LOCATION AND USE OF EQUIPMENT. CUSTOMER undertakes and agrees not to move the leased equipment from the position of delivery and installation, in the case of stationary equipment. In the case of mobile equipment, CUSTOMER agrees to keep the leased equipment garaged or maintained at CUSTOMER’s specific address when not in mobile use, and to obtain the written consent of COMPANY if such equipment is to be located elsewhere on a regular basis. CUSTOMER is to use COMPANY owned equipment for the storage of COMPANY’s liquefied petroleum gas only.
LOCATION AND USE OF EQUIPMENT. 7.1 The Lessee shall cause the Equipment to be maintained and operated carefully in compliance with manufacturer’s recommendations and applicable laws and legislation, by competent and duly qualified personnel only, and for business purposes only. The Lessee shall not alter or modify the Equipment without the prior written consent of the Lessor.
7.2 The Lessee shall use the Equipment at its own risk and hereby agrees to indemnify and save the Lessor harmless from and against any and all liability, loss, damage, expense, cause of action, suits, claims or judgments arising from injury to persons or property or death based on or arising from, out of, or in connection with the actual or alleged use, operation, delivery or transportation of the Equipment.
7.3 The Lessor agrees to be solely responsible for all of the warranty costs, maintenance, operating costs and expenses related to or in any way connected or associated with the use and operation of the Equipment during the Term. The Lessor shall at all times and at the Lessor’s own expense keep the Equipment in good and efficient working order and repair and shall furnish any and all parts, mechanisms and devices required to keep the Equipment in good mechanical and working order.
7.4 The Lessor, its employees and/or specifically appointed agents shall at all reasonable times have access to the Equipment for the purpose of inspecting it.
7.5 The Lessee shall not, without the prior written consent of the Lessor, make any alterations, additions or improvements to the Equipment. All such alterations, additions or improvements so made shall belong to and remain the property of the Lessor.
7.6 The Lessee acknowledges and agrees that the Lessor is not responsible for the pick-up, return or replacement of any Equipment that is damaged, malfunctions or fails to perform.
7.7 The Lessee agrees not to remove or cover any tag, barcodes or nameplate appearing on the Equipment.
7.8 The Lessee agrees not to remove any “Shockwatches” installed on any Equipment. If any item of Equipment is returned and it is determined that a “Shockwatch” has been removed, a fee of $100.00 will be charged to the Lessee for labour costs related to the thorough inspection of the Equipment.
7.9 It is the Lessee’s responsibility to examine and test the Equipment immediately upon receipt and prior to the acceptance of delivery. the Lessor does not guarantee, assume responsibility for or make any representation in respect of the performance or resu...
LOCATION AND USE OF EQUIPMENT. You shall give Us at least 15 days prior written notice before moving the Equipment from the location set forth above to a different location. The notice must include the mailing address of the new location so that Consumables are sent to the new location. You shall not sell or otherwise transfer any rights in the Equipment unless You first get Our permission. You shall use the Equipment in accordance with all laws, operating manuals and Xerox service agreements.
LOCATION AND USE OF EQUIPMENT. Lessee shall be solely responsible to install the Equipment or have it installed, to inspect the Equipment during installation, upon completion of installation to test the Equipment and to accept it pursuant to the terms of this Lease. The full risk of loss arising out of or in connection with delays, partial performance or nonperformance by supplier(s) shall be on Lessee, and Lessor shall not be liable for specific performance of this Lease or for damages if, for any reason, any supplier delays or fails to fill or improperly fills an order. During the term of this Lease, the Equipment shall be located at the address specified in the Equipment Schedule and shall not be removed from that address without the prior written consent of Lessor. Lessee covenants and warrants that during the period that any Equipment is leased to Lessee, or its successors or assigns, the Equipment will at all times be used and operated in compliance with the laws of the jurisdictions in which it is located, and in compliance with all acts, rules, regulations, and orders of any commission, board or other legislative, administrative, or judicial body or officer having power to regulate or supervise the use or operation of the Equipment. Lessee shall not install or use the Equipment in such manner or in such circumstances that any part of the Equipment is deemed to be an accession to other personal property or deemed to be real property or a fixture thereon.
LOCATION AND USE OF EQUIPMENT. Lessee shall keep the equipment at the location designated in the Lease, unless Lessor in writing permits its removal. Said equipment shall be used solely in the conduct of Lessee's business and Lessee warrants that property leased is for commercial or business purposes and not for consumer, personal, home or family purposes.
LOCATION AND USE OF EQUIPMENT. (a) Supplier’s rights of possession, custody, and use of the Equipment shall commence on the date the Equipment is delivered to or obtained by Supplier and shall end upon the earlier of the termination of this Bailment Agreement, or such time as YETI notifies Supplier that such rights have ended. Until those rights end, Supplier may use the Equipment at the Site in the normal course of Supplier’s business for the exclusive limited purpose of manufacturing products for sale to YETI. Supplier shall cause the Equipment to be used in a safe, careful and proper manner by its personnel. Supplier shall provide YETI with periodic reports identifying the Equipment in Supplier’s possession and its condition. Supplier shall track, record and report to YETI on a quarterly basis the number of molding cycles endured by each specific item of Equipment during the quarter then ending in order for YETI to best estimate the remaining life of each item of Equipment
(b) Supplier shall exercise a commercially reasonable standard of care in handling, storing and using Equipment to protect the integrity and functionality of the Equipment, and shall subject the Equipment only to normal wear and tear. Supplier shall not utilize tools or processes that scratch, dent, penetrate, damage or crack the Equipment or otherwise disfigure, alter or mar the appearance of the Equipment, except for normal wear and tear.
(c) Supplier shall have no right to make any new Equipment or any duplicate of any Equipment unless specifically directed in writing to do so by YETI. Supplier shall not permit any third party to inspect, examine, photograph, videotape, record, or otherwise copy (electronically or otherwise) the image, design or specifications of any of the Equipment.
LOCATION AND USE OF EQUIPMENT. The Equipment shall be located and used only on the Premises and shall not be removed without prior written consent of the Manager. The Equipment shall be maintained and operated by competent employees only. The Owner shall pay all expenses of operating and maintaining the Equipment and shall insure the Equipment against normal perils, with loss payable to the Manager.

No Equipment shall be removed from the above address without the prior written consent of Lessor. Any relocation of the Equipment shall be at the risk and the expense of the Lessee and in accordance with the Manufacturer's specifications.
(b) Lessee covenants and warrants that during the period that any Equipment is leased to Lessee hereunder, such Equipment will at all times be used and operated in compliance with the laws of the jurisdictions in which it is located, and in compliance with all acts, rules, regulations, and orders of any commission, board or other legislative, administrative, or judicial body or officer having power to regulate or supervise the use or operation of the Equipment. Lessee shall not install or use the Equipment in such manner or in such circumstances that any part of the Equipment is deemed to be an accession to other personal property or deemed to be real property or a fixture thereon.
LOCATION AND USE OF EQUIPMENT. 12.1 The Hirer is responsible for selecting the site at which the Equipment is to be installed and for obtaining all necessary permits or approval required for the use of the equipment at that site.
12.2 Hirer must expressly inform AbiBird of the location of the Equipment during the Rental Period.
12.3 Hirer must not:
1) part with possession of the Equipment;
2) allow any other person to use the Equipment; or
3) permit removal of the Equipment from the location at which Hirer represented it would be located; without the prior written consent of AbiBird.
12.4 The Hirer must store the Equipment in a safe place, and do all other things necessary to
