Common use of Meal and Rest Breaks Clause in Contracts

Meal and Rest Breaks. (a) The Employer shall make every reasonable effort to organize the work assignment on a shift in such a way as to allow each Nurse to have designated meal and rest break(s) at regular intervals during the shifts. (b) The Employer shall make every reasonable effort to ensure that no Nurse will work longer than five (5) consecutive hours without a break, unless mutually agreed between the Nurse and the Employer. (c) Nurses shall be permitted to combine meal and/or rest break(s) where operationally possible. (d) Operational requirements may require that Nurses remain on the nursing unit or within the facility for their designated meal and rest break(s). (e) Where operational requirements prevent a Nurse from having an uninterrupted meal or rest break(s) and it is not possible to reschedule the missed break(s) or a portion of the break(s) during the remainder of the shift, the Nurse shall be compensated for the portion of the missed meal period or rest period, at a rate of one and one-half times (1.5x) the Nurse’s hourly rate for the period of the rest and meal break(s) missed.

(f) The Nurse may elect to take her or his compensation for missed meal or rest breaks in time rather than pay. Where the Nurse elects time off, it shall be scheduled at a mutually agreed upon time. Not applicable to a Nurse Practitioner.

(ed) Where operational requirements prevent a Nurse from having an uninterrupted meal or rest break(s) and it is not possible to reschedule the missed break(s) or a portion of the break(s) during the remainder of the shift, the Nurse shall be compensated for the portion of the missed meal period or rest period, at a rate of one and one-half times (1.5x) the Nurse’s 's hourly rate for the period of the rest and meal break(s) missed. (e) Where it is known to the Employer that an overtime assignment is to be in excess of four (4) hours, the Nurse who is required to work the overtime beyond her or his scheduled hours of work shall be granted a fifteen (15) minute paid break prior to the commencement of the overtime.

(e) Where it is known to the Employer that an overtime assignment is to be in excess of four (4) hours, the Nurse who is required to work the overtime beyond their scheduled hours of work shall be granted a fifteen (15) minute paid break prior to the commencement of the overtime.‌

The Union and the Employer agree that, in lieu of paying for missed breaks as provided in Article 7.05(d), the Employer may provide the Nurse additional break time at the equivalent rate (from Letter of Understanding).
