Our Performance Sample Clauses

Our Performance. We may appoint subcontractors, agents, affiliates, or partners to host, perform, modify, improve, enhance, or otherwise provide the Service Offerings or any components or portions thereof and to fulfill our obligations and exercise our rights under this Agreement. We shall be solely responsible for such third parties.

Our Performance. So that you can see how we are doing, every month we will publish our performance against the Key Performance Indicators listed in appendix 1. Periodically we will also carry out surveys to understand your view on our performance. Please don’t wait for the survey though; you can feedback at any time by speaking directly to your Business Partner. We welcome your feedback and aim to respond to all feedback received.

Our Performance. You acknowledge and agree that we shall not be liable for any damages or loss of any kind resulting from any unintentional error or omission by us in performing Mobile Deposit, in accordance with or unintentional deviation from the terms and conditions of this Agreement, including exhibits or addenda. Maintenance of Mobile Deposit or any related services may be performed from time-to-time resulting in interrupted service, delays or errors in Mobile Deposit or related services. Neither we nor our service providers can always foresee or anticipate technical or other difficulties related to access to or use of the services. These difficulties may result in loss of data, personalization settings, or other interruptions. Therefore, we shall not be responsible for the timeliness, deletion, non-delivery, or failure to store any user data, communications, or personalization settings in connection with your use of the services. Further, we shall not be responsible for the operation, security, functionality, or availability of any wireless device or mobile network, which you utilize to access the services. You agree to exercise caution when utilizing the services on your personal computer or wireless device and to use good judgment and discretion when obtaining or transmitting information. Financial information shown on your personal computer or wireless device while using the services reflects the most recent account information available to us, but it may not be current. You agree that we shall not be liable for any delays in the content, or for any actions you take in reliance thereon. If you need current account information you agree to contact us directly.

Related to Our Performance

  • Work Performance Xxxxxx agrees that all Services performed hereunder shall be performed on a best effort basis by employees, students, faculty, graduate assistants and staff having an appropriate experience and skill level and in compliance with the statement of work.

  • Excused Performance In case performance of any terms or provisions hereof shall be delayed or prevented because of compliance with any law, decree or order of any governmental agency or authority, whether the same shall be of Local, State or Federal origin, or because of riots, war, public disturbances, strikes, lockouts, differences with workmen, fires, floods, acts of God or any other reason whatsoever which is not within the control of the party whose performance is interfered with and which, by the exercise of reasonable diligence, said party is unable to prevent, the party so suffering may, at its option, suspend, without liability, the performance of its obligations hereunder during the period of such suspension of performance of duties hereunder.

  • Continuing Performance In the event of a dispute, the Owner and the Developer agree to continue their respective performance hereunder to the extent feasible in light of the dispute, including paying xxxxxxxx, and such continuation of efforts and payment of xxxxxxxx shall not be construed as a waiver of any legal right.

  • Time for Performance The term of this SOW Agreement shall begin on and end on _ (the “Initial Term”). The Initial Term may be extended as the parties may agree. The State may terminate this SOW for convenience upon thirty days prior written notice to the Contractor. If the Master Agreement should expire or otherwise terminate prior to the end of the term of this SOW Agreement, this SOW Agreement shall continue to the end of its existing term, unless or until terminated in accordance with the terms of this SOW Agreement, and the Parties acknowledge and agree that the terms of the Master Agreement shall survive and apply to this SOW Agreement.
