Overview of Dispute Resolution Process. Spotlease is committed to participating in a consumer-friendly dispute resolution process. To that end, these Terms provide for a two-part process for individuals to whom Section 19.1 applies: (1) an informal negotiation directly with Spotlease’s customer service team, and (2) a binding arbitration administered by the American Arbitration Association (“AAA”) using its specially designed Consumer Arbitration Rules (as modified by this Section 19 and except as provided in Section 19.6). Specifically, the Consumer Arbitration Rules provide:
19.2.1 Claims can be filed with AAA online (xxx.xxx.xxx);
19.2.2 Arbitrators must be neutral and no party may unilaterally select an arbitrator;
19.2.3 Arbitrators must disclose any bias, interest in the result of the arbitration, or relationship with any party;
19.2.4 Parties retain the right to seek relief in small claims court for certain claims, at their option;
19.2.5 The initial filing fee for the consumer is capped at $200;
19.2.6 The consumer gets to elect the hearing location and can elect to participate live, by phone, video conference, or, for claims under $25,000, by the submission of documents;

Overview of Dispute Resolution Process. 15.3.1.1 The Dispute Resolution process is a progressive series of steps to resolve disputes by the NJHIN Manager and/or the NJHIN Advisory Council. Except as may otherwise be determined by a final, non-appealable judgment of a Court of competent jurisdiction to the contrary, or as the finding by the NJHIN Manager and/or the NJHIN Advisory Council otherwise may be modified by mutual agreement of the parties, the determination of the NJHIN Manager and/or the NJHIN Advisory Council or its designated Sub-Committee, as applicable, shall be final and binding upon all TDSOs.
A. The decision of the NJHIN Advisory Council, with certain exceptions, shall be a final determination.
B. Under the Dispute Resolution Process described in this Section 15, a dispute may be commenced by a TDSO, NJII and/or NJDOH against one or more other parties (a “Dispute”). The procedure set forth in this Section 15 shall be followed as closely as possible whether the Dispute is commenced by a TDSO or by NJII and NJDOH. The essential and interested persons and parties shall follow this Section 15’s applicable procedures, as nearly as possible, in order to achieve a mutually agreeable resolution.
C. All discussions, written, electronic and oral, arising out of or under the Dispute Resolution Process shall be treated as Offers to Compromise under Fed. R. Evidence 408 and applicable state law equivalent.
