Loss of Data. In the event of loss of any State data or records where such loss is due to the intentional act, omission, or negligence of the Contractor or any of its subcontractors or agents, the Contractor shall be responsible for recreating such lost data in the manner and on the schedule set by the Contract Manager. The Contractor shall ensure that all data is backed up and is recoverable by the Contractor.

Loss of Data. In the event of loss of any State data or records where such loss is due to the intentional act or omission or negligence of the Contractor or any of its subcontractors or agents, the Contractor shall be responsible for recreating such lost data in the manner and on the schedule set by the Contract Monitor. The Contractor shall ensure that all data is backed up and recoverable by the Contractor. Contractor shall use its best efforts to assure that at no time shall any actions undertaken by the Contractor under this Contract (or any failures to act when Contractor has a duty to act) damage or create any vulnerabilities in data bases, systems, platforms, and/or applications with which the Contractor is working hereunder.
Loss of Data. In the event of loss of any data or records necessary for the performance of this Contract, where such loss is due to the error or negligence of the Contractor, subcontractors, or agents, the Contractor shall be responsible, irrespective of cost to the Contractor, for recreating such lost data or records on a schedule set by the State Project Manager.

The Contractor acknowledges that the Authority‟s Data is the property of the Authority and the Authority hereby reserves all Intellectual Property Rights which may subsist in the Authority‟s Data. The Contractor shall not delete or remove any notices contained within or relating to the Authority‟s Data. 29.2. The Contractor shall not store, copy, disclose, or use the Authority‟s Data except as necessary for the performance by the Contractor of its obligations under this Contract or as otherwise expressly authorised in writing by the Authority. 29.3. To the extent that Authority‟s Data is held and/or processed by the Contractor, the Contractor shall supply that Authority‟s Data to the Authority as requested by the Authority in the format specified in Section 4 (Services Scope). 29.4. The Contractor shall take responsibility for preserving the integrity of the Authority‟s Data and preventing the corruption or loss of the Authority‟s Data. 29.5. The Contractor shall perform secure back-ups of all Authority‟s Data and shall ensure that up-to-date back-ups are stored off-site. The Contractor shall ensure that such back-ups are available to the Authority at all times upon request and are delivered to the Authority at no less than three monthly intervals. 29.6. In the event that the Authority‟s Data is corrupted, lost or sufficiently degraded as a result of any Default by the Contractor the Authority may, in addition to any other remedies that may be available to it either under this Contract or otherwise: 29.6.1. require the Contractor (at the Contractor's expense) to restore or procure the restoration of Authority Data and the Contractor shall do so as soon as practicable but not later than one month; and/or 29.6.2. the Authority may itself restore or procure restoration of the Authority‟s Data and shall be repaid by the Contractor any reasonable expenses incurred in doing so. 29.7. If at any time the Contractor suspects or has reason to believe that the Authority‟s Data has or may become corrupted, lost or sufficiently degraded in any way for any reason, then the Contractor shall notify the Authority immediately and inform the Authority of the remedial action the Contractor proposes to take.
Loss of Data. Adverity shall not be liable for any loss of, or damage to, data or programs to the extent that such loss or damage would have been avoided or mitigated by adequate preventative measures of Customer.
Loss of Data. Neither we nor our service providers can always foresee or anticipate technical or other difficulties related to the Mobile Banking Service. These difficulties may result in loss of data, personalization settings or other Service interruptions. Neither we nor any of our service providers assumes responsibility for the timeliness, deletion, misdelivery or failure to store any user data, communications or personalization settings in connection with your use of the Service.

In the event of any act, error or omission, negligence, misconduct, or breach that compromises or is suspected to compromise the security, confidentiality, or integrity of Citizens Data or the physical, technical, administrative, or organizational safeguards put in place by Vendor that relate to the protection of the security, confidentiality, or integrity of Citizens Data, Vendor shall, as applicable: (a) notify Citizens in accordance with appliable laws and regulations; (b) cooperate fully with Citizens in investigating the occurrence, including making available all relevant records, logs, files, data reporting, and other materials required to comply with applicable laws or regulations or as otherwise required by Citizens; (c) in the case of PII, at Citizens’ sole election, (i) notify the affected individuals who comprise the PII as soon as practicable but no later than is required to comply with applicable law, or, in the absence of any legally required notification period, within five (5) calendar days of the occurrence; or, (ii) reimburse Citizens for any costs in notifying the affected individuals; (d) in the case of PII, provide third-party credit and identity monitoring services to each of the affected individuals who comprise the PII for the period required to comply with applicable law, or, in the absence of any legally required monitoring services, for no less than twelve (12) months following the date of notification to such individuals; (e) perform or take any other actions required to comply with applicable law as a result of the occurrence; (f) without limiting Citizens’ obligations of indemnification as further described in this Agreement, indemnify, defend, and hold harmless Citizens for any and all Claims (as defined herein), including reasonable attorneys’ fees, costs, and expenses incidental thereto, which may be suffered by, accrued against, charged to, or recoverable from Citizens in connection with the occurrence; (g) be responsible for recreating lost Citizens Data in the manner and on the schedule set by Citizens without charge to Citizens; and, (h) provide to Citizens a detailed plan within ten (10) calendar days of the occurrence describing the measures Vendor will undertake to prevent a future occurrence. Loss of Data. You agree that, should your data be lost or destroyed as a result of a failure or interruption of your computer systems, you are responsible for all consequences resulting from such systems failure or interruption. You are responsible for verifying the accuracy and completeness of all transactions conducted through Online Banking, including those affected by any system failure or interruption.
Loss of Data. ‌ In the event of loss of any State of Florida Data or record where such loss is due to the negligence of Contractor or any of its Subcontractors or agents, Contractor shall be fully responsible for recreating such lost State of Florida Data in the manner and on the schedule set by the Department, in addition to any other damages the Department may be entitled to by law or this Contract. Contractor shall bear the full cost for recreating any lost State of Florida Data and will not be entitled to any compensation by the Department for those costs. This section shall survive termination or expiration of this Contract.
