Common use of Overtime Meal Break Clause in Contracts

Overtime Meal Break. (a) An employee required to work overtime in excess of one and a half hours after working ordinary hours shall be allowed a meal break of twenty minutes before commencing overtime work and thereafter upon completing each four hour period until the overtime work is finished and such meal breaks shall be paid for at the ordinary rate. (b) An employee required to work overtime in excess of one and a half hours prior to the ordinary commencement time shall be allowed a meal break at the ordinary commencement time at the ordinary rate. (c) Linfox and employee may agree to any variation of this provision to meet the circumstances of the work in hand provided that Linfox shall not be required to make any payment in respect of any time allowed in excess of twenty minutes.
