Maintenance and Operating Expenses. The only maintenance or operating expense for which the Eligible User may be billed is gasoline or another fuel type required to operate the vehicle. All other maintenance and operating expenses are the responsibility of Contractor. Contractor shall only supply vehicles that have been maintained in accordance with manufacturer's requirements, industry standards, and all applicable laws.

If applicable and outlined in Appendix A, the College may require the Foundation to keep and maintain all such facilities and property in a clean and orderly condition and may require, at its own expense, at reasonably frequent intervals and in a lawful manner, dispose of all waste from the facilities. The College will provide at no cost to the Foundation certain facilities-related services. These include office space, telephones, utilities, custodial and facilities maintenance services.

The Auxiliary agrees that it shall keep and maintain all such facilities and property in a clean and orderly condition and shall, at its own expense, at reasonably frequent intervals, and in a lawful manner, dispose of all waste generated from its use of College facilities. The Auxiliary further agrees that it shall keep all such facilities and property in good repair. The Auxiliary shall provide reimbursement to the District for utility costs, maintenance and custodial costs relating to the facilities, as provided in Section 4.2 of this Agreement.

The NELNET Depositor's right to receive the Estimated Amount (as defined in the NELNET Indenture) from the Underlying NELNET Trust pursuant to Section 5.03 of the NELNET Indenture, which rights are being conveyed to the Trust pursuant to the NELNET Assignment Agreement and Section 2.5(b) hereof. Sublessee shall obtain the written consent of Sublessor prior to erecting any improvements on the Dock.

This Line Item includes those expenses directly assignable to the Terminal or Airfield Cost Centers and those expenses associated with Maintenance and Operating of the Airport that are not directly assignable but are allocated to the Airport Cost Centers. Allocable Airfield Maintenance and Operation Expenses include both Airfield and ARFF Maintenance and Operating Expenses.
