Other Prohibited Uses a. Promenade Park has been established as a focal point "event" park and the City desires to maintain the park at a "showcase" level. In addition to uses otherwise prohibited by state and federal law or this Sub-Grant, CMP funds may not be used: (1) to pay for capital improvements to a nursing home, or to build a nursing home; (2) to pay for nursing home services or supplies that are already the responsibility of the nursing home, such as laundry, linen, food, heat, staffing costs, etc.; (3) to pay the salaries of temporary managers who are actively managing a nursing home; (4) to recruit or provide LTC Ombudsman certification training for staff or volunteers, or investigate and work to resolve complaints; (5) for general operations or administrative salaries; (6) for facility maintenance activities intended to meet the minimum standards for nursing facilities as set forth in 42 C.F.R. Part 483; (7) for vendor payments and payroll obligations for a facility’s normal operations or for fulfillment of state or federal requirements; (8) for costs related to travel, bonuses, or other direct employee benefits; (9) for costs that are not specifically outlined in the applicant’s grant proposal or are already included in the facility’s cost report; or, (10) for projects, programs, goods, or services unrelated to improving the quality of life or quality of care of nursing facility residents.

Customer and its Users may not use the Service or take any action, directly or indirectly, that will result in excessive consumption or utilization of the Service or Bee Creek Network resources, or which may weaken network performance, as determined in Bee Creek’s sole discretion, such as (i) using the Service to host a web server site which attracts excessive traffic at Customer’s premises; (ii) continuously uploading or downloading streaming video or audio, USENET hosting, or continuous FTP uploading or downloading; (iii) and continued use of programs or commands which take a large amount of system resources, be that processor time, memory, network bandwidth, and/or drive space on the host system. This is for the security of our Customers and other Bee Creek Network users. OFFENSIVE OR HARMFUL INFORMATION FOR MINORS: Please be aware that the Internet may host material that is deemed unfit for viewers under the age of eighteen. Certain sites contain pictures and information that are considered harmful in nature and obscene. Customers and its Users are responsible for monitoring the viewing habits of minors. We have links to software that you may download to ensure children are safe from such sites.
Other Prohibited Uses. Neither party shall appropriate or use the other party's Confidential Information other than in furtherance of its obligations under this Agreement and/or the License Agreement. Neither party shall, by virtue of this Agreement alone, obtain any title to, or any interest or license in, any of the other party's Confidential Information.

The End User shall not directly, or indirectly, participate in any of the following acts: (1) provide any other person or entity, including any subcontractor, independent contractor, affiliate, or service provider of the End User, with access to or use of the Application Services; (2) modify, translate, adapt, or otherwise create derivative works or improvements, whether or not patentable, of the Application Services or any part thereof; (3) reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the Application Services or any part thereof, or to otherwise misuse the Application Services in any manner not expressly authorized by Xxxxxxxx; (4) remove, delete, alter, or obscure any trademarks or any copyright, trademark, patent, or other intellectual property or proprietary rights notices provided on or with the Application Services, including any copy thereof; (5) rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Application Services, or any features or functionality of the Application Services, to any person or entity (other than those allowed under this Agreement) for any reason, whether or not over a network or on a hosted basis, including in connection with the internet or any web hosting, wide area network (WAN), virtual private network (VPN), virtualization, time-sharing, service bureau, software as a service, cloud, or other technology or service; (6) remove, delete, efface, alter, obscure, translate, combine, supplement, or otherwise change any trademarks, copyright, patent, warranties, disclaimers, or other intellectual property rights, proprietary rights or other symbols, notices, marks, or serial numbers on or relating to any copy of the Application Services; (7) use the Application Services in violation of any law, statute, or regulation; and (8) use the Application Services for purposes of: (i) benchmarking or competitive analysis of the Application Services; (ii) developing, using or providing a competing software product or service; or (iii) any other purpose that is to Avonelle’s detriment or commercial disadvantage.
Other Prohibited Uses. Using the Property in any and all other ways that are inconsistent with the Conservation Purposes, including, without limitation, the construction and maintenance of golf courses, sod farms, helicopter pads, and airstrips.
