Local Disasters. In the event of a local disaster or catastrophe as declared by a governmental agency such as earthquake, fire, flood, explosion, widespread power failure or other acts of God outside the Employer’s control that reasonably require all available employees to report for work or remain on duty, the provisions of this Agreement pertaining to scheduled paid time off, lunch and rest periods, job postings, shift changes, and transfers shall be suspended and the Employer shall be relieved of any obligation to adhere to those provisions during emergency operations. However, the Employer shall honor all prescheduled time off for employees who purchased non-refundable tickets or have made other non-recoverable economic commitments for use during their prescheduled time off. If the employee cannot be allowed the prescheduled time off, the Employer shall reimburse the employee for the cost of any unused non-refundable tickets and other non- recoverable economic impacts. Bargaining unit employees who are on duty when a disaster or catastrophe occurs shall be afforded every reasonable opportunity to ensure the welfare of their families.

Local Disasters. Local disaster” as used in the context of this section applies to disasters within the AMR Oregon and XX Xxxxxxxxxx standard operating areas. In the event of a local disaster, the Employer shall be relieved of all obligations hereunder relating to scheduled paid time off, lunch and rest periods, job postings, shift changes and transfers in the event of and during the term of a disaster or catastrophe, such as fire, flood, earthquake, hurricane and other acts of God outside the Employer’s control that disrupt the Employer’s normal operations. In the event that an employee is on shift when a disaster occurs, or the Employer designates a disaster situation, the Employer shall make every reasonable effort to allow the employee sufficient time to ensure the welfare of the employee’s family. No employee shall suffer a financial hardship when pre-approved PTO is canceled by the Employer as a result of a Local Disaster. The employer agrees to reimburse an employee for fees associated with the cancellation of pre-paid arrangements, provided the employee can show verification and documentation that the employee did incur a non-recoverable loss when the employee did diligently attempt to recover or delay plans at no loss to the employee. Any PTO that the employee would have used will be credited back to the employee’s PTO bank. Claims relating to the cancellation of an employee’s vacation shall be made as soon as possible, but no later than thirty (30) days following the cancellation. In order to be eligible for reimbursement under this provision, the employee must be able to show verification and documentation that the PTO was planned and pre-paid prior to the declaration of the Local Disaster. Except as provided by the first two (2) paragraphs above, bargaining unit employees shall be covered by the terms and conditions of the collective bargaining agreement.

However, the Employer shall honor all prescheduled time off for employees who purchased non-refundable tickets or have made other non- recoverable economic commitments for use during their pre-scheduled time off or Employer shall reimburse the employee for the cost of any unused non-refundable tickets and other non-recoverable economic impacts provided that such none use is a result of and at the direction of Employer and not voluntary. Employees who are on duty when a disaster or catastrophe occurs shall be afforded every reasonable opportunity to ensure the welfare of their families.

  • Catastrophic Leave - Natural Disaster Upon request of an employee and upon approval of a department director or designee, leave credits (CTO, vacation, personal leave, annual leave, personal day, and/or holiday credit) shall be transferred from one or more employees to another employee, in accordance with departmental policies, under the following conditions:

  • NATURAL DISASTER LEAVE 30.1 Where a permanent employee is unable to attend work because of a natural disaster, ie bushfire or flood, they will be entitled to be paid ordinary pay for the shift they would otherwise have worked on that day. This entitlement will apply once per calendar year and is not cumulative from year to year.

  • Disaster Services In the event of a local, state, or federal emergency, including natural, man- made, criminal, terrorist, and/or bioterrorism events, declared as a state disaster by the Governor, or a federal disaster by the appropriate federal official, Grantee may be called upon to assist the System Agency in providing the following services:

  • Disaster Leave ‌ When there has been a natural disaster of a magnitude that requires the Board of Supervisors to Proclaim a County State of Emergency, the County will enact this disaster leave provision. During the proclaimed emergency period and for up to one year from the termination of the said proclamation, County employees may donate accrued compensatory time and vacation leave to other County employees who have lost work time because they have been a victim of a disaster affecting their primary residence. For up to one year from the termination of said proclamation, impacted employees may use up to 320 hours of donated leave. Such donated time will not exceed the total amount of time lost by the receiving employee including vacation, compensatory time used and any unpaid leave incurred. Unused donated time at the expiration of the leave provision period will be returned to the donor.

