sub-clause (27.1), the Company may elect to: (a) Provide the employee with an agreed reasonable board and lodging in a well kept establishment with three adequate meals each day; or (b) Pay the employee an Allowance of $560.00 per week of seven days but such allowance shall not be wages. In the case of broken parts of the week occurring, the Allowance will be $80.00 per day. Provided that this allowance will be increased if the employee satisfies the Company that he reasonably incurred a greater outlay than that prescribed. The increased rates will be effective from 1 July 2003. Provided that where an employee is requested to work at a distant project where reasonable board and lodging is not available or where the size of the workforce is in excess of the available accommodation, agreed, alternative arrangements will be made. With the consent of the Company and not withstanding the above, the parties may enter into other arrangements by agreement which are superior than those contained in this Agreement prior to the commencement of the project. However, agreed pre- existing Company arrangements where superior to those contained in this Agreement will still apply.
