Mediation of Grievance. Prior to requesting final and binding arbitration, the Authority and the Union may elect to participate in mediation upon mutual agreement. A mediator from State Mediation and Conciliation Services will be utilized unless the parties mutually agree on an alternative mediator. All discussions in the mediation are confidential and may not be used in any subsequent hearing/arbitration or dispute resolution process. If the parties agree to participate in mediation, the timeframe for the Union to request arbitration shall be suspended until the working day after mediation is concluded. The cost of the mediator shall be split equally between the Authority and the Union.

Mediation of Grievance. By mutual written agreement, the parties may elect to enter into grievance mediation prior to submitting the grievance to final and binding arbitration. If mediation does not settle the issue(s) as covered in the grievance, the grievant has the right to file for arbitration within ten (10) business days.

  • Arbitration of Grievances If a grievance brought under Division B (GRIEVANCES) of this Article is not resolved at Step Three of that procedure, the Association may submit the matter to arbitration. Notice of intent to arbitrate (Appendix D) must be filed with the President of the University within twenty (20) working days of the date of the decision at Step Three.