  • CONDITIONS FOR EMERGENCY/HURRICANE OR DISASTER - TERM CONTRACTS It is hereby made a part of this Invitation for Bids that before, during and after a public emergency, disaster, hurricane, flood, or other acts of God that Orange County shall require a “first priority” basis for goods and services. It is vital and imperative that the majority of citizens are protected from any emergency situation which threatens public health and safety, as determined by the County. Contractor agrees to rent/sell/lease all goods and services to the County or other governmental entities as opposed to a private citizen, on a first priority basis. The County expects to pay contractual prices for all goods or services required during an emergency situation. Contractor shall furnish a twenty-four (24) hour phone number in the event of such an emergency.

  • Catastrophic Sick Leave Bank [a] The District will establish and manage a catastrophic sick leave bank from which eligible educators may draw leave under the conditions and restrictions outlined below. Teachers who wish to participate in the catastrophic sick leave bank program shall be required to contribute one (1) day of their available sick leave to the bank. This contribution must be made each year during the insurance open enrollment period, as designated by the District, by completing and submitting the appropriate form to the Human Resources Department. If the bank has a substantial balance of days remaining at the end of the academic year, the Association and District may agree to suspend the contribution requirement for one year. Any educator who did not previously participate in the bank but who desires to participate during the non- contribution year will be required to donate one (1) day to initiate eligibility by submitting the appropriate form to the Human Resources Department during the insurance open enrollment period, as designated by the District. [b] Only educators who have contributed to the bank and who have depleted their sick leave and personal leave balances shall be eligible to receive consideration for sick leave from the bank. [c] All requests for sick leave from the bank must be in writing and must be addressed to the Human Resources Director. Requests may be submitted and approved any time after the required sick leave has been contributed. The requests must include the reasons for the request, written verification from the attending physician indicating the nature and severity of the illness or health problem along with the projected recovery date, and the number of sick leave days requested. [d] Only severe, extended illness and catastrophic medical problems of an employee or immediate family member will be considered for leave withdrawals from the bank. Illness or medical problems of a short-term nature shall not be considered. Life-threatening illness or severe accidents requiring extended recovery periods will be given first priority. [e] Withdrawals from the bank for illness of the participating employee shall not exceed one hundred (100) leave days per employee during any four (4) year period. [f] Withdrawals from the bank for illness of an immediate family member shall not exceed twenty (20) days during any consecutive four (4) year period. For requests under this policy, immediate family members shall include husband, wife, son, daughter, father, mother, brother, sister, grandmother, and grandfather. In addition, exceptions may be considered by the Superintendent for other relatives or those who have virtually held the position of an immediate member of the family. [g] In all sick leave bank withdrawal requests, whether for the participating employee or for an immediate family member, the District reserves the right to approve requests, deny requests, or to approve only a portion of the leave days requested.

  • Safety, breakdowns and accidents 17.5.1 The Concessionaire shall ensure safe conditions for the Users and passengers, and in the event of unsafe conditions, it shall follow the relevant operating procedures and undertake removal of obstruction and debris without delay. Such procedures shall conform to the provisions of this Agreement, Applicable Laws, Applicable Permits and Good Industry Practice.

  • Catastrophic Leave Program Leave credits, as defined below, may be transferred from one or more employees to another employee, on an hour-for-hour basis, in accordance with departmental policies upon the request of both the receiving employee and the transferring employee and upon approval of the employee's appointing authority, under the following conditions:

  • Industrial Accident and Illness Leave shall be granted for illness or injury incurred within the course and scope of an employee's assigned duties. The employee who has sustained a job-related injury shall report the injury on an Office approved accident form to the immediate supervisor within twenty-four (24) hours. An employee shall report any illness, in writing, to the immediate supervisor within twenty-four (24) hours of knowledge that the illness is an alleged industrial illness. Requirements for such leave shall be:
